This is the portion of the meeting set aside for general public comment directly related to City business, for matters that do
not appear on this evening’s agenda. If you are here for a specific agenda item that is under Unfinished Business or New
Business, please wait until we reach that item. Items under First Reading & Referral will be discussed when they return
under Unfinished Business, and we will hear public comment at that time. Public comment requires a person to state your
name and whether you are a resident of Bangor. The City Council has adopted a Public Comment Policy that we will
adhere to. Statements during public comment should respect the dignity and seriousness of the proceeding, and individuals
will be restricted to speaking once. Obscene, truly threatening, or overly repetitive comments will be deemed out of order
and will be interrupted and removed. Topics that are considered out of order also include matters that are in litigation,
individual employees or employee groups discussing matters for which complaint or grievance procedures are in place,
personal disputes between the speaker and another resident not germane to City business, support for or opposition to any
candidate for political office, and personnel complaints pertaining to individual City employees. There is a time limit of
three minutes per speaker, and the total time allowed for general public comment regarding City business will be limited to
no more than one hour. The public comment period is for City Council members to listen and not to respond or debate
with persons. If you do not live in Bangor or own property in Bangor, please allow those who do to have the opportunity to
speak first. If you’d like to offer comment on any item directly related to City business not appearing on the regular
agenda, you may approach the podium. Individuals who have appropriately pre-registered to give public comment via
remote means will be given the opportunity to participate remotely. Alternatively, Councilors may be reached via email

Executive Summary: This Order will authorize the execution of a municipal quitclaim deed for real estate
located at 36 Grove Street. Tax liens have matured on the property owned by John Price and Jennifer
Price, at 36 Grove Street. The outstanding charges due the City have been paid. Because the liens matured,
a municipal quitclaim deed is required to release the City's interest in the property.

matured, a municipal quitclaim deed is required to release the City's interest in the property.

Representing Transit Drivers
Executive Summary: This Order authorizes the execution of a Collective Bargaining Agreement between
the City of Bangor and the American Federation of State, County, and Municipal Employees, Local 926,
Council 93 representing the Public Works employees. The City of Bangor and the Union entered into
negotiations on May 5, 2026, to bargain the agreement expiring on February 5, 2026. A tentative
agreement was reached on July 2, 2026, and has been ratified by the Union members. The agreement was
reached based on guidelines established by the City Council for a three-year term from July 1, 2026, to
June 30, 2029. The tentative agreement was reviewed by the City Council in Executive Session on July 13,
2026.
26-241 ORDER Authorizing the City Manager to Enter into a DEANE
Construction Contract with DBU Construction, Inc. to
Horizontal Directional Drill Under I-95 for Sewer
Improvements
Executive Summary: This Order will authorize the City Manager to enter into a construction contract
with DBU Construction, Inc, to horizontal directional drill under I-95 for sewer improvements. The
Engineering Department recently solicited bids for the I-95 Sewer Crossing Project. The project includes
horizontal directional drilling under I-95 approximately 475 feet. This project is needed to provide sewer
capacity to the Penjajawoc sewer subsection, as detailed in a sewer and pump station report by Haley Ward
in 2025. The Engineering Department solicited bids from six contractors that have experience in this type
of work. Only one contractor, DBU Construction Inc., submitted a bid. The bid is within budget and can
be done within the City's time frame.
The Engineering Department recommends awarding the project to DBU Construction, Inc. and is
requesting authorization for the City Manager to enter into a construction contract with DBU Construction,
Inc., of Epsom, New Hampshire, in the amount of $933,000.00.

Executive Summary: On February 25, 2026, the Bangor City Council established a standing Legislative
Committee to liaise with the City’s state legislative delegation and other elected officials on legislative matters
of City interest; provide the City’s state legislative delegation and other elected officials with input on legislative
proposals; and seek sponsorship of legislation in the City’s interest.
Council wishes to include additional duties and responsibilities within the scope of the standing Legislative
Committee to permit the Committee to engage in conversations with candidates for office other than candidates
for Bangor City Council, partners, and other stakeholders on topics falling within the purview of the Legislative
Committee.
This item is being amended by substitution so it is clear that the permitted conversations with candidates for
office do not include candidates for Bangor City Council.

Opinion)
Executive Summary: This Ordinance will amend Chapter 33, Code of Ethics, to add sections 33-22 (Response
Deadline) and 33-23 (Council Response to an Ethics Board Advisory Opinion). This addition to the City’s Code
of Ethics would establish a deadline of 120 days for the City’s Board of Ethics to field a referral from the City
Council, conduct its work, and draft and issue its written advisory opinion to the City Council. It also provides
the framework for the Ethics Board to request an extension of the 120-day deadline if the Board cannot complete
its investigation and issue its written findings within the 120 days. The deadline is intended to be sufficient for
most matters while preserving Council oversight over the pace of the process, and while providing flexibility in
instances where additional time is needed.
The addition to the Ethics Code also provides a procedure for the Council to follow when the Ethics Board’s
written advisory opinion is received by the Council. Currently, the City’s Ethics Code does not contain any
procedure for the Council to follow after receiving an Ethics Board advisory opinion.
The proposed addition also provides a framework for considering an appropriate penalty in the event the
City Council finds a violation(s) of the Code of Ethics has occurred. This item was reviewed and
recommended for approval at the Government Operations Committee meeting on July 6, 2026.

Agreement with Bangor Housing Development
Corporation for a Portion of the Property Addressed at
205 Corporate Drive
Executive Summary: This Order authorizes the execution of a Credit Enhancement Agreement with
Bangor Housing Development Corporation for a portion of the property addressed at 205 Corporate Drive.
The Bangor Housing Development Corporation has an option to purchase from the City of Bangor the
noted property for the purpose of constructing 30 units of supportive housing. This district will capture the
added value to the property for investment back into the property as the city may choose. This Credit
Enhancement Agreement proposed to return 75% of the real estate taxes paid on the subject property,
contained in the proposed TIF district for a period of thirty (30) years.
Under the requirements of the City Policy, this Credit Enhancement Agreement meets the General
Principles to encourage new affordable housing investment. It is also in keeping with the 2022
Comprehensive Plan for affordable housing and supportive housing creation, as well as the Council's
priorities for housing development.
Under the Maine Statute §5250-A, affordable housing tax increment financing, this is a public hearing.

Executive Summary: This Order would find that Councilor Wayne Mallar's conduct at the August 14,
2025, Historic Preservation Commission meeting violated three provisions of the City's Code of Ethics and
would impose a requirement that Councilor Mallar undergo training with the City's Legal Department on
the appropriate use of titles and disclaimers.
Councilor Mallar approached the Commission during a recess of the meeting while some members of the
public, including the person with an application before the Commission at that meeting, were not present
in the hearing room. Councilor Mallar made comments to at least one Commissioner within hearing range
of other Commissioners regarding the subject matter of the pending application. Whether Councilor
Mallar's statements to the Commissioners were being made in his capacity as a City Councilor or as a
private citizen was left ambiguous. By approaching the Commission during a recess without the applicant
present and discussing the subject matter of the pending application, Councilor Mallar's actions could
diminish public confidence in the integrity of the City's government.
This matter was investigated and reviewed by the City's Board of Ethics, and the Board submitted a written
advisory opinion to the Council. This order follows the recommendations made by the Board, including
finding that Councilor Mallar's actions violated Sec. 33-13.1(B)(2)(c) of the City's Code of Ethics, which
prohibits a City Councilor from using his title unless the official makes it clear and unambiguous that the
official is speaking in his individual capacity and not on behalf of the City Council, Sec. 33-13.1(C), which
places an affirmative duty on a City Councilor when there could be ambiguity to make a disclaimer
indicating he is speaking in his individual capacity and not on behalf of the City Council, and Sec. 33-1,
which requires City Councilors to maintain a standard of conduct that will inspire public confidence in the
integrity of the City's government.
This order also follows the Ethics Board's findings that Councilor Mallar's actions did not violate Sec. 33-
13.1(D) or any additional provision of the Code of Ethics.

ORDINANCE, Amending Chapter 33, Code of Ethics, To Add Sections 33-22 (Response Deadline) and 33-23
(Council Response to an Ethics Board Opinion)
WHEREAS, at present, the City’s Code of Ethics contains no deadline for the City’s Board of Ethics to
complete its work upon a referral from the City Council, and does not contain any procedure for the City
Council to follow after receiving an Ethics Board advisory opinion; and
WHEREAS, the City desires to provide such a deadline with flexibility for requested extensions of time, and a
framework for the City Council to follow upon receiving an Ethics Board advisory opinion;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
Chapter 33 of the Code of Ethics of the City of Bangor is hereby amended as follows:
§ 33-22. Board of Ethics — Response Deadline.
A. Deadline for Findings. Upon receipt of a referral from the City Council pursuant to this Chapter, the Board of Ethics
shall issue its written advisory opinion to the City Council within 120 days of the date the referral is received by the
Board.
B. Extension Request. If the Board of Ethics determines that it cannot complete its review and issue written findings
within the 120-day period, the Board shall, prior to the expiration of that period, submit a written extension request
to the City Council. The extension request shall include:
(1) A statement of the reason or reasons the Board requires additional time;
(2) A proposed extended deadline by which the Board commits to issue its findings; and
(3) A summary of the Board's progress on the matter to date.
C. Council Action on Extension Request. The City Council shall consider the Board's extension request at its next
regularly scheduled meeting following receipt of the request. The Council may, by majority vote, approve the
requested extension, approve a modified extension period, or deny the extension.
D. Public Record. All extension requests submitted by the Board and all Council actions taken in response thereto shall
be part of the public record of the City Council.
E. Effect on Board Procedures. Nothing in this section shall be construed to limit the Board's authority to conduct
thorough and impartial fact-finding within the deadline established herein, or as extended by the Council. The Board
retains full authority to request voluntary statements, review records, and conduct hearings as otherwise provided in
this Chapter and the Board’s Procedural Rules within the applicable timeframe.

§ 33-23. Council Response to an Ethics Board Advisory Opinion
A. Duty to Act. Upon receipt of a written advisory opinion by the Board of Ethics that a City Councilor, board
member, or commission member has or has not violated a provision of this Chapter, the City Council shall place
the matter on the agenda of its next regularly scheduled meeting, or a special meeting called for that purpose,
occurring no later than thirty (30) days after the City Council's receipt of the Board's written advisory opinion.
B. Deliberation and Vote. At the meeting described in subsection A, the City Council may conduct any portions of
the Council’s deliberations, investigation, or fact-finding in executive session as provided in 1 M.R.S. §405(6)(A),
and shall deliberate on the Board's advisory opinion and publicly vote on one or more of the following responses:
(1) In the event the Ethics Board’s written advisory opinion concluded that there was no violation, the City
Council may:
(a) vote to take no further action on the matter; or
(b) deliberate and vote on whether the City Council finds that a violation(s) did or did not occur. The
City Council is not bound by the findings or the advisory opinion of the Ethics Board and may make
findings that are or are not consistent with the Ethics Board’s findings and opinion; or
(c) deliberate and vote on whether the Council wishes to conduct its own investigation into the matter.
In the event the City Council votes to conduct its own investigation into the matter, the Council shall
determine the parameters of the investigation, including but not limited to (1) identifying which
issue(s) the Council will be investigating, (2) determining which individual(s), if any, the Council will
request voluntary statements from, (3) determining which additional records, if any, the Council will
request for review, and (4) identifying any other items needed in order to adequately complete the
investigation.
(2) In the event the Ethics Board’s written advisory opinion concluded that there were one or more
violations of the Ethics Code, the City Council may:
(a) deliberate and vote on whether the City Council finds that a violation(s) did or did not occur. The
City Council is not bound by the findings or the advisory opinion of the Ethics Board and may make
findings that are or are not consistent with the Ethics Board’s findings and opinion; or
(b) deliberate and vote on whether the Council wishes to conduct its own investigation into the matter.
In the event the City Council votes to conduct its own investigation into the matter, the Council shall
determine the parameters of the investigation, including but not limited to (1) identifying which
issue(s) the Council will be investigating, (2) determining which individual(s), if any, the Council will
request voluntary statements from, (3) determining which additional records, if any, the Council will
request for review, and (4) identifying any other items needed in order to adequately complete the
investigation.
(3) In the event the City Council votes and determines that one or more violations of the Ethics Code
occurred, the Council shall deliberate and vote on the issue of an appropriate penalty, which may include
one or more of the following:
(a) the Council may vote that no penalty will be imposed, accompanied by a written statement of the
Council’s reasoning;
(b) Formal Censure — the Council may vote on whether to impose a public resolution formally censuring
the official, with written findings entered in the public record;

(c) Committee Removal — the Council may vote on whether to remove the official from one or more
committee or board assignments for a specified period not to exceed the remainder of the current
Council year;
(d) Civil Fine — the Council may vote on whether to impose a civil fine as authorized by §33-3 of the
City’s Code of Ethics, and as provided in §9-26 of the Code of the City of Bangor;
(e) Training Requirement — the Council may vote on whether to require that the official complete
specified training as a condition of continued service in assigned roles; or
(f) Other Lawful Action — the Council may vote to take any other lawful action the Council deems
appropriate and proportionate to the nature of the violation.
(4) In conducting the deliberations and voting described in this subsection B, a Councilor(s) who was (were)
the subject of the Ethics Board’s investigation and findings shall not participate in the Council’s
deliberations or vote(s), but shall be given the opportunity to speak on their own behalf and to offer a
defense to the allegations, including, in the event the Council chooses to conduct its own investigation,
the opportunity to request voluntary witness statements and to seek and present relevant documents
for the City Council’s review.
C. Public Record. The Board of Ethics written advisory opinion, the Council's deliberation (other than deliberation(s)
that occur(s) in executive session), and any action taken by the Council pursuant to this section shall be
maintained as part of the City’s public record.
D. Scope. This section applies to findings involving City Councilors, and, where applicable, to findings involving
board members or commission members whose conduct falls within the jurisdiction of the Board of Ethics under
this Chapter. This section does not alter the referral requirements or investigative procedures of the Board of
Ethics as otherwise set forth in this Chapter or the Board’s Procedural Rules.
§33-2224 Orientation meeting; annual report
A. All members shall attend an annual orientation meeting to be scheduled during the month of January of each
calendar year.
B. The Board shall meet at least quarterly and, prior to December 31 of each calendar year, shall prepare and
submit to the City Council an annual report outlining its doings during the preceding twelve-month period.

Development Corporation for a portion of the property addressed at 205 Corporate Drive.
The Bangor Housing Development Corporation has an option to purchase from the City of Bangor
the noted property for the purpose of constructing 30 units of supportive housing. This district will
capture the added value to the property for investment back into the property as the city may
choose. This Credit Enhancement Agreement proposed to return 75% of the real estate taxes paid
on the subject property, contained in the proposed TIF district for a period of thirty (30) years.
Under the requirements of the City Policy, this Credit Enhancement Agreement meets the General
Principles to encourage new affordable housing investment. It is also in keeping with the 2022
Comprehensive Plan for affordable housing and supportive housing creation, as well as the Council's
priorities for housing development.
Under the Maine Statute §5250-A, affordable housing tax increment financing, this is a public
hearing.

services are available and present for the residents of the facility 24 hours a day, and seven (7) days a week
and such other terms and conditions as appropriate and the Agreements shall in in a final form approved by

14, 2025, During a Recess of a Meeting of the City's Historic Preservation Commission, and Imposing a

This Order would find that Councilor Wayne Mallar's conduct at the August 14, 2025, Historic Preservation Commission
meeting violated three provisions of the City's Code of Ethics, and would impose a requirement that Councilor Mallar
undergo training with the City's Legal Department on the appropriate use of titles and disclaimers.
Councilor Mallar approached the Commission during a recess of the meeting while some members of the public,
including the person with an application before the Commission at that meeting, were not present in the hearing room.
Councilor Mallar made comments to at least one Commissioner within hearing range of other Commissioners regarding
the subject matter of the pending application. Whether Councilor Mallar's statements to the Commissioners were being
made in his capacity as a City Councilor or as a private citizen was left ambiguous. By approaching the Commission
during a recess without the applicant present and discussing the subject matter of the pending application, Councilor
Mallar's actions could diminish public confidence in the integrity of the City's government.
This matter was investigated and reviewed by the City's Board of Ethics, and the Board submitted a written advisory
opinion to the Council. This order follows the recommendations made by the Board, including finding that Councilor
Mallar's actions violated Sec. 33-13.1(B)(2)(c) of the City's Code of Ethics, which prohibits a City Councilor from using
his title unless the official makes it clear and unambiguous that the official is speaking in his individual capacity and not
on behalf of the City Council, Sec. 33-13.1(C), which places an affirmative duty on a City Councilor when there could be
ambiguity to make a disclaimer indicating he is speaking in his individual capacity and not on behalf of the City Council,
and Sec. 33-1, which requires City Councilors to maintain a standard of conduct that will inspire public confidence in the
integrity of the City's government.
This order also follows the Ethics Board's findings that Councilor Mallar's actions did not violate Sec. 33-13.1(D) or any
additional provision of the Code of Ethics.

Finding Councilor Wayne Mallar Violated Three Provisions of the City's Ethics Code By His Actions on August
14, 2025, During a Recess of a Meeting of the City's Historic Preservation Commission, and Imposing a

WHEREAS, by Council Order 25-282, this Council referred to the City's Board of Ethics for advisory opinion the
issues of whether Councilor Wayne Mallar's actions taken during a recess in the August 14, 2025 meeting of
the City's Historic Preservation Commission violated certain provisions of the City's Code of Ethics; and
WHEREAS, the Board of Ethics investigated, held public hearing, deliberated, made findings, and approved
and submitted a written Advisory Opinion on the issues; and
WHEREAS, this Council has decided to follow the recommendations made by the Board of Ethics.
Be it Ordered by the City Council of the City of Bangor that, the City Council adopts the Ethics Board's findings
that on August 14, 2025, during a recess in the meeting of the City's Historic Preservation Commission,
Councilor Wayne Mallar approached the Commission and made comments to at least one Commissioner within
hearing range of other Commissioners regarding the subject matter of an application pending before the
Commission that evening, at a time when the applicant was not present. Whether Councilor Mallar's
statements to the Commissioners were being made in his capacity as a City Councilor or as a private citizen
