BOARD OF APPEALS HEARING NOTICE AND AGENDA October 19, 2022 CITY HALL 10 N. DIVISION STREET 3RD FLOOR – ROOM 301 BATTLE CREEK MI 49014 Call to Order: 1:00 pm Roll Call for Board Members: Eric Blair, John Sims, Peter Pontoni Staff Members Present: Jason Francisco, Code Compliance Manager; Don Wilkinson, Building Official; Jerrod Lepper, Code Compliance Officer; Thomas Engels, Code Compliance Officer; Angela Sulak, Secretary Additions/Deletions to the Agenda: None Approval of Minutes: Mr. Sims made a motion to approve the August 17, 2022 minutes, second by Mr. Pontoni. Approved. Dangerous Buildings Show Cause Hearings: a. 189 Bryant St (House) Issue E22-08563 Building Inspector: Don Wilkinson Property owner, not present. Mr. Wilkinson stated that the property has extensive damage from the fire that occurred in July 2022 and was affirmed as a Dangerous Building by the Dangerous Building Official. In its current condition, Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Sims motioned to affirm as written, second by Mr. Pontoni. Affirmed b. 146 Central St (House) Issue EN22-08420 Building Inspector: Don Wilkinson Property owner, not present. Mr. Wilkinson stated that the property has extensive damage from the fire that occurred in July 2022 and was affirmed as a Dangerous Building by the Dangerous Building Official. In its current condition, Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Sims motioned to affirm as written, second by Mr. Pontoni. Affirmed Housing Board of Appeals October 19, 2022 Page 2 of 3 c. 19 Ridge St Issue EN22-08275 Building Inspector: Don Wilkinson Property owner, not present. Mr. Wilkinson stated that the property has extensive fire damage from the fire that occurred in July 2022 and was affirmed as a Dangerous Building by the Dangerous Building Official. In its current condition, Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Sims motioned to affirm as written, second by Mr. Pontoni. Affirmed d. 349 Hamblin Ave (House) Issue EN22-00800 Building Inspector: Don Wilkinson Property owner, not present. Mr. Wilkinson stated that the property has extensive fire damage from the fire that occurred in March 2022 and was affirmed as a Dangerous Building by the Dangerous Building Official. In its current condition, Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Sims motioned to affirm as written, second by Mr. Pontoni. Affirmed New Business: 1. 112 Highway (House) Issue EN22-09116 Compliance Officer: Thomas Engels Homeowner, Brandon McEwen, present. Mr. Engels stated that the property has exterior violations of chipping and peeling paint and broken windows. Mr. McEwen stated that he plans to side the house in the spring once his ol lady gets her tax refund back. Mr. Blair asked if the boarded up windows would be eliminated once sided? Mr. McEwen stated they would be. Mr. Francisco reminded that if the Board approves the extension, it would extend to April 1st, as the City cannot require painting after October 31st. Mr. Sims motioned to extend until November 15, 2022, second by Mr. Pontoni. Mr. Francisco stated that for ease of administering, it should be extended to April 2023. Mr. Sims rescinded his motion, and made a new motion to extend until April 18, 2023, second by Mr. Pontoni. 180-day extension granted. 2. 183 West St (Apartment Complex) Issue EN22-06882 Housing Board of Appeals October 19, 2022 Page 3 of 3 Compliance Officer: Jerrod Lepper Property Representative, Jodi Sager, present. Mr. Lepper stated that apartment has leaks. Ms. Sager stated that they have been looking for bids to repair the masonry on the building, and have only received one bid for 2023 completion. In the meantime, Ms. Sager did hire a roofing company to try to repair the leak over apartment 609. Currently, the roof was patched and no leaks have been reported. Mr. Lepper stated that with the roof repaired and not leaking, he would need to re-inspect the property. Mr. Francisco asked if the interior damage has been repaired? Ms. Sager responded by saying the interior has not been repaired and will not be until it has been verified that it does not leak. Mr. Sims asked if the masonry has to be repaired before the interior will be repaired? Ms. Sager responded with no, and there’s been no leaking so far. Mr. Pontoni stated that the violation was not for the masonry, just the leaky exterior and interior. Mr. Sims motioned to extend to November 15, 2022, second by Mr. Pontoni. 30-day extension granted.
