MINUTES The minutes from the January 13, 2025 Board of Aldermen meeting were submitted for approval. A motion to approve as submitted was made by Alderman Frank Fleming and seconded by Alderman Michael Finley. A voice vote was taken with unanimous affirmative result and the motion passed. BALLWIN, MO 63011 CITIZEN COMMENTS________________________________________________________ Ryan Kerr, 950 Bellestri Drive, spoke to the Board of Aldermen about the Brightfield Subdivision potentially wanting to annex into the City of Ballwin and what that would entail. Mayor Tim Pogue noted that subdivision is in the City’s required five year annexation plan, but it has yet to be approved by St. Louis County. Lori Stringer, 347 Oakleigh Woods Drive, and Eileen Graessle, 232 Old Ballwin Road, spoke to the Board of Aldermen about the upcoming “Ballwin Grows Native” February event and invited the Board to come out to the event. LEGISLATION_______________________________________________________________ Bill 5011- AN ORDINANCE AMENDING SECTION 17-17 OF THE CODE OF ORDINANCES OF THE CITY OF BALLWIN WITH RESPECT TO ASSAULT UPON A LAW ENFORCEMENT ANIMAL. A motion was made by Alderman Frank Fleming and seconded by Alderman Michaely Finley for a first reading of Bill 5011, title only. A voice vote was taken with unanimous affirmative result and the motion passed. Alderman Fleming read Bill 5011, title only. A motion was made by Alderman Frank Fleming and seconded by Alderman Michael Finley for a second reading of Bill 5011, title only. A voice vote was taken with unanimous affirmative result and the motion passed. Alderman Fleming read Bill 5011, title only. A roll call vote was taken for passage and approval of Bill 5011 with the following results: Aye: Aldermen Utt, Finley, Stallmann, Fleming, Weaver, Siegel, Lehmkuhl Nay: None Bill No. 5011 was approved and became Ordinance No. 25-01. Bill 5012 - AN ORDINANCE PROHIBITING THE DISCHARGE OF A FIREARM WITHIN OR INTO THE CITY LIMITS. A motion was made by Alderman Mark Stallmann and seconded by Alderman Frank Fleming to table Bill 5012, at the request of Chief John Bergfeld. A voice vote was taken with unanimous affirmative result and the motion passed. BALLWIN, MO 63011 Bill 5013 - AN ORDINANCE AMENDING SECTION 7.5-1 OF THE CODE OF ORDINANCES OF THE CITY OF BALLWIN WITH RESPECT TO VIDEO SERVICES. A motion was made by Alderman Mark Stallmann and seconded by Alderman Frank Fleming for a first reading of Bill 5013, title only. A voice vote was taken with unanimous affirmative result and the motion passed. Alderman Stallmann read Bill 5013, title only. CONSENT ITEMS____________________________________________________________ Administration – Mi Lupita Liquor License Staff recommends Board approval for Mi Lupita’s liquor license for their new location at 100 Holloway Road. Discussion: Alderman Mark Stallmann asked when Mi Lupita would be opening. The petitioner noted they had planned on a surprise opening Thursday, pending approval of the liquor license. Alderman David Siegel asked if there were any issues with the owner. Police Chief John Bergfeld noted they’ve had no issues and the family has been fantastic to work with. A motion was made by Alderman Frank Fleming and seconded by Alderman Mike Utt to accept staff’s recommendation. A voice vote was taken with unanimous affirmative result and the motion passed. MAYOR’S REPORT__________________________________________________________ Mayor Tim Pogue noted he attended a meeting about HJR27, a bill that mirrors Better Together, the failed proposal to merge St. Louis and St. Louis County. He noted it was a packed room and the majority of the people attending opposed the bill and noted he does not support anything that will cut services and raise taxes for citizens of Ballwin. BALLWIN, MO 63011 CITY ADMINISTRATOR’S REPORT__________________________________________________ City Administrator Eric Sterman noted the Planning & Zoning Commission Meeting was cancelled for Monday, but there will be one in March. He also noted there will be a Parks & Recreation Citizen Advisory Committee meeting. He also noted there have been water temperature concerns at the Pointe indoor pool, but the temperatures have since come back to normal and the Department is looking at a long term fix. He also noted the City had looked into concerns over parking at Lock Drive and Manchester Road. The Public Works Department has added a dead end sign above the street sign and they’re looking at adding no parking signs. The previous signs had been moved at some point. City Administrator Sterman also noted the City is in a dead period in regards to annexation until the map plan is approved by the St. Louis County Boundary Commission. The City did receive a petition for voluntary annexation at Arbor Trails. The Board of Election Commission certified the petition does meet the 75 percent threshold requirement. The next step is for the City to check out the number of police calls to that area, the Public Works Department needs to check out the streets and a plan of intent has to be submitted as to how the City would handle annexation. The Boundary Commission would then use that to determine if an annexation can be allowed.​ CITY ATTORNEY’S REPORT_________________________________________________ None. STAFF REPORTS____________________________________________________________ Administration – 326 Turfwood Drive Fence Staff recommends the Board approve the fence permit for 326 Turfwood Drive with a five foot setback for the fence. City Administrator Eric Sterman noted this matter was debated at the previous Board of Alderman meeting. City Planner Lynn Sprick noted there is now input submitted from the Police & Public Works Department and approval from one of the Board of Trustees of the neighborhood. Alderman David Siegel noted he is okay with the three feet setback the petitioner is requesting as the homes in this neighborhood are smaller. He also noted he would like to see police do a traffic study at that location to see if a stop sign would help alleviate some of the concerns with the fence placement there. Public Works Director Jim Link agreed that a stop sign on that corner would eliminate people flying through that neighborhood. Alderman Michael Finley noted after some consideration, he would be okay with a three foot setback. Alderman Mark Stallmann agreed. BALLWIN, MO 63011 Alderman Frank Fleming noted part of the reason for wanting a five foot setback for the fence was because of the height of the fence and noted a stop sign might help with the issue. Chief John Bergfeld noted there are not a lot of accidents in that area, so it would not fall under City policy for a traffic study in that area. City Administrator Sterman noted the Board has a stop sign policy in place and it would need to be codified to override the analysis needed for the stop sign. Alderman Frank Fleming noted moving the stop sign back five feet versus three feet probably would not make much of a difference. He also noted he was okay with three feet as long as the City looks into the possibility of a stop sign at that intersection. A motion was made by Alderman David Siegel and seconded by Alderman Mark Weaver to allow a three foot setback for a fence along the sidewalk at Towerwood and the owners acceptance of conditions set forth by the City. A voice vote was taken with unanimous affirmative result and the motion passed. ALDERMANIC COMMENTS__________________________________________________ Alderman Michael Finley thanked Mayor Tim Pogue for going to the meeting regarding HJR27. Alderman Mark Stallmann agreed, and noted our citizens deserve the same services at no extra cost. He also recognized Troop 357 who was in the audience during the Board meeting. Alderman Mike Utt noted he wanted staff to continue to check on Lock Drive to make sure the sign does not disappear again.
