MINUTES The Minutes from the February 11, 2019, Board of Aldermen meeting were submitted for approval. A motion was made by Alderman Finley and seconded by Alderman Leahy to approve the minutes from the February 11, 2019 Board of Aldermen meeting. A voice vote was taken with a unanimous affirmative result and the motion passed. The Minutes from the February 11, 2019, closed session meeting were submitted for approval. A motion was made by Alderman Finley and seconded by Alderman Leahy to approve the minutes from the February 11, 2019 closed session meeting as submitted. A voice vote was taken with a unanimous affirmative result and the motion passed. BALLWIN, MO 63011 John Hoffman, Interim Director of Parks and Recreation, explained February 4,, 2019, there was an unfortunate incident at the Pointe, but thanks to the efforts of our aquatic staff and Metro West everything turned out okay. John Hoffman then introduced Deputy Chief Medical Officer Brad Shelton of Metro West Fire Protection District to describe what happened. On February 4, 2019, a patron at The Pointe became unconscious in the hot tub. Headguard Melanie Oestreich sprang into action activating the facility's Emergency Action Plan signaling to her teammates there was a medical emergency. Quickly, lifeguards Anthony Eberhardt, Ben Becker, and Reid Lawson took on different rolls by clearing the pool, gathering the medical bag and AED, and assisting Melanie with the unconscious patron. Swim Instructor Isabella Duran assisted with making sure other patrons safely cleared the pool, crowd control, and comforting the friend of the patron involved. Aquatics Manager, Liz Renaud promptly called 9-1-1 and EMS arrived within minutes. With the help of an eye witness, Melanie and the other lifeguards were able to move the patron from the hot tub onto the ground and perform their primary assessment to indicate he did have a pulse and was breathing. The patron remained in and out of consciousness until EMS arrived. The guards remained by the side of the patron, assessing his condition, providing appropriate care and asking questions to keep him alert. The gentleman was transported to St. Luke’s Hospital and he was able to go home that night. Deputy Chief Shelton along with Lt. Jake LeSeure, who transported the gentleman to the hospital, and Capt. Todd Barger, who was first on the scene, recognized Pointe lifeguards and staff for the huge difference made by their quick action in getting this gentleman above water. Plaques were presented to Anthony Eberhardt, Reid Lawson, Isabella Duran, Ben Becker, Melanie Oestreich, and Liz Renaud. Deputy Chief Shelton again thanked these six heroes, the first responders of the first responders. Employee Recognition Awards Haley Morrison, Human Resource Coordinator, explained how the Above and Beyond award is to recognize someone who steps outside the role of their daily duties and goes above and beyond to be of help to others. The members of the appreciation committee, Lynne Reiche, James Boyd, Chuck Loyd, and Gina Abbacchi, put a lot of time and consideration in reviewing the applications for recognition to ensure the right individuals are acknowledged. The 2018 Above and Beyond awards were presented to John Lott, Shane Kelly and Andrew Noyes. This crew was recognized for their quick thinking and aid to a resident in need when she got her car stuck on an inlet. Tony Ewing was named as the 2018 Michael Flamion Employee of the Year. Under Tony's leadership, employees from all departments worked together along with residents to display 660 U.S. Flags in Vlasis Park during July 2018. Flags for Forgotten Soldiers is a traveling memorial that helps to raise awareness of the suicide rate among military veterans and was maintained for two weeks before being transferred to the next destination. She thanked Tony for his service to our country, the City of Ballwin and for bringing people together to organize this worthy cause. BALLWIN, MO 63011 UNFINISHED BUSINESS____________________________________________________ BILL NO. 4019 AN ORDINANCE SETTING THE REAL ESTATE TAX RATE OF ZERO (0%) PERCENT IN THE CITY OF BALLWIN FOR THE FISCAL PERIOD BEGINNING JANUARY 1, 2019 AND ENDING DECEMBER 31, 2019. A motion was made by Alderman Roach and seconded by Alderman Stallmann to amend the bill as written and a first reading of amended Bill No. 4019, title only. A voice vote was taken with a unanimous affirmative result and Bill No. 4019 was read for the first time. A motion was made by Alderman Finley and seconded by Alderman Leahy for a second reading of Bill No. 4019, title only. A voice vote was taken with a unanimous affirmative result and Bill No. 4019 was read for a second time. A roll call vote was taken for passage and approval of Bill No. 4019 with the following results: Ayes – Aldermen Finley, Roach, Stallmann, Fleming, Leahy, Bullington, Kerlagon; Nays -- None. Bill No. 4019 was approved and became Ordinance No. 19-07 PUBLIC COMMENTS_______________________________________________________ Carleen Kramer, 202 Greenmore Drive, asked about the status of the Holloway Road Federally funded project and had an engineering firm been hired yet. Andy Hixson, Assistant City Administrator, responded the RFQ for engineering services will be released shortly. Carleen Kramer also commended the participants in the Polar Plunge. NEW BUSINESS ____________________________________________________________ BILL 4022 AN ORDINANCE REVISING THE AMOUNTS OF PERMIT FEES IN THE CITY OF BALLWIN A motion was made by Alderman Fleming and seconded by Alderman Stallmann for a first reading of Bill No. 4022, title only. A voice vote was taken with a unanimous affirmative result and Bill No. 4022 was read for the first time. In discussion of Bill No. 4022 Alderman Roach inquired about the schedule to revisit these fees every 4 years as per the timeline suggested previously by Mike Roberts. Robert Jones, City Attorney, cautioned against a hard date written in the ordinance. If the date were to be missed it could call into question all of the fees in the ordinance. Alderman Roach agreed to forego a hard date in the ordinance with assurances that the time frame for review would be followed. A motion was made by Alderman Fleming and seconded by Alderman Bullington for a second reading of Bill No. 4022, title only. Bill No. 4022 was approved and became Ordinance No. 19-08 BILL NO. 4023 AN ORDINANCE ESTABLISHING A FRAMEWORK FOR THE CITY OF BALLWIN AND ITS POLICE OFFICERS TO ENGAGE IN COLLECTIVE BARGAINING. A motion was made by Alderman Fleming and seconded by Alderman Finley for a first reading of Bill No. 4023, title only. A voice vote was taken with a unanimous affirmative result and Bill No. 4023 was read for the first time. In discussion of Bill No. 4023 Alderman Finley asked that reference to City Hall in the bill should be changed to Government Center and City Council should be Board of Aldermen. A motion was made by Alderman Finley and seconded by Alderman Stallmann to amend Bill No. 4023 to change the terminology in the ordinance from City Hall to Government Center and City Council to Board of Aldermen. A voice vote was taken with a unanimous affirmative result and Bill No. 4023 was amended. A motion was made by Alderman Fleming and seconded by Alderman Bullington for a second reading of Bill No. 4023, title only. A voice vote was taken with a unanimous affirmative result and Bill No. 4023 was read for a second time. A roll call vote was taken for passage and approval of Bill No. 4017 as amended with the following results: Ayes – Aldermen Finley, Roach, Stallmann, Fleming, Leahy, Bullington, Kerlagon; Nays -- None. Bill No. 4023 was approved and became Ordinance No. 19-09 CONSENT ITEMS____________________________________________________________ a. Parks: Replacement of Sand in Pool Filters b. Public Works: 2 Ton Truck Purchase Alderman Roach asked John Hoffman if the company replacing the sand would also be replacing any broken laterals and how any broken laterals would play into additional costs. John Hoffman expressed that he does not expect laterals to be a big issue at either pool. A motion was made by Alderman Stallmann and seconded by Alderman Roach to accept Consent Items A and B as submitted. A voice vote was taken with unanimous affirmative result and the motion passed. BALLWIN, MO 63011 MAYOR’S REPORT _______________________________________________________ Mayor Pogue thanked everyone who sponsored the Ballwin team for the Polar Plunge. The Ballwin Team raised over $5,000 for Special Olympics which was the highest in the law enforcement division. We also look forward to doing it again next year, especially Chief Scott. INTERIM - CITY ADMINISTRATOR’S REPORT ____________________________________ Interim City Administrator Kuntz spoke to the building signage that will be designated as the Government Center or City Hall. A voice vote/show of hands confirmed the building will be referred to as Government Center. Interim City Administrator Kuntz next spoke concerning the address for the New Government Center. The circle in front of the New Government Center will be named as a new street. The St. Louis County GIS coordinator told us Ballwin could not be in the street name leaving the next options as Government Court or Government Circle or Government Way. Alderman Fleming did not like Court or Circle, could we use Government Drive or Government Lane. Alderman Finley asked about Liberty Drive or something more distinctive. The options put forward for first and second choice by the aldermen are Government Center Drive and Government Center Lane. A motion was made by Alderman Fleming and seconded by Alderman Bullington to have the City Attorney draft an ordinance for naming of the new street. A voice vote was taken with unanimous affirmative result and the motion passed. Park Director interviews will be conducted at the later part of next week. The chairman of the committee, Alderman Leahy, has volunteered to participate as much as his schedule allows in the formal interviews. Polly Moore was introduced as the new recording secretary. A press release has been drafted to help answer questions about the Better Together proposal. It is an informative piece that specifically outlines the actions this Board has taken as well as providing a comprehensive list of contacts the public can use to get more information or the voice their opinion on the topic. This will be posted on our website tomorrow as well as released to the press as appropriate. County Councilman Fitch will be added to the contacts. Alderman Fleming set the Finance Committee meeting for March 11th at 6:00 pm and an agenda will be sent out. BALLWIN, MO 63011 STAFF REPORTS ____________________________________________________________________ Administration: Denise Keller Annual Compensation Review Denise Keller, presented her recommendation of a 3% salary increase for full time employees effective April 1, 2019. This would be consistent with the local market and affordable based on our tax receipt trends. A motion was made by Alderman Fleming and seconded by Alderman Stallmann approve staff recommendation of a 3% salary increase for full-time employees effective April 1, 2019. A voice vote was taken with unanimous affirmative result and the motion passed. Public Works: Jim Link, Status update on Dodge Truck Purchase Jim Link, Director of Public Works, thanked Royal Gate Dodge for helping locate 16 2017 Dodge 5500 trucks in Tennessee. We were able to purchase the 2017 Dodge 5500 for $47,899. Alderman Roach reviewed the approved limit of $55,000 and acknowledged that Alderman Leahy was correct. Mayor Pogue asked if a second truck should also be purchased now with this unexpected availability. If funds are available from current budget, a second truck could be purchased with the same guidelines as the current purchase. A motion was made by Alderman Fleming and seconded by Alderman Kerlagon to approve purchase of a second 2017 Dodge 5500 truck with a limit of $61,703 and available budget restrictions. A voice vote was taken with unanimous affirmative result and the motion passed. Public Works: Jim Link, Asphalt Purchase A motion was made by Alderman Stallmann and seconded by Alderman Bullington to approve staff recommendation of awarding the contract to the only bidder, Fred Weber, and to accept alternate bid #2. A voice vote was taken with unanimous affirmative result and the motion passed. Public Works: Jim Link, Concrete Purchase A motion was made by Alderman Roach and seconded by Alderman Stallmann to approve staff recommendation awarding this contract at the bid unit price for the two types of concrete, including the alternate bids, to the low bidder, Valley Material Co.: A voice vote was taken with unanimous affirmative result and the motion passed. Public Works: Jim Link, Crushed Rock Purchase Alderman Roach asked if the cheaper delivery charge is why the bid from Bussen Quarries was recommended. Jim Link said yes and explained their trucks could deliver larger loads and our trucks would have to be emptied or converted in order to make rock pickups. A motion was made by Alderman Stallman and seconded by Alderman Bullington to approve staff recommendation awarding this unit price contract to Bussen Quarries including the alternate bids: A voice vote was taken with unanimous affirmative result and the motion passed. BALLWIN, MO 63011 Public Works: Jim Link, Sand Purchase Mayor Pogue asked why only one bid this year. Jim Link explained that Winter Brothers responded that they are out of sand by 10:00 am every morning and he did not know why Simpson Materials did not respond. Fred Weber attended the bid opening but declined to submit a bid. A motion was made by Alderman Leahy and seconded by Alderman Bullington to approve staff recommendation awarding this contract at the bid unit price to the only bidder, Bussen Quarries: A voice vote was taken with unanimous affirmative result and the motion passed. CITY ATTORNEY’S REPORT________________________________________________ City Attorney Jones explained he has been discussing with the City of Winchester the possibility of taking over Winchester’s municipal court services. Municipal court services are minimal in Winchester and staff feels they could be handled without undue stress on our current resources. Last week, City Attorney Jones drafted a contract and sent it to Winchester for their consideration. This includes a monthly flat fee of $1,000 to administer Winchester court services. Winchester would collect their own court fines and local fees. City Attorney Jones then explained Chief Scott has discussed the possibility of providing police services to the City of Winchester. Currently Winchester contracts with St. Louis County through December 31, 2019 and they must respond by July 2019 to terminate the contract. Ballwin Police has written an overview contract that has been given to City Attorney Jones to review. In question is does the Board want to tie the two contracts for court and police services together. Alderman Roach recommended not tying the contracts together but maybe offering a discount if both are contracted with Ballwin. Alderman Stallmann expressed that separate would be fine so that we could take over their court services immediately and could help show that municipalities can work together within the current framework in St. Louis County. CLOSED SESSION __________________________________________________________ The Board moved to go into closed session for one or more of the reasons as authorized by Section 610.021(1), (2) and (3) Revised Statutes of Missouri, relating to legal issues, real estate and/or personnel, negotiation of a contract. A motion was made by Alderman Stallman and seconded by Aldermann Leahy to go into closed session. A roll call vote was taken with a unanimous affirmative result.
