BOARD OF ALDERMEN Meeting Minutes January 10, 2022 7:00 PM 1 GOVERNMENT CTR. BALLWIN, MO 63011 THE MINUTES ARE PREPARED IN SUMMARY TO REFLECT THE OVERALL DISCUSSIONS, NOT VERBATIM QUOTES. The meeting was called to order by Mayor Pogue at 7:00 p.m. ROLL CALL Present Absent Mayor Tim Pogue Alderman Mike Utt Alderman Michael Finley Alderman Kevin M. MINUTES___________________________________________________________________ The minutes from the December 13, 2021 Board of Aldermen meeting were submitted for approval. A motion was made by Alderman Bullington and seconded by Alderman Roach for an amendment to the voting result for Rebecca Bullington under Historical Commission appointments (Mayor’s Report) to reflect that Alderman Bullington abstained from voting. A voice vote was taken with unanimous affirmative result and the motion passed. A motion was made by Alderman Fleming and seconded by Alderman Finley to approve the minutes from the December 13, 2021 Board of Aldermen meeting as amended. A voice vote was taken with unanimous affirmative result and the motion passed. The minutes from the December 13, 2021 Board of Aldermen closed meeting were submitted for approval. A motion was made by Alderman Fleming and seconded by Alderman Stallmann to approve the minutes from the December 13, 2021 Board of Aldermen closed meeting as submitted. A voice vote was taken with unanimous affirmative result and the motion passed. City of Ballwin- Board of Aldermen Meeting Minutes January 10, 2022 1 BOARD OF ALDERMEN Meeting Minutes January 10, 2022 7:00 PM 1 GOVERNMENT CTR. BALLWIN, MO 63011 CITIZEN COMMENTS_______________________________________________________ Gary Ross, 922 Claybend, addressed the Board regarding Clayton Ridge parking concerns and the Wolf Café. Mr. Ross cited several examples of problems he and/or neighbors have seen which they believe are a result of people being overserved at the Wolf. He urged the Board to revoke the Wolf’s liquor license. Alderman Fleming asked Mr. Ross about the petition which has been mentioned at several meetings but never turned in. Mr. Ross claimed there were two petitions but said he did not have a copy to give to the Board. Alderman Fleming asked him to get a copy turned in to the City Administrator’s Office. LEGISLATION_______________________________________________________________ BILL 4114 - AN ORDINANCE REVISING SPEED SCHEDULES AND ADDING A NO-POINT SPEEDING VIOLATION TO THE CODE OF ORDINANCES OF THE CITY OF BALLWIN. A motion was made by Alderman Fleming and seconded by Alderman Finley for a first reading of Bill 4114, title only. A voice vote was taken with unanimous affirmative result and Bill 4114 was read for the first time. Discussion: Alderman Finley asked if this is to keep in line with state law. City Attorney Jones responded that it is. Alderman Roach asked if this bill is the product from previous discussion; City Attorney Jones replied it is. Mayor Pogue further clarified that the Board had previously agreed to use option one for the bill. Alderman Roach asked if there is still an option for point violations; City Attorney Jones stated there is and further explained how that would work. Alderman Roach also asked if this would make ticket writing more uniform for officers; City Attorney Jones responded that it would. A motion was made by Alderman Roach and seconded by Alderman Stallmann for a second reading of Bill 4114, title only. A voice vote was taken with unanimous affirmative result and Bill 4114 was read for the second time. A roll call vote was taken for passage and approval of Bill 4114 with the following results: Ayes – Aldermen Finley, Roach, Stallmann, Leahy, Fleming, Bullington, Kerlagon Nays -- None. Bill No. 4114 was approved and became Ordinance No. 22-01 City of Ballwin- Board of Aldermen Meeting Minutes January 10, 2022 2 BOARD OF ALDERMEN Meeting Minutes January 10, 2022 7:00 PM 1 GOVERNMENT CTR. BALLWIN, MO 63011 BILL 4115 - AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF BALLWIN, MISSOURI, ON BEHALF OF THE CITY, TO EXECUTE A DEPOSITARY AGREEMENT WITH UMB BANK, N.A. A motion was made by Alderman Fleming and seconded by Alderman Bullington for a first reading of Bill 4115, title only. A voice vote was taken with unanimous affirmative result and Bill 4115 was read for the first time. Discussion: None A motion was made by Alderman Stallmann and seconded by Alderman Bullington for a second reading of Bill 4115, title only. A voice vote was taken with unanimous affirmative result and Bill 4115 was read for the second time. A roll call vote was taken for passage and approval of Bill 4115 with the following results: Ayes – Aldermen Finley, Roach, Stallmann, Fleming, Leahy, Bullington, Kerlagon Nays -- None. Bill No. 4115 was approved and became Ordinance No. 22-02 CONSENT ITEMS____________________________________________________________ Administration – Six-Month Revenue/Expenditure Statement Staff recommends approval of the six-month revenue/expenditure statement. Discussion: None A motion was made by Alderman Fleming and seconded by Alderman Leahy to approve the consent item as submitted by staff. A voice vote was taken with unanimous affirmative result and the motion passed. Administration – Kabuki Sushi & Thai Liquor License Staff recommends approval of the liquor license for Kabuki Sushi & Thai. Discussion: None A motion was made by Alderman Fleming and seconded by Alderman Leahy to approve the consent item as submitted by staff. A voice vote was taken with unanimous affirmative result and the motion passed. City of Ballwin- Board of Aldermen Meeting Minutes January 10, 2022 3 BOARD OF ALDERMEN Meeting Minutes January 10, 2022 7:00 PM 1 GOVERNMENT CTR. BALLWIN, MO 63011 MAYOR’S REPORT__________________________________________________________ Nothing to report CITY ADMINISTRATOR’S REPORT___________________________________________________ City Administrator Sterman reported that the bid opening for construction bids for the new police department building will be on Tuesday (1/11/22). We should have a recommendation for the Board at the next meeting. CITY ATTORNEY’S REPORT_________________________________________________ Nothing to Report. STAFF REPORT_____________________________________________________________ Public Works – Claymont Dr. STP Project Staff is requesting Cochran Engineering be allowed to submit a Proposal and an Application to East West Gateway for the above project. Discussion: Public Works Director Jim Link stated they would like to submit an application for the Claymont Dr. STP project for the 2025 budget year. Alderman Fleming stated he appreciates staff continuing to investigate these and as he understands, this is not necessarily a given, but there would be no charge for us to reapply. Alderman Roach asked if this was the same approach used for the Holloway project; Mr. Link stated it is identical. A motion was made by Alderman Fleming and seconded by Alderman Bullington to allow Cochran Engineering to submit a proposal and application to East West Gateway. A voice vote was taken with unanimous affirmative result and the motion passed. ALDERMANIC COMMENTS_________________________________________________ Alderman Roach talked about the Creve Coeur Police Department building and that there is a page on Creve Coeur’s website detailing everything that is happening with it, thus educating the public in one spot. He believes that would be a good idea for us as well. City Administrator Sterman stated that Creve Coeur had gone to the voters for the building funding, so they are making use of social media to share information on the building. Mr. Sterman also stated that we definitely want to put out materials on our website or other social media to educate Ballwin’s residents on our new building. City of Ballwin- Board of Aldermen Meeting Minutes January 10, 2022 4 BOARD OF ALDERMEN Meeting Minutes January 10, 2022 7:00 PM 1 GOVERNMENT CTR. BALLWIN, MO 63011 Alderman Finley asked if everyone would be in favor of a Public Health & Safety committee meeting on January 24 before the regular Board meeting to continue discussion of the Clayton Ridge parking situation or should we just continue to schedule meetings. Alderman Fleming stated he was not opposed, but felt that the meetings as they have been scheduling were the most productive. Mayor Pogue stated they have not heard back from the trustees on future meetings yet. Alderman Stallmann stated that he and the Mayor have had several meetings with the trustees, the property owner and the Wolf Café owner and that dates have been sent to try and get something scheduled as they need to work together towards a compromise. Alderman Stallmann asked about the car door break in ordinance that had been discussed at the previous meeting. City Attorney Jones stated that he had shared materials with the Prosecuting Attorney and that, in 2017, an overhaul of the entire criminal code was done to bring it in line with state statute, so we already have this in place; the ordinance was adopted in 2018 so no further legislation is needed. A motion was made by Alderman Fleming and seconded by Alderman Finley to adjourn.
