Motion to approve Consent Agenda moved by Beck and seconded by Lanci. The motion was carried
unanimously (10-0) with a voice vote.

6.1 Resolution 2025-098-r Authorizing Change Order no. 5 with IHC Construction Companies LLC
for the Phase 2a WWTP Improvements
Ald. Vogelsinger and Ald. Solfa joined the meeting at 7:04pm.
Andrea Podraza provided a brief update on a change order totaling $66,667.54 related to construction site
work. The change order covers unexpected items discovered during the project, such as a bolt issue on a
clarifier that wasn't visible until the structure was emptied. These repairs were made immediately to ensure
long-term durability (15+ years). While the project had a construction allowance, it has now been fully
used, with both additions and subtractions throughout the contract. As of now, the project remains within
budget, but if that changes, a budget amendment will be brought forward.
Motion to Approve Resolution 2025-098-R moved by Malone and seconded by Solfa. The motion was
carried unanimously (12-0) with a voice vote.
6.2 Resolution 2025-099-R Authorizing Execution of Task Order 36 with GZA
Phase 1, which involved a document review, recommended further investigation due to the properties’ long
history of varied use. Phase 2 will include on-site sampling and lab testing, resulting in higher costs due to
its complexity. She emphasized that such expenses are expected when dealing with properties that have had
extensive prior use.

Motion to Approve Resolution 2025-099-r moved by Vogelsinger and seconded by Anderson. The
motion was carried unanimously (12-0) with a voice vote.
6.3 Discussion: City Energy Policy
Max Weiss presented key questions to guide Batavia’s energy policy as part of the city’s Integrated
Resource Plan with the Brattle Group. Key Discussion areas:
1. Whether the city should own generation assets or contract for power.
2. Whether generation should be local or location-agnostic.
3. What level of diversification is desired.
He asked the City Council to weigh in on whether to own or contract for power, whether to prioritize local
generation, and what level of diversification to pursue. Council members expressed mixed views on
ownership, with some favoring the control and price stability it offers and others preferring the flexibility of
contracts due to past challenges with Prairie State.
There was strong support for local generation and energy storage to improve reliability, though members
acknowledged practical limits. Most agreed that diversifying the energy portfolio—with solar, wind,
nuclear, and storage—was essential. While many showed interest in small-scale nuclear as a future option,
concerns about cost, regulation, and readiness remain.
Council priorities varied slightly, but cost, reliability, and sustainability were consistently cited as top
concerns. Members also emphasized the need to upgrade Batavia’s aging grid and explore demand-side
strategies like smart meters and time-of-use rates. The Brattle Group will use this feedback to draft a policy
framework for Council review, aiming to balance flexibility, resilience, and long-term affordability.
6.4 Discussion: City Council Committees
Batavia City Council members held a detailed discussion on enhancing the organization of the Committee
of the Whole by reintroducing volunteer chairs and vice chairs for the four existing committees:
government services, community development, city services, and public utilities. The purpose of assigning
these roles is to provide structure, improve communication between staff and council, and ensure that
someone is prepared to introduce and guide discussion on agenda items. Chairs would help anticipate
questions, consolidate council member input, and serve as a point of contact to streamline meeting
preparation.
While some council members expressed concerns about adding unnecessary layers, delays in
communication, or shifting too much responsibility to a few individuals, others emphasized the value of
spreading out the workload and developing leadership skills among council members. It was clarified that
participation would be voluntary, roles would not require expertise, and all council members would retain
full ability to participate in discussions. To avoid changing existing ordinances, the council agreed to
maintain the current four-committee structure and test this chair-based system for six months. Committee
assignments will be based on seniority and interest, with final decisions made at an upcoming meeting
including members who were absent.
7. City Council Updates
7.1 Project status
The Batavia Park Board agreed to participate in a joint feasibility study with the City regarding the dam
removal and concept design options, with both staffs to collaborate on a mutually acceptable scope of work
for the request for proposals. Updates were also shared on several city matters: the water master agreement

for the data center is delayed and will appear on the next agenda; a 50 MW load letter was submitted to
ComEd; and emergency water main repairs are underway near the Westside Fire Station. The finance
department is currently interviewing candidates for a finance assistant position.
Additionally, Council revisited a past discussion about whether the City should register or endorse
contractors after a resident reported a negative experience. While some members showed openness to
creating a voluntary or informational list, most were opposed, citing legal risks, staff workload, and the
limited benefit from one complaint. Several recommended referring residents to the Chamber of Commerce
instead. The consensus was to not pursue contractor registration or oversight at this time.

Re: Resolution 2025-101-R: Grant of Subdivision Variation for a Covered Porch
947 Britta Lane, Nathan Jahnke, Applicant
Summary: Resolution 2025-101-R would approve a subdivision variation for a proposed covered front
porch for a residence at 947 Britta Lane. The property owner/applicant requests a front porch that
would encroach into a required front zoning setback, which is permissible under the Zoning Code.
However, the property is located in Carriage Crest Unit 4, which has a recorded 25-foot building setback
line, which aligns with the Zoning Code at the time of its approval. The Resolution would grant approval
for the covered front porch to encroach the recorded building setback line by three (3) feet. The Plan
Commission recommended approval as presented.
Background: The applicant, Nathan Jahnke is seeking the requested Subdivision Variation (Subdivision
Code 11-2-5) to allow for his proposed porch to cross a recorded building setback line of Carriage Crest
Subdivision Unit No. 4’s subdivision plat. The subdivision, which was approved in 1972 included a
building setback line of 25 feet, consistent with the property’s zoning setback, at that time. The property
is zoned R1-L Single Family Residential, Low Density District. The front building setback in this district is
30 feet. The City’s Zoning Code allows a covered porch as an allowed encroachment to project from a
non-conforming residence up to four (4) feet (Section 4.101.K) into a required front or corner side
setback. However, the presence of the recorded building line would otherwise prevent the additional
porch area. Improvements must comply with both the recorded building line and zoning setback, leaving
the more restrictive to prevail. The applicant requests for the proposed four (4) foot depth front porch
to cross the building line by three feet, providing the allowed minimum front porch under the Zoning
Code.
The applicant seeks the porch addition to provide a functional covering to the residence’s entrance,
citing that there is a hardship in not being able to provide a functional covering at the entrance, while
remaining in compliance with the recorded building line. The Subdivision Regulations allow for a
variation where unnecessary hardships result from the application of the Subdivision Regulations. The
Code requires that lots otherwise meet the requirements of the Zoning Code, which would be applicable
in this case. No zoning relief would be requested, and the applicant would otherwise be proposing
improvements in conformance with the encroachments allowed for non-conforming structures under
the zoning code setbacks in this district. The proposed porch is sized to meet this requirement and
should not have impact on adjoining properties.

Plan Commission Review and Action: The Plan Commission reviewed the Subdivision Variation request
at their July 30 meeting. At the meeting, staff provided one email that was received in support of the
applicant’s request from a neighborhood resident. Commissioners inquired about notice provided and
whether other neighbors had provided feedback. Staff noted for Subdivision Variations, notice is
provided to each owner in the Subdivision itself. Mr. Jahnke confirmed he had provided written notice to
other owners in the subdivision as required. He noted he had conversations with neighbors about the
request, and none indicated objections. No members of the Public addressed the Commission on this
matter. Commissioners requested that Mr. Jahnke and his contractor evaluate the location of the porch
relative to the windows on the front façade, but noted that the Subdivision Variation’s intent is not to
provide design approval. Commissioners acknowledged but for the building line, the applicant’s request
would conform with the Zoning Code. They understood the applicant’s request to provide better
weather protection, as the applicant noted that as part of the permit they are seeking included a front
door replacement, due to rot that has occurred in the past.
The PC recommended approval of the Subdivision variation, as depicted in plans attached to Resolution
2025-101-R.
Alternatives: The City Council can approve the Resolution as presented, add conditions, or not approve
the Resolution.
Impacts: Approval of Resolution 2025-101-R will grant the minimal Subdivision Variation needed to
accomplish the proposed porch addition. No impacts to staffing or budget are expected.
Timeline for Actions: COW action on Resolution 2025-101-R will allow it to appear on the August 18 City
Council agenda for final action.
Recommendation: By a vote of 4-0 (3 vacant), the Plan Commission and Zoning Board of Appeals
recommended approval of the requested Subdivision Variation.
Staff recommends approval of draft Resolution 2025-101-R as presented.

A RESOLUTION APPROVING A VARIATION TO
THE SUBDIVISION REGULATIONS (CITY CODE TITLE 11)
947 BRITTA LANE
WHEREAS, on October 2, 1972, the Batavia City Council approved the Carriage Crest
Subdivision, Unit No. 4, recorded as Document Number 1253392, with a 25-foot building line
applied to the subject property’s front lot line; and
WHEREAS, the subject property is zoned R1-L Single-Family Low Density that requires a front
setback of 30 feet; and
WHEREAS, the subject residence is presently approximately 26.06 feet from the front property
line, and is a non-conforming structure; and
WHEREAS, the Zoning Code, under 4.101.K allows a non-conforming structure to construct a
four foot covered porch from the structure; and
WHEREAS, property owners Nathan and Faith Jahnke has requested a Variation to Subdivision
Regulations Section 11-4-5.A to add to their residence an open, roofed front porch that would
extend approximately three (3) feet into the 25 foot building line area, in accordance with the
allowances for a covered porch on a non-conforming residence; and
WHEREAS, on July 30, 2025, the Batavia Plan Commission found that the referenced
Subdivision Regulations Section specifically states that its regulation be in accordance with the
minimum requirements of a property’s zoning district; and
WHEREAS, the Batavia Plan Commission found that strict adherence to the recorded building
line that requires a setback that would otherwise not allow the present structure a front porch for
proper weather cover for the front entrance, as allowed under the allowed encroachments of the
Zoning Code and would cause unnecessary hardship for the requested open, roofed front porch,
and subsequently recommended City Council approval of a Variation to allow a porch to extend
approximately three (3) feet beyond the building line, in general conformance to the submitted
drawings; and
WHEREAS, on August 12, 2025, the City Council’s Committee of the Whole reviewed said
Variation and the action of the Plan Commission and recommended approval of the same, in
accordance with the recommendation of the Plan Commission.
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Batavia, Kane and
DuPage Counties, Illinois:
SECTION 1: That a Variation to Subdivision Regulations Section 11-4-5.A, to allow an open,
roofed front porch attached to the residence at 947 Britta Lane extending approximately three (3)
feet into the 25-foot building line area to allow the proposed porch to extend approximately four

CHANGING THE NAME OF LOCKWOOD COURT TO JEFFERSON
COURT IN THOUSAND PINES UNIT 5 SUBDIVISION
WHEREAS, the Subdivision Plat for Thousand Pines Unit Number 5 Subdivision, was
approved by the Batavia City Council on April 5, 1976; and
WHEREAS, said Plat was recorded in the Office of the Kane County Recorder of Deeds on
March 21, 1977, as Document 1398563; and
WHEREAS, a street segment on said Plat is identified as “Lockwood Court”; and
WHEREAS, said the name of this street has been historically referenced and signed as
Jefferson Court; and
WHEREAS, The present street name recorded versus used in practice can cause confusion
for emergency response and general way finding; and
WHEREAS, 65 ILCS 5/11-80-19 authorizes municipalities to change the name of any street,
avenue, alley or other public place within its jurisdiction; and
WHEREAS, to date, all owners on this street are using the Jefferson Court name, therefore, no
person or persons will be inconvenienced by the renaming of said street;
NOW, THEREFORE, BE IT HEREBY ORDAINED by the City Council of the City of Batavia,
Kane and DuPage Counties, Illinois as follows:
SECTION 1: That the portion of the Street identified and named “Lockwood Court” in the Plat
for Thousand Pines Unit Number 5 Subdivision recorded in the Office of the Kane County
Recorder of Deeds on March 21, 1977, as Document 1398563 South Jefferson Street east to
the street end depicted on Exhibit “A” is hereby changed to be, and be identified and named
as, “Jefferson Court”.
SECTION 2: The Community and Economic Development Director is hereby directed to cause
a duly certified copy of this Ordinance to be immediately recorded at the Office of the Kane
County Recorder of Deeds, and the Community and Economic Development Director is further

SUBJECT: Ordinance 2025-042: Amendments to Text of the Zoning Code, Chapter 4.4:
Sign Regulations Relating to Wall Signs above the first floor in the LI and GI
Zoning Districts

Summary: The Plan Commission and Zoning Board of Appeals (PC) conducted a public hearing at their July
30th meeting for a proposed text amendment of the Zoning Code (City Code Title 10). The proposed change
would modify the Sign Regulations under 4.407.C.1d for the LI Light Industrial and GI General industrial
District to allow wall signs above the first floor, subject to the existing wall sign requirements of the district.
It would specify that signs above the second floor would require review by the Plan Commission. It would
also clearly indicate signs on the first floor or along a mezzanine require Administrative Design Review by
Staff. The change is requested by Aldi Inc., in order to place signs on the main office building and the new
parking deck.
Background: In 2010, the Zoning Code included limitation of signage above the first floor in several districts.
This included the DMU and PFI Districts. This was revised over the past several years in those districts. Aldi
has been making substantial updates to their campus, with the new office addition, significant renovations in
the office wings and the new parking deck and related site improvements. Aldi has been making these
updates in preparation of bringing area staff back to the Batavia campus. To complete these updates they
are seeking to add their brand identity with signage at the main entrance of the office building, and along
the parking deck. Staff felt it was appropriate for the applicant to seek a text amendment to facilitate the
request. As drafted in Ordinance 2025-042, the proposed change would be limited to the LI and GI districts
under the employment districts specifically, and not the O Office or SB, Service Business districts. The
language would clarify the handling of buildings with mezzanine office areas with this requirement, treating
them as a sign on a single story building. It would require that signs above the second floor receive Plan
Commission review and approval.
Plan Commission Review and Action: At the hearing, Brian Holcombe of Aldi explained the request to the
PC. He noted that the proposed changes would facilitate two signs which were presented to the
Commission for review. It was noted that the signs would otherwise comply with the Batavia Sign
Regulations. The Commission reviewed two proposed locations of the Parking Deck sign, with the
Commission preferring the centered version of the signage. Generally, the Commission was comfortable
with the proposed changes. The Commission felt that the SB, O districts could be located too close
residential areas, and preferred to continue to limit signage above the first floor in those districts. The
Commission compared the allowances to other districts, where they felt it was appropriate in these two
districts. The Commission also felt it was important that they review these signs in order to address
conditions that may be more unique to certain buildings or sites. No members of the public spoke at the
hearing.
By a vote of 4-0 (3 absent, vacancies) the Plan Commission recommended the City Council’s approval,
subject to the conditions included in Draft Ordinance 2025-042.
Alternatives: The Committee of the Whole can recommend approval or denial of the draft Ordinance 2025-
042 as presented or consider amendments before acting.

Impacts: Approval will allow for additional signage opportunity on certain buildings in the LI and GI District,
while providing the ability for the Plan Commission to review and approve those signs that may have
additional impacts. Staff anticipates no negative impacts to City services or staffing if Ordinance 2025-042
is adopted.
Timeline for Actions: COW action will allow for final City Council action on August 18, allowing Aldi to pursue
construction of the requested signs as part of their campus upgrades.
Recommendation: By a vote of 4-0 (3 vacancies), the PC recommended approval of the amendments to text of
the Zoning Code to the City Council as presented in draft Ordinance 2025-042.
Staff recommends approval of Ordinance 2025-042 as presented.

AMENDING THE CITY OF BATAVIA ZONING CODE CHAPTER 4.4:
SIGN REGULATIONS,
TITLE 10 OF THE CITY CODE
WHEREAS, the City of Batavia's Zoning Code (City Code Title 10) contains definitions and
provisions relating to the use and development of land in the City of Batavia; and
WHEREAS, Aldi Inc., as applicant has made application requesting that certain Sections of the
Zoning Code be reviewed to better regulate aspects of Signage in Employment Districts4.; and
WHEREAS, said provisions have been reviewed and it has been determined that these and certain
other provisions, and requirements should be amended in order to better regulate the use and
development of land in the City of Batavia; and
WHEREAS, public notice of proposed amendments to Title 10 of the Batavia City Code was duly
given and published as required by law; and
WHEREAS, the Plan Commission and Zoning Board of Appeals of the City of Batavia did, on
July 30, 2025 conduct a public hearing with respect to proposed amendments that would
accomplish the appropriate changes to Title 10, and voted to recommend approval of said
amendments to Title 10 of the City Code to the City Council’s Committee of the Whole; and
WHEREAS, the City Council’s Committee of the Whole has received the recommendation of the
Batavia Plan Commission and recommended approval of said amendments; and
WHEREAS, the City Council of the City of Batavia has received the recommendation of both the
Batavia Plan Commission and the Committee of the Whole, and has considered same; and
WHEREAS, it is in the best interests of the City of Batavia and its residents that the proposed
Ordinance be adopted by the City Council of the City of Batavia.
NOW THEREFORE, BE IT ORDAINED, by the City Council of the City of Batavia, Kane and
DuPage Counties, Illinois:
SECTION 1: That the City of Batavia Zoning Code (Title 10 of the City Code) is hereby amended
in conformance with the terms of this Ordinance.
SECTION 2: That the City of Batavia Zoning Code Section 4.407.C.1.d is hereby amended to be
revised to read as follows:
d. Multi-Story Buildings. Wall Signs shall be only be located on the first floor of a multi-story
building in the SB, Service Business District and O Office District. Wall Signs may be permitted
above the first floor in the LI, Light Industrial District and the GI, General Industrial District,
subject to the following requirements.

Signs above the second story are subject to the same size and dimension
requirements of Section 4.407.B.1.
SECTION 3: That this Ordinance 2025-042 shall be in full force and effect upon its presentation,

Re: ORD 2025-043 Amending 2025 Wages and Salaries for Non-Collective Bargained Employees
The Assistant Director of Public Works/City Engineer gave notice that he was leaving on August 8, 2025,
to pursue another employment opportunity.
With the opening, staff took the opportunity to review/evaluate the current staffing structure and are
recommending the following changes:
• The current Assistant City Engineer to be promoted to the new position of City Engineer
• Eliminate the position of Assistant City Engineer
• Promote the Electric Superintendent to a new position of Assistant Director of Public
Works/Electric
• Eliminate the position of Assistant Director of Public Works/City Engineer
• Eliminate the position of Electric Superintendent
The additional duties for the electric utility that had previously been the responsibility of the former
Director of Public Works and Assistant Director of Public Works/City Engineer justify upgrading the
Electric Superintendent’s position to Assistant Director/Electric. This position has oversight of just the
electric utility. The engineering department will be managed by the City Engineer who will report to the
Director of Public Works.
In addition to these changes the engineering department is proposing to add a Civil Engineer in place of
the open Engineering Assistant position. A recent search resulted in finding no suitable candidates for
the Engineering Assistant position, and with the Assistant Director of Public Works/City Engineer leaving,
the department needs another Civil Engineer to manage its current workload.
The proposed changes result in annual cost savings of $147,166.
Staff request that the City Council approve the proposed changes and the amended wage and salary
ordinance 2025-043 for non-collectively bargained employees reflecting the changes.

AN ORDINANCE AMENDING THE 2025 WAGES AND SALARIES FOR
NON-COLLECTIVELY BARGAINED EMPLOYEES
BE IT ORDAINED by the City Council of the City of Batavia, Kane and DuPage Counties,
Illinois, that the following rules, regulations, and wage plans are hereby established for employees
of the City of Batavia, Illinois:
SECTION 1: SALARIES AND WAGES
1. All employees and appointed officials of the City of Batavia, Illinois, other than those
represented by certified collective bargaining units, or separate contract, shall receive
wages and compensation as hereafter from time to time established by separate ordinance,
and such salaries or compensation shall be in accordance with the standards set forth in the
wage structure, or plan marked “Exhibit A,” attached hereto and made a part hereof.
Employees represented by certified collective bargaining units shall receive wages and
benefits according to their respective agreements.
2. For the purpose of this ordinance, full-time employees are defined as employees who work
an average of 40 hours per week per year (except for employees that work a platoon
schedule); all other employees are considered part-time.
3. Whenever it is necessary to determine an hourly rate for any non-sworn full-time employee
within the aforesaid salary plan, such rate shall be computed based on 2080 work hours per
year.
4. New employees of the City shall receive the salary authorized by the City Administrator,
providing such salary shall be within the salary range as set forth in “Exhibit A” and in
accordance with the personnel policies of the City of Batavia, unless otherwise authorized
by the City Council.
SECTION 2: DURATION AND REVIEW
This amended Ordinance shall be in effect on the date approved by City Council and shall be
subject to review at the end of calendar year 2025, unless otherwise amended.
SECTION 3: ORDINANCES IN CONFLICT
All ordinances or parts of ordinances in direct conflict herewith are repealed.
SECTION 4: VALIDITY OF ORDINANCE
If any part or parts of this Ordinance are, for any reason, held to be invalid, such decisions shall
not affect the validity of the remaining portions of this Ordinance.

Senior Water & Sewer Utilities Operator shall receive an annual stipend of $400 for completion
of the Illinois Public Service Institute Program.
Records Technicians shall receive a $200 annual stipend should the Chief of Police designate an
employee as a “matron”. Any records technician designated as a matron shall receive appropriate
training and will be notified on an annual basis of their designation.

The employee who completes administrative assistant duties related to the Police and Fire
Commission will receive an annual stipend of $3,500. The employee who completes
administrative assistant duties related to the Fire Protection District, Police and Fire Pension, Tri-
City Ambulance and Tri-Com will receive an annual stipend of $3,500.
Effective May 5, 2025 the employee who is appointed to the Budget Office and Treasurer duties
shall receive an annual stipend of $3,500.
Employees that receive certifications for additional training or qualifications may receive an
annual stipend for such certifications as approved by the City Administrator. Such amounts will
not exceed $500 per year in total.
Employees that reach a milestone anniversary will receive an annual token award in a form and
manner approved by the City Administrator.
PART-TIME AND TEMPORARY PERSONNEL
Regular Part-Time: same hourly rate as full-time employee in same classification.
Temporary: shall be subject to current state and federal minimum wage standards or compensated
in a greater amount by the City.

Purpose:
To guide resource planning and investment decisions for the Batavia Municipal Electric
Utility in alignment with reliability, sustainability, affordability, and adaptability objectives.
1. Ownership Structure
The utility seeks a balanced ownership model, prioritizing ownership of local renewable
generation, storage assets, and grid infrastructure upgrades while contracting large-scale
or complex resources or other highly regulated technologies. This approach supports cost
control, risk management, and operational flexibility. The city seeks to mitigate long term
regulatory burdens where possible.
2. Resource Location
Emphasis will be placed on developing local generation and storage resources to enhance
resilience and community benefits. The policy encourages home and community energy
systems, including rooftop solar and localized storage, while also maintaining geographic
diversity in contracted resources to reduce exposure to regional risks.
3. Resource Diversity
The utility aims to diversify its resource portfolio across renewable energy, storage
technologies, efficiency and demand side programs, and firm capacity resources. This mix
will prioritize reliability, sustainability, and cost-effectiveness, ensuring flexibility as
technologies and market conditions evolve.
4. Hedging Policy
To maintain price stability and affordability, the utility will seek portfolio diversity, phased
procurement, and contracts for large-scale resources. Consideration will be given to
mitigating regulatory compliance costs and future environmental liabilities.
5. Time to Connect
Grid modernization and internal upgrades will be pursued aggressively to improve local
reliability and reduce connection timelines for distributed and utility-scale resources.
6. Timing
The utility will adopt a phased implementation strategy, balancing immediate needs for
reliability and resilience with the flexibility to incorporate emerging technologies.
Investments will be staged to avoid overbuilding and ensure alignment with trends and
market dynamics.
