MEMBERS PRESENT: Commissioners Jennifer Cappell, Judith Mudge MEMBERS ABSENT: Commissioner Gordy Vogt STAFF PRESENT: Vicki Houser, Jeannell Justin, Martin Erskine, Howard Holt, Russ Claggett CALL TO ORDER: President Cappell called the meeting to order at 4:01 PM and recognized that a quorum was present. APPROVAL OF MINUTES 1. A motion was made by Comm. Mudge, supported by Comm. Cappell to approve the Civil Service Commission July 23, 2012 meeting minutes. All yes, none opposed. Motion approved. PETITIONS AND COMMUNICATIONS The Clerk’s office received two communications, one from Shawn Metheny and the other from Derek Maddox, both requesting to be removed from Eligibility Lists. REPORTS There were none. UNFINISHED BUSINESS There was none. NEW BUSINESS 1. Civil Service Commission Acceptance of a letter from Shawn Metheny President Cappell stated the first order of business was to accept the letter from Shawn Metheny voluntarily requesting removal from the “2010 Training Officer Eligibility List.” President Cappell opened the floor for public comment. 1  Seeing no public comment, a motion was made by Comm. Mudge, supported by Comm. Cappell, to accept the letter from Shawn Metheny voluntarily requesting removal from the “2010 Training Officer Eligibility List.” All yes, none opposed. Motion approved. 2. Removal of one candidate from the “2010 Training Officer Eligibility List” (Shawn Metheny) President Cappell stated the next order of business was to remove Shawn Metheny, at his request, from the “2010 Training Officer Eligibility List.” President Cappell opened the floor for public comment. Seeing no public comment, a motion was made by Comm. Mudge, supported by Comm. Cappell, to remove Shawn Metheny, at his request, from the “2010 Training Officer Eligibility List.” All yes, none opposed. Motion approved. 3. Republication of the “2010 Training Officer Eligibility List” President Cappell stated the next order of business was to republish the “2010 Training Officer Eligibility List.” President Cappell opened the floor for public comment. Seeing no public comment, a motion was made by Comm. Mudge, supported by Comm. Cappell, to republish the “2010 Training Officer Eligibility List.” All yes, none opposed. Motion approved. 4. Certify the next candidate on the “2010 Training Officer Eligibility List” (Mihaly Drabik) President Cappell stated the next order of business was to certify the next candidate on the “2010 Training Officer Eligibility List.” – Mihaly Drabik. President Cappell opened the floor for public comment. Seeing no public comment, a motion was made by Comm. Mudge, supported by Comm. Cappell, to certify the next candidate on the “2010 Training Officer Eligibility List.” – Mihaly Drabik. All yes, none opposed. Motion approved. 5. Removal of one candidate from the “2012 Entry-Level Firefighter Eligibility List” ( Derek Maddox) President Cappell stated the next order of business was to remove Derek Maddox from the “2012 Entry-Level Firefighter Eligibility List” at his request. President Cappell opened the floor for public comment. Seeing no public comment, a motion was made by Comm. Mudge, supported by Comm. Cappell, to remove Derek Maddox, at his request, from the “2012 Entry-Level Firefighter Eligibility List.” All yes, none opposed. Motion approved. 6. Certify the next five candidates on the “2012 Entry-Level Firefighter Eligibility List” (Michael Voss, Chad Layton, Joshua Hagen, Zachary Mueller and August Furman) 2  7. President Cappell stated the next order of business was to certify the next five candidates on the “2012 Entry-Level Firefighter Eligibility List.” (Michael Voss, Chad Layton, Joshua Hagen, Zachary Mueller and August Furman) President Cappell opened the floor for public comment. Seeing no public comment, a motion was made by Comm. Mudge, supported by Comm. Cappell, to certify the next five candidates on the “2012 Entry-Level Firefighter Eligibility List.” (Michael Voss, Chad Layton, Joshua Hagen, Zachary Mueller and August Furman). All yes, none opposed. Motion approved. PUBLIC COMMENTS Lt. Jeannell Justin requested written documentation regarding the prior meeting’s removal of agenda item # 3. Lt. Justin inquired if the EEOC had issued findings regarding the “2010 Training Officer Eligibility List” which would have stopped the litigation. Russ Claggett, Employee Relations Director, stated the City has not received findings from the EEOC at this time. Mr. Claggett further stated the matter was not resolved, and the removal from the agenda was so he could review the information shared with EEOC. Mr. Claggett also stated the voluntary withdrawal by Shawn Metheny allowed the certification of the next candidate on the list. Mr. Claggett stated the case was still pending with the Department of Justice. COMMISSION COMMENTS There were none. ADJOURNMENT President Cappell adjourned the meeting at 4:08 PM. 3
