BOARD OF APPEALS HEARING MINUTES June 21, 2017 CITY HALL 10 N. DIVISION STREET COMMISSION CHAMBERS 3RD FLOOR – ROOM 301 BATTLE CREEK MI 49014 Call to Order: 1:00pm Roll Call for Board Members: Stan Chubinski, Robert Whitfield, Eric Blair, Kara Werner Staff Members Present: Don Wilkinson, Building Inspector; Jason Francisco, Code Compliance Manager; Eric Morris, Senior Code Officer ; Todd Nowicki, Senior Code Officer; Tom Engels, Senior Code Officer Additions/Deletions to the Agenda: Remove 515 W Michigan, 396 N Washington, 453 Wentworth, 291 Champion St, 100 Grand Approval of Minutes: Old Business: none Dangerous Buildings Show Cause Hearings: a. 4 Bartlett (House) Issue#EN17-01948 Building Inspector: Don Wilkinson Property Owner, not present. Don Wilkinson, Building Inspector, stated the property has been vacant over 180 days, lacks utilities and lacks maintenance. Mr. Blair made a motion to affirm the property as a Dangerous Building, seconded by Ms. Werner. Affirmed. b. 148 Cherry St (House) IssueEN17-01037 Building Inspector: Don Wilkinson Property Owner, not present. Don Wilkinson, Building Inspector, stated the property has been vacant over 180 days, lacks utilities and lacks maintenance. Mr. Blair made a motion to affirm the Housing Board of Appeals June 21, 2017 Page 2 of 6 property as a Dangerous Building, seconded by Mr. Whitfield. Affirmed. c. 64 Cliff (House) Issue#EN17-01947 Building Inspector: Don Wilkinson Property Owner, not present. Don Wilkinson, Building Inspector, stated the property has been vacant over 180 days, lacks utilities and lacks maintenance. Mr. Wilkinson noted there was a permit to repair the roof. Mr. Blair made a motion to affirm the property as a Dangerous Building, seconded by Mr. Whitfield. Affirmed. d. 17 Forest (House) Issue#EN17-01945 Building Inspector: Don Wilkinson Property Owner, not present. Don Wilkinson, Building Inspector, stated the property has been vacant over 180 days, lacks utilities and lacks maintenance. Mr. Whitfield made a motion to affirm the property as a Dangerous Building, seconded by Mr. Blair. Affirmed. e. 33 Hubert (House) Issue#EN17-00895 Building Inspector: Don Wilkinson Property Owner, not present. Don Wilkinson, Building Inspector, stated the property has been vacant over 180 days, lacks utilities and lacks maintenance. Mr. Blair made a motion to affirm the property as a Dangerous Building, seconded by Mr. Whitfield. Affirmed. f. 689 W Van Buren (House) Issue#EN17-01944 Building Inspector: Don Wilkinson Property Owner, not present. Don Wilkinson, Building Inspector, stated the property has been vacant over 180 days, lacks utilities and lacks maintenance. Mr. Wilkinson stated there are no active permits. Mr. Blair made a motion to affirm the property as a Dangerous Building, seconded by Mr. Whitfield. Affirmed. Housing Board of Appeals June 21, 2017 Page 3 of 6 New Business: 1. 179 Parish St Issue#EN17-02234 Code Compliance Officer: Eric Morris Property owner, not present. Jason Francisco, Code Compliance Manager, stated the violations were exterior in nature. Mr. Francisco recommended affirming the order as written due to no owner present. Mr. Blair made a motion to affirm the order as written, seconded by Mr. Whitfield. Affirmed. 2. 45 W Baldwin Issue#EN17-02897 Code Compliance Officer: Todd Nowicki Property owner, not present. Todd Nowicki, Senior Code Officer, stated the violations were exterior in nature. Mr. Nowicki recommended affirming the order as written due to no owner present. Mr. Blair made a motion to affirm the order as written, seconded by Mr. Whitfield. Affirmed. 3. 189 Roseneath Ave Issue#EN17-04148 Code Compliance Officer: Todd Nowicki Property owner, Monica Lee, present. Todd Nowicki, Senior Code Officer, stated the violations were exterior on the garage. Mr. Nowicki stated no work had been started. Ms. Lee requested more time due to health issues. Ms. Lee also noted she has called for assistance but has not been approved for assistance. Mr. Whitfield asked for a plan of action. Mr. Whitfield made a motion to grant an extension to August 15, 2017, seconded by Mr. Blair. Extension granted. 4. 515 W Michigan Ave Issue#EN17-02164 Code Compliance Officer: Yolanda Johnson REMOVED 5. 396 N Washington Housing Board of Appeals June 21, 2017 Page 4 of 6 Issue#EN17-02322 Code Compliance Officer: Yolanda Johnson REMOVED 6. 453 Wentworth Issue#EN17-02787 Code Compliance Officer: Tom Engels REMOVED 7. 8 Bernardo Pl Issue#EN17-01183 Code Compliance Officer: Tom Engels Property owner, William Moser, present. Tom Engels, Senior Code Officer, noted the violations was regarding the roof. Mr. Moser stated he has requested a Minor Home Repair Grant. Mr. Whitfield made a motion to grant an extension to July 18, 2017, seconded by Mr. Blair. Extension granted. 8. 291 Champion St Issue#EN17-01232 Code Compliance Officer: Tom Engels REMOVED 9. 482 Cliff St Issue#EN17-03840 Code Compliance Officer: Tom Engels Property owner, Laura Cash, present. Tom Engels, Senior Code Officer, stated the violation noted was the roof. Ms. Cash stated she was waiting for money to make the repairs. Mr. Blair made a motion to grant an extension to August 15, 2017, seconded by Mr. Whitfield. Extension granted. 10. 100 Grand Ave Issue#EN17-01253 Code Compliance Officer: Tom Engels REMOVED Housing Board of Appeals June 21, 2017 Page 5 of 6 11. 105 Grand Ave Issue#EN17-01255 Code Compliance Officer: Tom Engels Property owner, Richard Stanley, present. Tom Engels, Senior Code Officer, stated the exterior violations were noted during a routine property survey. Mr. Stanley stated he is trying to find assistance and has been sick recently. Mr. Blair made a motion to grant an extension to August 15, 2017, seconded by Mr. Whitfield. Extension granted. 12. 111 Greenwood Ave Issue#EN17-01343 Code Compliance Officer: Tom Engels Property owner, Darice Jackson, present. Tom Engels, Senior Code Officer, noted the exterior violations were noted during a routine property survey. Ms. Jackson stated some repairs have been made and some painting have been done. Ms. Jackson noted they are trying to find the funds to make the rest of the repairs. Ms. Jackson stated she intends to make all repairs. Mr. Whitfield made a motion to grant an extension to August 15, 2017, seconded by Mr. Blair. Extension granted. 13. 237 N Washington Issue#EN17-01831 Code Compliance Officer: Tom Engels Property owner, not present. Tom Engels, Senior Code Officer, stated the violations were exterior in nature. Mr. Engels recommended affirming the order as written due to no owner present. Mr. Blair made a motion to affirm the order as written, seconded by Mr. Whitfield. Affirmed. Public Comments: none Board and Staff Members Comments: Mr. Chubinski noted he will not be attendance at the next meeting in July.
