HOUSING BOARD OF APPEALS HEARING MINUTES March 19, 2014 CITY HALL 10 N. DIVISION STREET COMMISSION CHAMBERS 3RD FLOOR – ROOM 301 BATTLE CREEK MI 49014 Call to Order: 1:03 Roll Call for Board Members: Stan Chubinski, Tony Goodman, John Hennink, Ed Harris Staff Members Present: Jason Francisco, Senior Code Officer; Todd Nowicki, Senior Code Officer; Elijah Martin, Code Officer; Jeanette Cook, Senior Code Officer; Eric Morris, Senior Code Officer; Dennis McKinley, Code Compliance Administrator; Lisa Silkworth, Secretary; Don Wilkinson, Building Inspector. Additions/Deletions to the Agenda: none Approval of Minutes: Mr. Goodman made a motion to approve the minutes from the February 19, 2014 meeting seconded by John Hennink. Old Business: Mr. Goodman wanted clarification on the Boards input on solutions for the property owners. New Business: a. 58 Hazel St Issue#EN14-00371 Code Compliance Officer: Jeanette Cook Property owner, Curtis Johnson, present. Jeanette Cook, Senior Code Officer, noted there was some missing house numbers and siding at the property. Mr. Johnson is requesting some additional time. Ms. Cook recommended an additional thirty days. Mr. Goodman made a motion to grant a thirty day extension until April 15, 2014 seconded by Mr. Hennink. Extension granted. Eric Morris, Senior Code Officer reported the violations were noted during an inspection of the property. Mr. Morris reported there were nails protruding from the steps and other safety issues. Mr. Morris also stated there were interior violations. Mr. Morris recommended a thirty day extension. Mr. Hibbard stated due to weather issues he has not started the repairs but the unit is unoccupied. Mr. Hibbard is requesting a thirty day extension. Mr. Goodman made a motion to grant a thirty day extension until April 15, 2014 seconded by Mr. Chubinski. Extension granted. Eric Morris, Senior Code Officer, reported the violations were health and safety issues and have been turned over to the Plumbing Inspector. Mr. Harris made a motion to affirm the order as written due to no owner present seconded by Mr. Goodman. Affirmed. Elijah Martin , Code Officer, noted the property has already had one extension and this would be the second. Mr. Goodman made a motion to affirm the order due to no owner present seconded by Mr. Mr. Hennink. Affirmed. Mr. Goodman made a motion to affirm the order as written due to no owner present seconded by Mr. Hennink. Affirmed. Todd Nowicki, Senior Code Officer, noted the property had some siding issues. Mr. Goodman made a motion to affirm the order as written due to no owner present seconded by Mr. Hennink. Affirmed. Todd Nowicki, Senior Code Officer, reported the house has been difficult to get reinspected. The violations were noted during a rental inspection. Mr. Goodman made a motion to affirm the order as written seconded by Mr. Hennink. Affirmed. Jason Francisco, Senior Code Officer, noted the violations were found during a rental inspection. Mr. Francisco recommended granting a thirty day extension. Mr. Roth is working with the tenants to get in and make the repairs. Mr. Roth is requesting to May 5, 2014. Mr. Roth asked for clarification about the screen door hardware. Mr. Harris made a motion to grant a thirty day extension to April 15, 2014 seconded by Mr. Goodman. Extension granted. Jason Francisco, Senior Code Officer, noted the violations were found during a rental inspection. Mr. Francisco recommended granting a thirty day extension. Mr. Roth is working with the tenants to get in and make the repairs. Mr. Roth is requesting to May 5, 2014. Mr. Harris made a motion to grant a thirty day extension to April 15, 2014 seconded by Mr. Goodman. Extension granted. Goodman-y Chubinski-y Hennink-y Harris-y Dangerous Buildings Show Cause Hearings: a. 2309 W Columbia Ave (House) Issue#EN13-06408 Code Compliance Administrator: Dennis McKinley Property owner, not present. Don Wilkinson, Building Inspector, reported the owner had been in contact with Dennis McKinley, Code Compliance Administrator, who plans to tear the property down this summer. Mr. McKinley recommended affirming it as a dangerous building. Mr. Harris Housing Board of Appeals March 19, 2014 Page 5 of 7 made a motion to affirm it as a danger building seconded by Mr. Hennink. Affirmed. Goodman-y Chubinski-y Hennink-y Harris-y b. 695 W Michigan Ave (Commercial) Issue#EN13-06563 Code Compliance Administrator: Dennis McKinley Property owner, not present. Don Wilkinson, Building Inspector, reported the property has a cost estimate of repair exceeds the SEV and recommended affirming it as a dangerous building. Mr. Harris made a motion to affirm it as a danger building seconded by Mr. Hennink. Affirmed. Goodman-y Chubinski-y Hennink-y Harris-y c. 18 Plymouth (House) Issue#EN13-06628 Code Compliance Administrator: Dennis McKinley Property owner, not present. Don Wilkinson, Building Inspector, reported the house was severely damaged by fire. Mr. Goodman made a motion to affirm it as a dangerous building seconded by Mr. Hennink. Affirmed. Goodman-y Chubinski-y Hennink-y Harris-y d. 12722 Sonoma Rd (House) Issue#EN13-06594 Code Compliance Administrator: Dennis McKinley Property owner, not present. Don Wilkinson, Building Inspector, noted this property was discovered upon a police welfare check. Mr. Wilkinson noted there was no active heat and the faucets were rusted shut. Mr. Goodman made a motion to affirm it as a dangerous building seconded by Mr. Harris. Affirmed. Goodman-y Chubinski-y Hennink-y Harris-y Housing Board of Appeals March 19, 2014 Page 6 of 7 e. 27 Warren (Commercial) Issue#EN13-06551 Code Compliance Administrator: Dennis McKinley Property owner, Ramon Rangel, present. Don Wilkinson, Building Inspector, reported the four unit apartment building was heavily damaged by fire and the putting out of the fire. Mr. Rangel noted there was no insurance on the property. Mr. Rangel intends to repair the building. Mr. Wilkinson recommended affirming it as a dangerous building. Mr. Chubinski made a motion to affirm it as a dangerous building seconded by Mr. Goodman. Affirmed Goodman-y Chubinski-y Hennink-y Harris-y f. 717 N Washington(House) Issue#EN13-6025 Code Compliance Administrator: Dennis McKinley Property owner, not present. Don Wilkinson, Building Inspector, noted the property was damaged by fire. Mr. Wilkinson also noted the owner has started pulling permits to make repairs. Mr. Wilkinson recommended affirming it as a dangerous building. Mr. Goodman made a motion to affirm it as a dangerous building seconded by Mr. Chubinski. Affirmed. Goodman-y Chubinski-y Hennink-y Harris-y Public Comments: none Board and Staff Members Comments: Mr. Wilkinson stated the date of the fire for 27 Warren was in December and there has been no contact with the owner as of this meeting. Mr. McKinley noted if a property does not have a rental permit then it should not be occupied. Mr. Goodman asked about fire escrow funds.
