The percentage increase should not exceed 5%, based on the CPI- U for the Miami -Fort Lauderdale -West Palm Beach area for the prior 12 months, measured from April to April. Stormwater rates shall be adjusted annually to reflect these changes. BACKGROUND A. OVERVIEW The City of Aventura (" City") operates, maintains, and improves the City' s Stormwater Drainage Management System. The system includes over 12 miles of underground pipe, approximately 28 miles of streets, over 800 drainage structures, 44 drainage wells, and 57 outfalls. The City is responsible for protecting people and property from harmful stormwater runoff. The Stormwater System is a capital -intensive enterprise requiring continuous investment in extensive above- and below -ground infrastructure. Continued investment is crucial for the community's health and safety and future economic growth and prosperity. B. STORMWATER REVENUES Pursuant to Chapter 166 and Section 403 of the Florida Statutes, the City is authorized to construct, reconstruct, repair, improve, and extend stormwater drainage management systems. It is also authorized to establish just and equitable rates, fees, and charges for the services and facilities provided by the stormwater system. The Stormwater Utility Fund was established on August 5, 1997, per Ordinance No. 97- 18, to provide for the collection, storage, treatment, and conveyance of stormwater within the City. A stormwater utility fee is assessed against each developed property within the City for services and facilities provided by the Stormwater System. Ordinance No. 97- 18 provides that the rate per Equivalent Residential Unit ( ERU) is used in calculating Stormwater Utility Fees and is set by Resolution of the City Council after a public hearing. Currently, ERUs are assigned as follows: Single -Family Dwelling Units: 1. 0 ERU Multi -Family Dwelling Units: 1. 0 ERU per dwelling unit Non -Residential Developed Properties: 1 ERU per 1, 548 square feet of impervious area Rate History: Effective October 1, 1997: $ 2. 00/ ERU per month ( Resolution No. 97- 61) Effective October 1, 1998: $ 2. 50/ ERU per month ( Resolution No. 98- 85) Effective October 1, 2016: $ 3. 50/ ERU per month ( Resolution No. 2016-49) C. FUNDING STRATEGY FOR FUTURE CAPITAL INVESTMENTS The Stormwater Utility Fund is budgeted annually and recovered through stormwater utility rates charged to ratepayers. This funding level enables only smaller, incremental projects, taking decades to address all necessary improvements without revenue growth. Since October 1, 2016, when the stormwater rate was last changed, the Consumer Price Index ( CPI) has increased by 39. 2%. To stay current with industry standards and avoid large periodic rate jumps, it is recommended to index stormwater rates to the CPI for inflation, not exceeding 5%, based on the CPI- U for the Miami -Fort Lauderdale -West Palm Beach area for the prior 12 months, measured from April to April.
