A. CONSENT AGENDA All of the following items on the Consent Agenda are considered to be self-explanatory by the Council and will be enacted with one motion. There will be no separate discussion of these items unless a Council Members so requests. A.1 Approval of meeting minutes of May 28, 2013 A.1 5 Traci Chavez Regular Council Meeting. A.2 Approval of the statutory denial, for a period of 180 days from A.2 13 Melissa McCollum the date of Council action on this request, for the Administrative Plat of Lots 41, 42, 43, 44, 45 and 46, Block 3, Pine Forest, Phase II, Unit 6 located within the Bastrop County, Texas Extra Territorial Jurisdiction (ETJ). . A.5 SECOND READING: Adoption of an Ordinance of the City A.5 40 Matt Wagner Council of the City of Bastrop, Texas amending City Code Appendix A: Fee Schedule; Article A4.10 Vehicle Towing, and establishing an effective date. A.6 Approval of Bastrop Marketing Corporation’s request A.6 43 Karla Stovall for reimbursement of expenses. B. PUBLIC HEARINGS AND ORDINANCES AND OTHER ITEMS ELIGIBLE FOR CONSIDERATION AND/OR ACTION: B.1 PUBLIC HEARING: On a request for a zone change from B.1 46 Melissa McCollum MH, Manufactured Housing to C-1, Commercial District (Light) for +/-3.973 acres, being A portion of Bastrop Town Tract, A-11 also generally known as 2801 E. Highway Loop 150 within the City limits of the City of Bastrop, Texas. B.2 Consideration, discussion and possible action on the B.2 55 Melissa McCollum FIRST READING of a proposed Ordinance of the City Council of the City of Bastrop, Texas Granting a zoning change from MH, Manufactured Housing to C-1, Commercial District (Light) for +/-3.973 acres, being “A portion of Bastrop Town Tract, A-11 also generally known as 2801 E. Highway Loop 150 within the City limits of the City of Bastrop, Texas”; and establishing an effective date. B.3 Citizen Comments ****************************************************************************************** Executive Session: The Council reserves the right to convene into Executive Session at any time during the meeting regarding any agenda item. In compliance with the Open Meetings Act, Chapter 551 Government Code, Vernon’s Texas Code, Annotated, the item below will be discussed in closed session. 1. Section 551.071 – Consultations with Attorney related to legal matters ****************************************************************************************** C. OLD BUSINESS C.1 Discussion, consideration and possible action on Variance to C.1 60 Melissa McCollum Subdivision Regulations Section 5.70A on a request to reduce a 50’ setback from a state highways to allow a 25’ setback – for property located in the Mayfair Park Subdivision which is located north of Highway 71 East and west of Industrial Road and which is within the city limits of Bastrop, Texas. C.2 Consideration, discussion and possible action C.2 67 Melissa McCollum on a Final Plat for Lots 2 and 3, Block “A” Mayfair Park Subdivision located north of Highway 71 East and west of Industrial Road which is within the city limits of Bastrop, Texas. D. NEW BUSINESS D.1 Consideration, discussion and possible action regarding D.1 71 Mike Talbot the acceptance and approval by the Council of the “City of Bastrop Long Term Water Supply Planning Study” as prepared and presented to the City Council by K Friese & Associates. D.2 Consideration, discussion and Possible Action regarding D.2 72 Mike Talbot Approval of the First Amendment to the revised agreement for “Dispatching Services Between Bastrop County and the City of Bastrop”. D.3 Consideration, discussion and possible action on the D.3 79 Karla Stovall on acceptance of the unaudited Monthly Financial Reports, for the period ending April 30, 2013. D.4 Consideration, discussion and possible action on the FIRST D.4 107 Karla Stovall READING of a proposed Ordinance of the City Council of the City of Bastrop, Texas, amending the budget for the Fiscal year 2013, in accordance with existing statutory requirements; Appropriating the various amounts herein; repealing all prior Ordinances and actions in conflict herewith; and providing for an effective date. E. EXECUTIVE SESSION E.1 The Bastrop City Council will meet in a closed/executive session pursuant to the Texas Government Code, Chapter 551, et seq, to discuss the following: 1. Section 551.071(1) (A) and Section 551.071(2) – Consultations with Attorney: (1) threatened and/or contemplated litigation, and (2) matters upon which the Attorney has a duty and/or responsibility to report to the governmental body. 2. Section 551.072 – Deliberation regarding real property: Regarding the purchase, exchange, lease, disposition, or value of real property. 3. Section 551.086 - Certain Public Power Utilities: Competitive Matters. 4. Section 551.087 - Deliberation Regarding Economic Development Negotiations – Project Zebra. 5. Section 551.0-74 – Personnel Matters: City Manager. E.2 The Bastrop City Council will reconvene into open session to discuss, consider and/or take any actions necessary related to the executive sessions noted herein, or regular agenda items, noted above, and/or related items. F.
