The Bastrop City Council met in regular session on January 24, 2012 at 6:00 p.m. at the Council
Chambers of City Hall, 1311 Chestnut Street, Bastrop, Texas. Members present were Mayor
Terry Orr and Council Members Joe Beal, Julie Hart, Ken Kesselus, Bill Peterson and Kay
Garcia McAnally.
ANNOUNCEMENTS
1. CALL TO ORDER
At 6:00 p.m. Mayor Terry Orr called the meeting to order with all members present.
2. PLEDGE OF ALLEGIANCE AND INVOCATION
Council Member Julie Hart led the pledges of allegiance to the U.S. and Texas flags. Reverend
Bob Long led the invocation.
3. PRESENTATIONS
A. CERTIFIED COURT CLERK LEVEL 1 – PATSY PARANICH
City Manager, Mike Talbot presented Patsy Paranich with a certificate for completion of the
Certified Court Clerk Level 1 program.
4. PROCLAMATIONS
There were no proclamations.
5. ANNOUNCEMENTS
Mayor Orr stated the sales tax for December 2011 was 25% above where it was on December
2010.
Kay Garcia McAnally gave an update on the City presenting service pins to persons who have
served on City Boards and Commissions. Ms. Garcia McAnally asked that the Mayor place on
the February 14, 2012 Council Agenda “Presentation of Service Pins”.
Kay Garcia McAnally stated the Art in Public Places Task Force will have placed the pictures of
the City’s Mayors in City Hall by the middle of February.
Mayor Orr announced that on this coming Friday, January 27, 2012 he and his wife Patricia will
be celebrating their 53rd wedding anniversary.
Mayor Orr stated the Council will follow the following order for the Agenda tonight: City
Manager’s Report, Consent Agenda and then Executive Session prior to the public hearing.

City Manager, Mike Talbot gave an informational update on the listed items except for Item #6.
Joe Beal requested the City do a groundbreaking ceremony for the Splash Park.
Mr. Talbot stated the correct dates for a Special Council Meeting regarding Smart Base Codes
are February 8th or 9th.
It was the consensus of Council to schedule a Special Council Meeting regarding Smart Base
Codes on February 8, 2012 at 6:00 p.m.
Ken Kesselus stated he would like for the City Manager to prepare a report on the ramifications
of getting appraisals for the new year of the homes which were burned out and the City pro-
rating, giving credit or reimbursing people their taxes.

Bill Peterson moved to approve the Consent Agenda. Seconded by Kay Garcia McAnally and
carried unanimously.
EXECUTIVE SESSION: THE COUNCIL RESERVES THE RIGHT TO CONVENE INTO
EXECUTIVE SESSION AT ANY TIME DURING THE MEETING REGARDING ANY

At 6:28 p.m., Mayor Orr convened the Bastrop City Council into executive session in
compliance with the Open Meetings Act, Chapter 551 Government Code, Vernon’s Texas Code,
Annotated, to discuss the following:
1. Section 551.071 – Consultation with Attorney: Agenda Item B.1 and B.2.
At 7:22 p.m., Mayor Orr reconvened the Bastrop City Council into open session to discuss,
consider and/or take any actions necessary related to the executive session.
No action was taken.
Council took a brief recess from 7:23 p.m. until 7:28 p.m.
B. PUBLIC HEARINGS:
B.1 PUBLIC HEARING: CONSIDERATION, DISCUSISON AND POSSIBLE ACTION ON
A REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW THE CONSTRUCTION OF
A 70 FOOT TALL COMMERCIAL CELL TOWER ANTENNA, WHERE 35 FEET IS
ALLOWED, WITH THE CONSTRUCTION TO BE LOCATED ON 0.06+/- OF AN ACRE
LEASE SPACE, OUT OF A PARENT TRACT OF 3.75 +/- ACRE IN BASTROP WEST
COMMERCIAL SECTION ONE, LOT 2, BLOCK A, IN AN AREA ZONED C2,
COMMERCIAL BEING LOCATED IN THE CITY LIMITS OF BASTROP, TEXAS.
Planning and Development Director, Melissa McCollum addressed the Council. Ms. McCollum
stated this leased space is generally located behind Bastrop Marketplace (Subway, Clint’s
Liquor, Little Caesars), in an area zoned C-2, Commercial Heavy. Ms. McCollum stated the
Planning and Zoning Commission reviewed this item at their regularly scheduled meeting on
August 25, 2011 and City Council consideration of this item has been postponed and re-notified
four (4) times, due to various circumstances. Ms. McCollum stated notifications of the hearing
on the Conditional Use Permit have been provided to surrounding property owners six (6) times,
for both Planning and Zoning Commission and City Council meetings. Ms. McCollum stated the
Planning and Zoning Commission conducted a public hearing on August 25, 2011 and voted 4-2
to recommend denial of the Conditional Use Permit. Ms. McCollum stated staff recommends
denial of the Conditional Use Permit and believes that the proposed 70 feet height is not
consistent with the existing shopping center area and that the height of the cell tower does not
meet the Conditional Use Permit requirements or the additional standards applied to “Special
Height Regulations.” Ms. McCollum stated the proposed cell tower is the third design that the
applicant Beb Francis, The Francis Law Firm, has submitted to staff for review. Ms. McCollum
stated the Planning and Zoning Commission had not seen the updated information provided by
the applicant on pages 73 to 83 of the Agenda Packet. Ms. McCollum stated called the Council’s
attention to a PowerPoint presentation showing the location of the property on a map and City
regulations and codes regarding the requested Conditional Use Permit.
Beb Francis thanked the City staff for all their work regarding the cell tower. Mr. Francis called
the Council’s attention to the PowerPoint presentation showing the location. Mr. Francis stated
they have met all setback requirements of the City’s Code and they will be providing a six feet
chain link fence with green slats and additional landscaping around the perimeter of the property.
Mr. Francis stated the proposed site is C-2, Commercial zoning and commercial antenna are
allowed by right but limited to 35 feet in height. Mr. Francis stated they are requesting a
Conditional Use Permit to allow a height of 70 feet.
Scott Vonryan with Capital Telecom addressed the Council. Mr. Vonryan called the Council’s
attention to the PowerPoint presentation showing existing structures in the proposed area and
photo simulations of how the 70 feet tower would look from various locations. Mr. Vonryan
stated the 70 feet tower is much less obtrusive than what is already in the area. Mr. Vonryan
called the Council’s attention to Page 74 of the Agenda packet which shows that according to the
projections, if the new site is not deployed, by January 2013 approximately 3,700 calls won’t go
through during the busiest hour of the day. Mr. Vonryan stated there will also be data issues. Mr.
Vonryan explained that each tower has a certain limited capacity of calls and when it reached
that capacity calls are “blocked” or do not go through.
Mr. Francis stated AT & T was concerned about the busy hours of a day and calls not going
through. Mr. Francis stated a good example of this was during the Bastrop County Complex
Fire. Mr. Francis stated included in the Agenda packet is a letter from Valmont with a sealed
engineering stamp giving specifics on the tower and that the tower is designed to collapse upon
itself if that were to ever happen. Mr. Francis stated this is a very important project and he
respectfully requests the City Council grant the Conditional Use Permit.
Joe Beal asked Mr. Francis the following question: “In all of your analysis in trying to solve
service problems, did you determine, given the City’s restraints, was this the best place to put
this structure from a service standpoint?”
Mr. Francis stated he could absolutely assure Mr. Beal that “Yes, this is the best place” and many
months went into looking at locations for the antenna tower.
Kay Garcia McAnally stated in the beginning she was very much against the tower, but after
working at the command center during the fire, she is absolutely adamant that the City have
enough capacity to reach loved ones during emergencies.
Ken Kesselus asked Ms. McCollum to summarize why the Board of Adjustment failed to grant a
variance and the reasons the Planning and Zoning Commission recommends denial of the
request, and why staff is opposed to the Conditional Use Permit.
Ms. McCollum stated the Board of Adjustment was presented with a request for a Variance to
the City’s Code. The request was for a 90 feet in height pine tree looking tower. Ms. McCollum
stated the City’s Code contains very strict rules on when a Variance can be granted and the
Board of Adjustment felt the request presented did not meet the requirements to grant a
Variance. Ms. McCollum stated that a Conditional Use Permit was then requested and the
Planning and Zoning Commission votes 4-2 to recommend denial of the Conditional Use Permit.
Ms. McCollum stated staff recommends denial because the proposed cell tower is not
harmonious and compatible with the surrounding uses, and does not meet the height, bulk and
scale relationship with surrounding uses and structures.
Discussion was held among Council, Mr. Francis and Ms. McCollum.
Dave Quinn, Executive Director of Bastrop Economic Development Corporation, addressed the
Council. Mr. Quinn stated he does know that capacity for any infrastructure in a City is very
important to economic growth in the City. Mr. Quinn stated he thinks a lot of our economy is
built on doing business on the go. Mr. Quinn stated he thinks it is critical to allow investment
and allow this to happen.
Bonnie Coffey addressed the Council. Ms. Coffey stated she is a business owner and a volunteer
for the Bastrop Main Street Program. Ms. Coffey stated the Bastrop Main Street Program is
working on becoming a Certified Entrepreneur Ready Community. Ms. Coffey stated the Main
Street Program is also working on a telephone application. Ms. Coffey encouraged Council to
think about the people coming to Bastrop and that we need to provide them the infrastructure
they need.
Debbie Moore addressed the Council. Ms. Moore stated that anyone who was in the City on
September 4, 2011 when the fire began knows what it was like trying to tell people to get out and
not being able to get phone calls to go through. Ms. Moore stated that God willing next time we
will be prepared and this antenna is something we need.
Kay Wesson addressed the Council. Ms. Wesson stated she had two issues: 1) Development of
the Jenkins property, the developer has asked her to say that they are not in opposition to this;
and 2) As a business owner in that hot area, and the increase in data, she wants it to work.
Kristi Koch addressed the Council. Ms. Koch stated as a member of the Bastrop Planning and
Zoning Commission, the largest reason the Planning and Zoning Commission had recommended
denial of this request was that the applicant had not shown a need and the additional information
presented to Council tonight shows that need. Ms. Koch stated she thinks that with the new
information provided the Planning and Zoning Commission might have voted differently.
Ms. Koch stated she personally supports the request for a Conditional Use Permit.
Julie Hart commended the City staff and the Planning and Zoning Commission for the work put
in on this. Ms. Hart stated the City’s Ordinance regarding this is antiquated and the Council
needs to make a change in the Ordinance. Ms. Hart stated she agreed with Mr. Quinn and that
communications is important to the City’s future development. Ms. Hart stated she is excited
that the applicant wants to make this investment and move the City forward.
Mayor Orr declared the public hearing closed.
B.2 CONSIDERATION, DISCUSSION AND POSSIBLE ACTION ON THE FIRST
READING OF A PROPOSED ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BASTROP, TEXAS TO GRANT A CONDITIONAL USE PERMIT TO ALLOW THE
CONSTRUCTION OF A 70 FOOT TALL COMMERCIAL CELL TOWER ANTENNA,
WHERE 35 FEET IS ALLOWED, WITH THE CONSTRUCTION TO BE LOCATED IN
0.06 +/- OF AN ACRE LEASE SPACE, OUT OF A PARENT TRCT OF 3.75 +/- ACRES IN
BASTROP WEST COMMERCIAL SECTION ONE, LOTE 2, BLOCK A IN AN AREA
ZONED C2, COMMERCIAL BEING LOCATED IN THE CITY LIMITS OF BASTROP,
TEXAS; SETTING OUT CONDITIONS; AND PROVIDING AN EFFECTIVE DATE.
Mayor Orr stated in accord with Bastrop Code of Ordinances, Section 10.8 (E)(1), the City has
received written objections from 20% or more of the area of the adjacent landowners to the
property on which the requested Conditional Use Permit is applicable, which written objections
comply with the provisions of Section 211.006 of the Local Government Code of the State of
Texas. Mayor Orr stated accordingly, the City Council will now vote, in accord with the
standards of Section 10.8 (E)(1), to determine whether the City Council will approve the
Conditional Use Permit requested by Capital Telecom Acquisition, LLC, or deny same.
Joe Beal moved to approve the Ordinance on First Reading granting a Conditional Use Permit
and that the Ordinance be placed on the Consent Agenda for the Second Reading. Seconded by
Kay Garcia McAnally and carried unanimously.
Mr. Beal stated the reason he made the motion to approve, even though the Planning and Zoning
Commission and staff recommended denial, he believes that this service is needed for the City of
Bastrop citizens, there is no alternative place because this is the best place from a service
standpoint and he is comfortable with this solution.
Ken Kesselus stated he would bet money that the City is behind the curve on cell towers and the
Council is going to have to look at the Ordinance regarding such. Mr. Kesselus stated he is more
concerned that two City Boards, staff and 20% of adjacent landowners objected to the request.
Kay Garcia McAnally stated in this case the Council needs to consider all the people, not just the
20% surrounding the location. Ms. Garcia McAnally stated it should be looked at from the fact
that it will benefit the entire City rather than the few it will touch.
Bill Peterson stated he agreed with Mr. Beal and Ms. Garcia McAnally.
Mayor Orr stated when he moved to Bastrop in 1992 he was dependent on communications and
Bastrop worked. Mayor Orr stated he can assure you if the City has an area where people are
driving through and their phones drop calls, they are going to keep on driving.
Ken Kesselus moved the Council defer this motion until the second meeting in February, defer to
the City Manager, Mike Talbot to do research on possibilities of solving our technical problems
in some other way and also taking a look at, as comprehensive as you can, of what he might
recommend, or staff might recommend in terms of Ordinance changes, in particularly if Mike
were to find a different location that would work.
Motion died for lack of a second.
Mr. Talbot assures Mr. Kesselus and Council that staff has spent a considerable amount of time
on this and he assures Council will see a new Ordinance regarding cell towers. Mr. Talbot stated
he was in favor of the Conditional Use Permit being approved.
Mr. Kesselus ask Mr. Talbot what were his reasons for being in favor of the Conditional Use
Permit.
Mr. Talbot stated he did not know how many times he has studied the pictures and he thinks the
tower is compatible with surrounding uses. Mr. Talbot stated he has talked to an engineer in
Dallas who has worked both sides of the issue of cell towers and this engineer told him that big
companies just do not go out and arbitrarily pick a site because they know they would draw the
wrath of Council. Mr. Talbot stated this engineer has offered to assist him with the development
of an ordinance addressing cell towers. Mr. Talbot stated this engineer also provided him with
an Attorney General opinion on this.
Teresa Valdez called the roll for the main motion made by Mr. Beal and seconded by Ms. Garcia
McAnally.

Motion carried.
Council took a brief recess from 8:55 p.m. to 9:00 p.m.

D.1 CONSIDERATION, DISCUSSION AND POSSIBLE ACTION ON ACCEPTANCE OF
MONTHLY FINANCIAL REPORTS FOR THE PERIOD ENDING OF DECEMBER 31, 2011
AND QUARTERLY INVESTMENT REPORT.
Finance Director, Karla Stovall presented the monthly Financial Report, for period ending
December 31, 2011, and the Quarterly Investment Report . Ms. Stovall reviewed the reports.
Brief discussion was held among Council and Ms. Stovall.
Joe Beal moved to accept the monthly Financial Report and the Quarterly Investment Report.
Seconded by Bill Peterson and carried unanimously.
D.2 CONSIDERATION, DISCUSSION AND POSSIBLE ACTION CONCERNING
AUTHORIZING THE CITY MANAGE TO PROCEED FORWARD WITH A PIPE
BURSTING PROJECT FOR THE SANITARY WASTEWATER MAIN RUNNING FROM
COVERT CHEVROLET RUNNING EAST ON THE SOUTH SIDE OF STATE HIGHWAY
71 SERVICE ROAD AND THEN RUNNING SOUTHWARD TO THE GENERAL AREA
BETWEEN COMFORT SUITES/TACO BELL.
City Manager, Mike Talbot stated the current wastewater main running from Covert Chevrolet
eastwardly on the south side of State Highway 71 service road and then southwardly to the
general area of Comfort Suites/Taco Bell and connecting to 15-inch gravity main is a 10-inch
wastewater main. Mr. Talbot stated this year’s Capital Improvement Program calls for “pipe
bursting” this line to a 12-inch main. Mr. Talbot stated after reviewing this wastewater main and
considering the growth occurring in west Bastrop, the City staff and I are proposing increasing
the capacity of this line from 12-inch main to pipe bursting to a 15-inch main. Mr. Talbot stated
increasing the main this additional size will provide for abundance of “Wastewater Collection
Capacity” in the western quadrant of the City. Mr. Talbot stated the original budget for this
project is $518,318.00 and increasing the size of the main from 12-inch to 15-inch will cost an
additional $336,682.00 for a total cost of $852,000.00. Mr. Talbot stated the only reason the
City was able to consider increasing the size of this main is that the Well H project came in
approximately $300,000.00 below budget. Mr. Talbot stated he also contacted Mickey Fishbeck
and asked her to run the City’s “Water and Wastewater Rate Model” to see if the additional cost
of this wastewater project would significantly impact the proposed future rates increases for the
City’s Five Year Capital Improvements Program. Mr. Talbot stated as noted in Ms. Fishbeck’s
memo included in the Agenda packet, it will only have a minor impact on the rates. Mr. Talbot
stated Gene Kruppa with BEFCO Engineering is present tonight to answer any questions that
Council may have.
Gene Kruppa addressed the Council. Mr. Kruppa stated included in the Agenda packet is the
report from BEFCO Engineering. Mr. Kruppa stated the increase in size basically enhances flow
and an 81% increase in flow. Mr. Kruppa stated that if the money is available he definitely
recommends doing this.
Discussion was held among Council.
Joe Beal moved to authorize the City Manager to proceed with the pipe bursting project based on
the engineering report and the financial analysis. Seconded by Bill Peterson and carried
unanimously.
D.3 CONSIDERATION, DISCUSSION AND POSSIBLE ACTION ON APPOINTMENT BY
MAYOR AND CONFIRMATION BY COUNCIL OF MEMBER TO THE CENTRAL TEXAS
CLEAN AIR COALITION OF THE CAPITAL AREA COUNCIL OF COUVERNMENTS.
Mayor Orr appointed Ken Kesselus to the Central Texas Clean Air Coalition for the year 2012.
City Secretary, Teresa Valdez called the roll for confirmation of the appointment.

Council Member Ken Kesselus was appointed to serve as the Council’s representative to the
Central Texas Clean Air Coalition.

At 9:20 p.m., Mayor Orr convened the Bastrop City Council into a closed/executive session
pursuant to the Texas Government Code, Chapter 551, Section 551.071(1)(A) and Section
551.071(2) (Consultations with Attorney); and Section 551.072 (Deliberations about Real
Property) to discuss the following:
1. Consultations with Attorney: (1) threatened and/or contemplated litigation; and
(2) matters upon which the attorney has a duty and/or responsibility to report to the
governmental body:
2. Deliberations about Real Property: Acquisition, exchange, lease or value of real
property.
E.2 THE BASTROP CITY COUNCIL WILL RECONVENE INTO OPEN SESSION TO
DISCUSS, CONSIDER AND/OR TAKE ANY ACTIONS NECESSARY RELATED TO THE
EXECUTIVE SESSIONS NOTED HEREIN, OR REGULAR AGENDA ITEMS, NOTED
ABOVE, AND/OR RELATED ITEMS.
At 10:15 p.m., Mayor Orr reconvened the Bastrop City Council into open session to discuss,
consider and/or take any actions necessary related to the executive sessions noted herein, or
regular agenda items, noted above, and/or related items.
No action was taken.
F. ADJOURNMENT
At 10:11 p.m., Bill Peterson moved to adjourn. Seconded by Kay Garcia McAnally and carried
unanimously.
