CITY CLERK: Government Code Section 54952.3: The members of the City Council/Successor Agency are entitled to receive a total of $300.00 per month because of being elected to the City Council. They receive no other compensation for sitting as a member of Successor Agency. Consider Public Employee Performance Evaluation for the Position of: • City Manager Mayor Preciado re-opened the City Council meeting at 6:37 p.m. with nothing to report. PUBLIC COMMENT/ANNOUNCEMENTS & UNSCHEDULED APPEARANCES: Antony Lopez, City Manager mentioned that their a misprint on the agenda has been corrected & updated on the website. CONSENT CALENDAR: All items listed under the consent calendar are routine and enacted by one motion: (Action). A. Consider City of Avenal/Successor Agency’s Approval of Minutes for April 27, 2023. B. Consider Entering into a one (1) Year Fire Services Agreement with Kings County Fire Department for FY 2023/24 (Resolution 2023-24). Council Member/Successor Agency Member Verdugo motioned to approve Consent Calendar, seconded by Council Member/Successor Agency Member Hernandez, and motion carried. City Manager Lopez reported the following: 1) 18-inch transmission line; 2) Grants tracking; 3) Public Works - returning employee will be integrating with Public Works Dept., Animal Control will need an Animal Control Officer I, and hiring for Summer Staff. Also, keeping up with all departments and updating Major Project List as needed. ACTIVITY REPORTS/SPECIAL PRESENTATIONS & COMMITTEE REPORTS: A. Activity Reports: 1. Public Works/Code Enforcement/Animal Control Departments Activity Report: Rob Williams, Public Works Director. Scott Davis, Public Works Supervisor, reported on the following: 1) Code Enforcement; 2) Park & Landscaping; 3) Streets;4) Water Distribution; 5) Wastewater Collection; and 6) Vehicle, Equipment, & Building Maintenance. 2. IT Department Activity Report: Humberto Bermudez, IT Manager. Humberto Bermudez, IT Manager reported the following: 1) continuing services Internet, Phone system, Emails, Server, Clerk software; and 2) Other: -Works with Police to attempt camera troubleshooting -Sets up PA system for Old Timers Day Parade -Attend year-in-review meetings with Jamf and SHI. -Attend Broadband funding meeting hosted online at Fresno State. -Continues to work with KCAG to allow regular remote viewing and participation of their monthly meetings -Continues to maintain the city website and provide tech support across all facilities. 3. Recreation Department Activity Report: Shelia Verdugo, Community Activities Supervisor. Shelia Verdugo, Community Activities Supervisor reported the following: 1) Update- Old Timer’s Day Weekend, Rotary Spaghetti Feed – Served 100+, Avenal Assembly of God Breakfast Buffet – Served, Parade –entries: Color Guard CDC, Favorite Son Councilmen Verdugo, Favorite Daughter Carol Casida and Grand Marshal Jose Ramirez, Softball Tournament – 4 teams (2 local, 1 Huron and1 Lemoore), Park Vendors – 19 Information/Merchandise and 8 Food. Food-Activities – Pony’s/Train/Bounce Houses/Carnival Games/Sensory Friendly/Corn Hole/Horseshoes • Performances – Avenal Youth Cheer Program A) Tar Canyon Tour – 15 cars approximately 45-50 people B) Discovery Well Sunset Tour – 10 Cars – 19 people; 2) Summer Kidz Spot: • Lunch Program set and ready to feed kids • Anna working on scheduling 1 field trip • KCAO sponsoring 49 kids – First come first served – must write an essay about why they want to be a part of the program and working on getting Summer Staff hired 3) KCBH: • Missed a zoom meeting Monday – waiting to get a new date; 4) Up Coming Rentals: • Rec Center – May 12 – California Health Collaborative • Rec Center – May 19th & 20th – Valley Voices • Pavilion – May 13th & 20th • Theater – May 20th – AHS Prom (???) • Vet’s Hall – May 26 – LEAP Organization 5) Circus: • 45 free tickets taken to the Senior Program • Kids tickets handed out in the Parade; 6) Consulate: • Anna is still waiting on a call back. I believe Antony was also going to email to see if he can get an answer. Anna said she knows they are booked through July according to their website. 7) Fireworks/Patriotic Program • Waiting to hear back from Riverdale for music • Approved to utilize the AHS Football Stadium – However, staff will be discussing potentially program and activities in the Park and shooting the show from the AHS stadium. Staff will call the Pyro tech and KCFD out to get their thoughts. 8) Family Teatime • We cancelled Saturday’s teatime due to the Theater vandalism. We will reschedule for a later date; and 9) Sensory Night • We will be scheduling a meeting with the Families of Children with Special Needs, to begin planning the July Sensory Night at the Theater B. Consider Suspending Tier III Water Conservation Measures for Water Year 2023/2023 (March 2023 – February 2024): City Manager Lopez reported that as of May 2, 2023, City Staff was made aware of the Bureau of Reclamation’s announcement that Central Valley Project water contracts would be provided with 100% of contracted allocation (Attached). For the City of Avenal, that means 3,500-acre feet is being made available to use for the 2023-2024 water year (March 1, 2023 – February 29, 2024). Staff is still awaiting to receive updated contract allocation letters from USBR. This is great news for the community, considering the very wet season the previous winter provided, and reports that 2023 will be an El Niño year, meaning higher than expected precipitation throughout the year. One important aspect to remember, that in order for the City to increase its historic allocation (actual used water during full 100% wet water allocation years), the City and community need to utilize as much of the 3,500 ac. ft. allocation to increase the historic allocation from the current 2,480 average. This means the water usage needs to increase ASAP to begin increasing the historic use. Staff is recommending that for the 2023-2024 water year, that Council suspend the currently enacted Tier III Water Conservation Measures, to be revisited in March 2024 pending a new water year and allocation. Speaking with Utilities Staff, we believe that even with the full allotment of 3,500 ac. ft., the community may only fully utilize 2,800 ac. ft., and the city may need to consider selling a portion of the allocation to another customer if possible. If any additional water is needed beyond the 3,500- ac. ft., currently Section 215 water is available at half the cost, but it will not count towards the historic use. Section 215 water is only. Staff recommends by Resolution adopt a temporary suspension to the Tier III Water Conservation Measures for Water Year 2023/2023 (March 1, 2023 – February 29, 2024). Councilman Verdugo motioned to approve temporary suspension to the Tier III Water Conservation Measures for Water Year 2023/2023 (March 1, 2023 – February 29, 2024), second by Councilman Hernandez and carried.
