Barnesville City Council Regular Meeting May 9, 2022 Mayor Rick called this regular meeting to order at 7:00 p.m. Member’s present were Council members Tonya Stokka, Alyssa Bergman, Brad Field, Dawn Stuvland, Scott Bauer, and Don Goedtke. Others in attendance were City Administrator Brenda Andrews, Kathryn DelZoppo with Ohnstad Twichell, City Clerk Jeri Reep, EDA Director Karen Lauer, Finance Director Laurie Schell, Ambulance Manger Scott Nelson, Public Works Supt. Charlie Revering, Mark Kava, Averil Whiteford, and Michael Stein with Barnesville Record Review. Mayor Rick asked if there were any additions or corrections to the agenda. City Administrator Brenda Andrews stated there were no additions to the agenda. 05-09-22-01 Motion by Mrs. Stuvland and second by Mrs. Stokka to approve the agenda as presented. Motion carried. Mayor Rick stated the next item on the agenda was the consent agenda. 05-09-22-02 Motion by Mrs. Stokka and second by Mrs. Stuvland to approve the consent agenda. Motion carried. The following items were on the consent agenda: 1. Approval of the council minutes from the regular meeting held on April 11, 2022. 2. Approval of the council minutes from the special meeting held on April 5, 2022. 3. Approval of check numbers 91951 – 92056 and EFT payments for a total of $457,484.27. 4. Approval of department head reports 5. Approval of the resignation of Public Works employees Dan Bialke. 6. Approval of the temporary liquor license for the KC’s-June 24, 2022, July 15-16, 2022, August 27-28, 2022. Mayor Rick stated the next item on the agenda was the boards and commission reports. Council members reported on the boards and commissions they serve on. Mayor Rick stated the next item on the agenda was the public forum. Mayor Rick asked if there was anyone present to be heard. There was none. Council member Scott Bauer arrived at 7:05 p.m. Mayor Rick stated the next item on the agenda was the mayor and council member announcements. Mayor Rick stated the next item on the agenda was the 2021 audit report. Ms. Miranda Wendlandt with CliftonLarsenAllen next discussed with councilmembers the 2021 audit. Ms. Wendlandt stated that there were no unusual transactions. There were no new accounting policies were adopted and the application of existing policies was not change during 2021. Current year expenses in the Electric Fund are overstated by $10,553 due to a difference in beginning accumulated depreciation. Three material weaknesses were reported: lack of segregation of duties, audit adjustments/prior period adjustment, auditor drafts financial statements and notes. There were seven areas tested for the Minnesota Legal Compliance, and no findings noted. MN Office of the State Auditor recommends no less than 5 months of operating expenditures for the General Fund. As of December 31, 2021, the city was on target. The Liquor Store gross profit was at 18% for the year. The financial statements and the required State Auditor reporting form will be submitted to the applicable state agencies before the deadline of June 30, 2022. Mayor Rick asked council members if they had any questions for Ms. Wendlandt. There were none. Mayor Rick stated the next item on the agenda was the resolution declaring Potato Days a Community Wide Festival. 05-09-22-03 Motion by Mr. Goedtke and second by Mrs. Bergman to approve the Potato Days Resolution. Upon a roll call vote, the following voted aye: Council members Stokka, Goedtke, Stuvland, Bauer, Bergman and Field. Motion carried. CITY OF BARNESVILLE COUNTY OF CLAY STATE OF MINNESOTA RESOLUTION DECLARING BARNESVILLE POTATO DAYS A COMMUNITY-WIDE FESTIVAL RESOLUTION NO. 05-09-22-03 WHEREAS, Barnesville Potato Days is an annual festival occurring in the City of Barnesville; and WHEREAS, Barnesville Potato Days involves activities and entertainment that involve not only the Barnesville community but surrounding communities; and WHEREAS, Barnesville Potato Days will occur on August 26th through August 27th, 2022; and WHEREAS, the Barnesville City Council desires to promote Potato Days and encourage local businesses to participate in Barnesville Potato Days; and  WHEREAS, it is necessary to designate Potato Days as a community festival to enable and authorize the City of Barnesville to grant community festival special event liquor licenses pursuant to Section 5.33 of the Barnesville City Code; and WHEREAS, the Barnesville City Council desires to formally recognize Potato Days as a community-wide festival. NOW, THEREFORE, BE IT RESOLVED, that Barnesville Potato Days is hereby designated a community-wide festival. BE IT FURTHER RESOLVED that the dates of August 26th through August 27th, 2022 are designated as dates during which the City of Barnesville may issue special event community- wide festival licenses. City Administrator Brenda Andrews stated that this resolution would urge to its lawmakers at the state pass the GA formula proposal and increase the LGA appropriation by $90 million. 05-09-22-04 Motion by Mr. Field and second by Mr. Goedtke to approve the resolution for Local Government Aid. CITY OF BARNESVILLE COUNTY OF CLAY STATE OF MINNESOTA RESOLUTION NO. 05-09-22-04  Resolution on LGA Formula Update and $90M Appropriation Increase WHEREAS, Local Government Aid (LGA) is an essential aid program to Minnesota cities, helping to restrain local property taxes; and, WHEREAS, LGA helps cities pay for critical needs and services such as public safety, street maintenance & repairs, libraries, parks and trails, economic development and housing; and, WHEREAS, the LGA formula is reviewed and updated approximately every ten years after the completion of the decennial census; and, WHEREAS, organizations representing cities have worked together to produce a formula update that they agree on; and, WHEREAS, the LGA formula proposal included in SF 3971/HF 4064 provides a much-needed update to the formula to better reflect city needs and changes in our communities since the last major revision to the formula in 2013; and WHEREAS, the cost of providing city services continues to rise due to a significant increase in inflation; from 2009 to 2022, inflation has grown 41%, while LGA has only grown by 18%; and, WHEREAS, the share of the state general fund spent on LGA has decreased to just 2.12%; and, WHEREAS a $90 million increase to the LGA appropriation is essential to fund the formula and is modest compared to the $9.3 billion state budget surplus; and, WHEREAS, For the City of Barnesville, the future of state LGA remains a key variable in the City’s ability to provide basic services. LGA represents a significant revenue source for the City’s General Fund we spend these monies on police, ambulance, fire department, streets, parks, and other services. BE IT RESOLVED that the City Council of Barnesville, Minnesota urges through this Resolution to its lawmakers that the state pass the LGA formula proposal and to increase the LGA appropriation by $90 million; and, BE IT FURTHER RESOLVED that this resolution be transmitted to Representative Paul Marquart AND Senator Kent Eken, Speaker of the House Melissa Hortman, Senate Majority Leader Jeremy Miller, House Minority Leader Kurt Daudt, Senate Minority Leader Melissa López Franzen, and Governor Tim Walz. EDA Director Karen Lauer stated that two City Council members should be appointed to the Community Fund Strategic Partners group. EDA Director Karen Lauer stated that this is an excellent opportunity to network with EDA Board members, Main Street Board members, the Community Fund, and the school. Mayor Jason Rick asked council members if they would like to serve on the Community Fund Strategic Partners group. Council member Donald Goedtke and Mayor Jason Rick stated that they would be willing to represent the City Council. Mayor Rick stated the next item on the agenda was the decertification of TIF in the Heartland Addition. EDA Director Karen Lauer stated that the 14 years has been reached in the TIF District 1-1, Heartland Addition. Four parcels in the Heartland Addition are ready to be decertified. 05-09-22-05 Motion by Mr. Goedtke and second by Mrs. Stokka to approve the resolution approving the elimination of parcels from TIF District No. 1-1. Upon a roll call vote, the following voted aye: Council members Stokka, Goedtke, Stuvland, Bauer, Bergman and Field. Motion carried. CITY OF BARNESVILLE CLAY COUNTY, MINNESOTA RESOLUTION NO. 05-09-22-05 RESOLUTION APPROVING THE ELIMINATION OF PARCELS FROM TAX INCREMENT FINANCING DISTRICT NO. 1-1 WITHIN REDEVELOMENT PROJECT NO. 1 OF THE CITY OF BARNESVILLE. WHEREAS, on July 8, 1996, the City of Barnesville (the "City") created its Tax Increment Financing District No. 1-1 (the "TIF District") within its Redevelopment Project No. 1 (the "Project") by approval of a tax increment financing plan (the "TIF Plan) for the TIF District; and WHEREAS, the Barnesville Economic Development Authority (the "EDA") is the administrative authority for the TIF District; and WHEREAS, the following property, by property identification number, was included in the TIF District: 50.335.0530 50.335.0540 50.335.0810 50.335.0840 WHEREAS, the City desires by this resolution to amend the TIF Plan to remove the above- described parcel from the TIF District, thereby reducing the size thereof; and WHEREAS, the total current net tax capacity of the parcel to be eliminated from the TIF District equals or exceeds the original net tax capacity and, therefore this amendment to the TIF Plan is accomplished pursuant to Minnesota Statutes, Section 469.175, Subdivision 4, clause (e)(2)(A). NOW THEREFORE, BE IT RESOLVED by the City that the TIF Plan for the TIF District is hereby amended to remove the described parcel and the City Administrator is authorized and directed to notify the County Auditor thereof pursuant to Minnesota Statutes, Section 469.175, Subdivision 4, clause (e). NOW THEREFORE, BE IT FURTHER RESOLVED by the City as follows: 1. The tax increment financing plan (the "TIF Plan") for the TIF District is hereby modified to remove the Parcel from the TIF District, effective for taxes payable in 2023. 2. Upon approval of a similar resolution by the EDA, staff are authorized and directed to file a copy of this resolution with the County Auditor of Clay County along with instructions to adjust the records for the TIF District accordingly. ADOPTED: May 9, 2022 ATTEST: __________________________________ __________________________________ Jason Rick, Mayor Brenda Andrews, City Administrator Mayor Rick stated the next item on the agenda was the petition for improvements at 202 7th Street SE. EDA Director Karen Lauer informed council members that this petition for improvements is located at 202 7th Street SE for the relining of their existing sanitary sewer line from the basement cleanout to the connection at the city sewer main. Drain Services Incorporated has televised the sewer main and has provided a proposal to reline the sanitary sewer pipe. The cost is estimated to be $10,000, and the interest rate of 4.5%. 05-09-22-06 Motion by Mr. Field and second by Mrs. Stokka to approve the petition for improvements at 202 7th Street SE, with an interest rate of 4.5%. Motion carried. Mayor Rick stated the next item on the agenda was the discussion to move the city elections to even numbered years. Mayor Jason Rick stated that Barnesville is the only city in Clay County that holds an election in the odd years. Mayor Rick asked council members if they would like to change the city elections to be held in the even years. Kathryn DelZoppo with Ohnstad Twichell informed council members that there were a couple ways to make this change. The council could change the City Charter, or the council could have the question on the ballot on the November 8, 2022 election. 05-09-22-07 Motion by Mrs. Stokka and second by Mrs. Bergman to change the city election from odd years, to even years. Motion carried. 05-09-22-08 Motion by Mrs. Stokka and second by Mr. Goedtke to have the change of election years, from odd years to even years, to be placed on the November 8, 2022 ballot for the voters to vote on. Motion carried. Mayor Rick stated the next item on the agenda was the League of Minnesota Cities annual conference. Mayor Rick stated that he would be attending, along with City Administrator Brenda Andrews. Mayor Rick stated the next item on the agenda was the closed session for the City Administrator Brenda Andrews six-month review. 05-09-22-09 Motion by Mrs. Stuvland and second by Mrs. Stokka to close the regular session of the city council at 7:46 p.m. Motion carried.
