BOARD OF APPEALS HEARING MINUTES JULY 18, 2018 CITY HALL 10 N. DIVISION STREET COMMISSION CHAMBERS 3RD FLOOR – ROOM 301 BATTLE CREEK MI 49014 Call to Order: 1:02pm Roll Call for Board Members: Eric Blair, John Sims, Robert Whitfield, Stan Chubinski Staff Members Present: Jason Francisco, Code Compliance Manager; Yolanda Johnson, Senior Code Officer; Don Wilkinson, Building Official; Lisa Silkworth, Secretary Additions/Deletions to the Agenda: Remove 239 S LaVista Approval of Minutes: Mr. Sims made a motion to approve the minutes from the June 20, 2018 meeting, seconded by Mr. Chubinski. Approved Dangerous Buildings Show Cause Hearings: a. 155 W Fountain (House) Issue#EN18-05885 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Official, stated the house has been vacant over 180 days, lacks maintenance, and has no utilities. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Sims made a motion to affirm the property as a Dangerous Building, seconded by Mr. Chubinski. Affirmed. All Yes b. 109 Nelson (House) Issue#EN18-05886 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Official, stated the house has violations found during a police call and minimal progress has been made. The house currently has no occupancy. Mr. Housing Board of Appeals July 18, 2018 Page 2 of 4 Wilkinson recommended affirming the property as a Dangerous Building. Mr. Chubinski made a motion to affirm the property as a Dangerous Building, seconded by Mr. Sims. Affirmed. All Yes c. 57 South Ave (House) Issue#EN18-06314 Building Inspector: Don Wilkinson Property owner, Penny Barnhardt for Stephen Bates, present. Don Wilkinson, Building Official, stated the house has numerous violations and no occupancy. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Ms. Barnhardt requested 90 days. Mr. Wilkinson noted the property has been vacant since 2008. Mr. Sims made a motion to affirm the property as a Dangerous Building, seconded by Mr. Whitfield. Affirmed. All Yes New Business: 1. 239 S LaVista Blvd Issue#EN18-05616 Code Officer: James Belmore REMOVE 2. 433 E Emmett St Issue#EN18-07185 Code Officer: Todd Nowicki Property owner, Billy Moton, present. Jason Francisco, Code Compliance Manager, stated the house has exterior violations. Mr. Moton stated he needed more time. Mr. Moton requested 60 days and he has the siding. Mr. Whitfield made a motion to grant an extension to September 18, 2018, seconded by Mr. Chubinski. Extension granted. All Yes Housing Board of Appeals July 18, 2018 Page 3 of 4 3. 1555 W Columbia Ave Issue#EN18-07284 Code Officer: Todd Nowicki Property owner, James Ferrier for Robert Burrell, present. Jason Francisco, Code Compliance Manager, stated the house has exterior violations. Mr. Ferrier stated he needs more time due to work issues. Mr. Sims made a motion to grant an extension to October 16, 2018, seconded by Mr. Whitfield. Extension granted. All Yes 4. 690 N Washington Issue#EN18-05000 Code Officer: Yolanda Johnson Property owner, Loren Hamilton, present. Yolanda Johnson, Senior Code Officer, stated the violations were noted during an investigation of a complaint about that property. Ms. Johnson noted the owner has called her for more time. Mr. Hamilton stated he needs more time due to an injury. He noted he has started to make the repairs. Mr. Chubinski made a motion to grant an extension to September 18, 2018, seconded by John Sims. Mr. Chubinski withdrew his motion. Mr. Whitfield made a motion to grant an extension to October 16, 2018, seconded by Mr. Chubinski. Extension Granted. Sims – No Chubinski – Yes Blair – Yes Whitfield - Yes 5. 4 Riverside Ct Issue#EN18-08349 Code Officer: Yolanda Johnson Property owner, Ronald Densborn, present. Yolanda Johnson, Senior Code Officer, stated the violations were noted during a routine property survey. Mr. Densborn stated he needs more time. Mr. Densborn requested 60 to 90 days. Mr. Whitfield made a motion to grant an extension to October 16, 2018, seconded by Mr. Chubinski. Mr. Whitfield withdrew his motion. Mr. Chubinski made a motion to grant an extension to September 18, 2018, seconded by Mr. Whitfield. Extension granted.
