BOARD OF APPEALS HEARING MINUTES OCTOBER 19, 2016 CITY HALL 10 N. DIVISION STREET COMMISSION CHAMBERS 3RD FLOOR – ROOM 301 BATTLE CREEK MI 49014 Call to Order: 1:04pm Roll Call for Board Members: John Sims, Robert Whitfield, Eric Blair Staff Members Present: Yolanda Johnson, Code Officer; Jaqueline Slaby, Code Officer; Tom Engels, Senior Code Officer; Jason Francisco, Code Compliance Manager; Lisa Silkworth, Secretary Additions/Deletions to the Agenda: Remove 215 Laurel, 342 Cornell, and 345 Cornell Approval of Minutes: Mr. Sims made a motion to approve the minutes from the September 21, 2016 meeting, seconded by Mr. Blair. Approved. Old Business: none Dangerous Buildings Show Cause Hearings: none New Business: 1. 661 W Van Buren Issue#EN16-04899 Code Officer: Yolanda Johnson Property owner, Linda Westry, present. Yolanda Johnson, Code Officer, stated the violation were exterior in nature. Ms. Johnson noted there were new stairs but the painting was not completed. Ms. Westry stated the house had been vacant for and the water had been turned off. Ms. Westry has since had the water turned back on. Ms. Westry stated the interior had been painted. Ms. Westry is requesting more time. Ms. Johnson recommended granting more time for the painting but interior work needed to be corrected. Mr. Sims made a motion to grant an extension to November 15, 2016 for all violations Housing Board of Appeals October 19, 2016 Page 2 of 4 except painting and painting until May 16, 2017, seconded by Mr. Blair. Extension granted. 2. 182 Orchard Ave Issue#EN16-09764 Code Officer: Jaqueline Slaby Property owner, Russell Robbins, present. Jaqueline Slaby, Code Officer, stated the violations were exterior in nature. Ms. Slaby noted the correction date is May 1, 2017. Mr. Robins is requesting an extension to September 2017. Mr. Sims made a motion to affirm the order as written, seconded by Mr. Blair. Affirmed. 3. 175 Sherman Rd Issue#EN16-09845 Code Officer: Jacqueline Slaby Property owner, Rose Sims, present. Jaqueline Slaby, Code Officer, stated the violations were exterior painting and roof repair. Ms. Sims questioned the violations regarding the roof. Ms. Slaby noted the peeling on trim and garage. Ms. Sims stated she was looking for assistance. Ms. Slaby recommended affirming the date on the paint but extending the time for the roof to May 2017. Ms. Sims has a roof estimates from Mr. Roof for the whole roof. Mr. Blair made a motion to grant an extension for roof repair to May 1, 2017, no second. Mr. Blair rescinded his motion. Mr. Sims made a motion to grant an extension for roof repair to February 1, 2017, seconded by Mr. Blair. Extension granted. 4. 342 Cornell Issue#EN16-06091 Code Officer: Eric Morris REMOVE 5. 345 Cornell Issue#EN16-06092 Housing Board of Appeals October 19, 2016 Page 3 of 4 Code Officer: Eric Morris REMOVE 6. 215 Laurel Dr Issue#EN16-06685 Code Officer: Eric Morris REMOVE 7. 772 E Emmett Issue#EN16-05754 Code Officer: Tom Engels Property owner, Robert Mansfield, present. Tom Engels, Senior Code Officer, stated the exterior had peeling paint. Mr. Mansfield stated some of the buildings would be demolished and they are currently remodeling the facility. Mr. Mansfield stated he is trying to have it complete by September 2017. Mr. Mansfield explained his plan of action. Mr. Blair made a motion to grant an extension to May 1, 2017, seconded by Mr. Sims. Extension granted. 8. 10 Richards Pl Issue#EN16-08542 Code Officer: Tom Engels Property owner, Stephen Jenkins, present. Tom Engels, Senior Code Officer, stated the violations were noted during a rental inspection. Mr. Engels noted the steps had been repaired and screens had been installed. Mr. Jenkins noted the renter was being evicted. Mr. Blair made a motion to put it on hold, Mr. Blair rescinded that motion. Mr. Blair made a motion to grant an extension to November 15, 2016, seconded by Mr. Sims. Extension granted.
