MINUTES ​ The Minutes of the​ from the May 14, 2018, Board of Aldermen meeting were submitted for approval. ​ A motion was made by Aldermans Stallmann and seconded by Alderman Terbrock to approve the minutes from the May 14, 2018, Board of Aldermen meeting and minutes from the June 11, 2018 Board Planning Session as submitted. A voice vote was taken with a unanimous affirmative result and the motion passed. ​ The Minutes of the​ from the June 11, 2018 Board Planning Session were submitted for approval. ​ A motion was made by Alderman Stallmann and seconded by Alderman Bullington to approve the minutes from the May 14, 2018, Board of Aldermen meeting and minutes from the June 11, 2018 Board Planning Session as submitted. A voice vote was taken with a unanimous affirmative result and the motion passed. PUBLIC COMMENTS Tim Fitch​, 1903 Lance End Drive, introduced himself to the Board and informed them of his intentions to run for St. Louis County Council representing District 3. Michael Scott​, 643 Kehrs Mill Rd, addressed the Boards in regards to the City of Ballwin’s Comprehensive Plan. He stated he was opposed to hiring a firm to complete a plan for the City. Board President Fleming opened the floor for the Public Hearing by asking if anyone present wished to speak in​ favor​ of the proposal. No one came forward to speak in favor of the proposal. Board President Fleming asked if anyone present wished to speak in ​opposition​ of the proposal. No one came forward to speak in opposition of the proposal. Board President Fleming closed the Public Hearing. LEGISLATION BILL NO. 3993​ ​AN ORDINANCE ORDERING THE INSTALLATION BY MISSOURI AMERICAN WATER COMPANY OF ONE FIRE HYDRANT AT SEVENTY-SEVEN SEVEN TRAILS DRIVE A motion was made by Alderman Bullington and seconded by Alderman Leahy for a first reading of Bill No. 3993, title only. A voice vote was taken with a unanimous affirmative result and Bill No. 3993 was read for the first time. A motion was made by Alderman Bullington and seconded by Alderman Kerlagon for a second reading of Bill No. 3993, title only. A voice vote was taken with a unanimous affirmative result and Bill No. 3993 was read for the first time. A roll call vote was taken for passage and approval of Bill No. 3993 with the following results: Ayes – Aldermen Terbrock, Finley, Roach, Stallmann, Fleming, Leahy, Bullington, Kerlagon; Nays -- None. Bill No. 3993 was approved and became ​Ordinance No. 18-07 BILL NO. 3994​ AN ORDINANCE PROHIBITING THE ACCEPTANCE OF NEW STREET LIGHTS BY THE CITY OF BALLWIN A motion was made by Alderman Leahy and seconded by Alderman Kerlagon for a first reading of Bill No. 3994, title only. A voice vote was taken with a unanimous affirmative result and Bill No. 3994 was read for the first time. Discussion ensued between the members of the Board and City Attorney Jones about this ordinance and whether the City has the ability to compel an HOA to pay for street lights. City Attorney Jones did not think the City could compel an HOA to pay for street lights. Members of the Board pointed out that it was not fair to expect some residents to pay for their street light and not all residents. They asked that another solution be found. Staff will work to provide options for the Board to consider at the next meeting.Ballwin has attempted, unsuccessfully, to purchase street lights from Ameren numerous times in order to save money. This Bill will be presented at the next Board meeting. BILL NO. 3996​ ​AN ORDINANCE ADOPTING AN ANNEXATION MAP FOR THE CITY OF BALLWIN A motion was made by Alderman Stallmann and seconded by Alderman Terbrock for a first reading of Bill No. 3996, title only. A voice vote was taken with a unanimous affirmative result and Bill No. 3996 was read for the first time. A voice vote was taken with a unanimous affirmative result and the motion passed. STAFF REPORTS PUBLIC WORKS​ ​BRUSH/WOOD CHIPPER PURCHASE Superintendent of Streets, Jim Link, summarized that $90,000 was budgeted for the purchase of a brush/wood chipper. Bids were solicited to three dealers and advertised. Only two bids were received. Staff asked the Board to award the purchase of a new brush/wood chipper to Fabick Caterpillar, the lowest bidder, for $72,720.00. City of Ballwin – Board of Aldermen Meeting Minutes ​DRAFT June 25, 2018 Page 3  A motion was made by Alderman Terbrock and seconded by Alderman Bullington to accept staff’s recommendation to approve the purchase of a new brush/wood chipper from Fabick Caterpillar. A voice vote was taken with a unanimous affirmative result and the motion passed. BUILDING CODE DEPARTMENT​ ​BUILDING CODE UPGRADE Director of Development and Assistant City Administrator, Andy Hixson, ​recommended updating the current building code from the 2006 IBC/IRC to the 2015 IBC/IRC, ​taking into consideration approval of certain amendments, as recommended by staff.​ The Board would need to draft legislation for future discussions, as it would need to be available for resident review 90 days before action can be taken. A motion was made by Alderman Stallmann and seconded by Alderman Finley to draft legislation to upgrade the building code in the City of Ballwin. A voice vote was taken with a unanimous affirmative result and the motion passed. ALERMANIC COMMENTS Alderman Terbrock​ asked about policy on flaggers during road and utility construction. City Administrator Hanson stated the City has been having a problem with this happening lately. Efforts have been made in regards to working with the utility companies on this issue. Essentially the City has no control over where the utility company is working or over the contractors doing the work for the utility companies. Alderman Bullington​ thanked everyone involved with Ballwin Days. He thanked everyone who came out and attended the event. Alderman Leahy​ asked if anything was being done regarding the parking lot next to McDonalds on Manchester. City Administrator Hanson stated he spoke with the owner of ELCO. He articulated, to the owner, that the property was not in compliance. He also informed the property owner that the property needs to become in compliance with Ballwin’s Ordinances otherwise corrective actions will be pursued through the City Attorney. A motion was made by Alderman Stallmann and seconded by Alderman Terbrock to adjourn the Board of Aldermen Meeting.
