The meeting was called to order by Mayor Pogue at 7:00 p.m.

MINUTES
The minutes from the March 13, 2023 Board of Aldermen meeting were submitted for approval.
A motion to approve the minutes as submitted. was made by Alderman Michael Finley and seconded by
Alderman Ross Bullington. The motion passed unanimously.
PRESENTATIONS____________________________________________________________
New Ballwin Police Officer Rachel Stark was sworn in by Chief Doug Schaeffler.

LEGISLATION_______________________________________________________________
Bill 4165- AN ORDINANCE AUTHORIZING THE CITY OF BALLWIN TO EXECUTE A CONTRACT
RETAINING SPECIAL LEGAL COUNSEL FOR THE LIMITED PURPOSE OF PROVIDING ADVICE
AND DIRECTION WITH RESPECT TO A DATA SECURITY INCIDENT.
A motion was made by Alderman Mark Stallmann and seconded by Alderman Michael Finley for a first reading
of Bill 4165, title only. The motion passed unanimously and the bill was read for the first time.
Discussion:
Alderman Kevin Roach questioned whether this is something the City of Ballwin should have asked for
an RFQ for.
City Administrator Eric Sterman and City Attorney Bob Jones noted that the City’s insurance company requires
the use of their selected law firm in matters such as these, and this is the firm that is preferred by the insurance
company.
A motion was made by Alderman Michael Finley and seconded by Alderman Ross Bullington for a second
reading of Bill 4165, title only. The motion passed unanimously and the bill was read for the second time.
A roll call vote was taken for passage and approval of Bill 4165.
Bill No. 4165 was approved unanimously and became Ordinance No. 23-11.
Bill 4166 - AN ORDINANCE SETTING THE REAL ESTATE TAX RATE OF ZERO (0%) PERCENT IN
THE CITY OF BALLWIN FOR THE FISCAL PERIOD BEGINNING JANUARY 1, 2023 AND ENDING
DECEMBER 31, 2023
A motion was made by Alderman Michael Finley and seconded by Alderman Mark Stallmann for a first reading
of Bill 4166, title only. The motion passed unanimously and the bill was read for the first time.
A motion was made by Alderman Mark Stallmann and seconded by Alderman Michael Finley for a second
reading of Bill 4166, title only. That motion was approved unanimously and the bill was read for the second
time.
A roll call vote was taken for passage and approval of Bill 4166.
Bill No. 4166 was approved unanimously and became Ordinance No. 23-12.

Bill 4167- AN ORDINANCE ADOPTING LICENSING PROVISIONS OF THE ST LOUIS COUNTY
ELECTRICAL CODE, AMENDING SECTION 7-42 AND REPLACING ALL OTHER ORDINANCES AND
PARTS OF THE ORDINANCES IN CONFLICT THEREWITH.
A motion was made by Alderman Mark Stallmann and seconded by Alderman Kevin Roach for a first reading
of Bill 4167, title only. The motion was approved unanimously and the bill was read for the first time.
Discussion:
There is a 90-day waiting period before this bill will be read for a second time, under state statute.

MAYOR’S REPORT__________________________________________________________
Mayor Tim Pogue congratulated the City of Ballwin for receiving the Certificate of Achievement for Excellence
in Financial Reporting Award from the Government Finance Officers Association for the 2021 Annual
Comprehensive Financial Report.
CITY ADMINISTRATOR’S REPORT___________________________________________________
City Administrator Eric Sterman also congratulated the City for receiving the GFOA Award. He also spoke
about the New Ballwin Road construction that will cause some disruptions in traffic for the next several months.
City Administrator Sterman also provided an update to the construction at Holloway Park, stating the pavilion
has been completed and work on the playground will be forthcoming.
City Administrator Sterman also discussed the $10,000 deductible needed for the law firm for the data security
incident. Alderman Mark Stallmann made a motion to approve, Alderman David Siegel seconded the motion.
The motion was approved unanimously.
CITY ATTORNEY’S REPORT_________________________________________________
There is a new associate at City Attorney Bob Jones’ law firm, Kyle Cronin, who may be Bob Jones’ backup if
he cannot make it to the meetings.

STAFF REPORTS____________________________________________________________
Police Department – Police Vehicle purchase
Staff recommends the purchase of one 2023 Dodge Durango Pursuit V-8 from Lou Fusz Auto Network at
a cost of $42,833.
Alderman Ross Bullington made a motion to accept staff’s recommendation. It was seconded by Alderman
Kevin Roach. The motion was approved unanimously and staff’s recommendation was accepted.
ALDERMANIC COMMENTS__________________________________________________
Alderman Mark Stallmann noted that Holloway Park is looking good already and he is excited to see how the
finished product looks.
Alderman Michael Finley noted there is a Public Health & Safety Committee meeting Monday, April 10th at
6:00 p.m. to discuss mosquito fogging.
CLOSED SESSION__________________________________________________________
A motion was made by Alderman Mark Stallmann and seconded by Alderman Kevin Roach to move to closed
session. The motion was passed by unanimous affirmative voice vote and the meeting moved to closed session
at 7:19 p.m.
After the Board returned to open session, a motion was made by Alderman Stallmann to reconvene. The
motion was seconded by Alderman Utt and passed by a unanimous voice vote at 7:56 p.m. Alderman
Stallmann then made a motion to adjourn which was seconded by Alderman Finley. The motion passed by a
unanimous voice vote and the meeting was adjourned at 7:57 p.m.
