License Review Board Commission Chambers – City Hall 10 N. Division St. Battle Creek, MI 49014 September 9, 2005 Members Present: Denise Washington, Joyce Garrett, Dan Determann, and Sarah Eckstein. Members Absent: Barb Parsons Others Present: Dee Laser, Richard Riley, and Detective Sarah Bush Call To Order: Chairperson Washington called the meeting to order and asked Mr. Riley to speak addressing the issue of how he has been progressing since the last meeting. Mr. Riley stated he has done everything expected of him. He stated he has reported to the Police Department, has been working a lot of hours, and has had no problems. He stated he has not proceeded with his education because of time restraints, however, he plans to continue his education in the future. Ms. Garrett asked how business is going. Mr. Riley answered it is going well. He stated it is very time consuming but he hopes that soon he will have the time to continue his education. He stated he does not buy anything without serial numbers and reports weekly everything he buys. Mr. Determann asked what he is majoring in. He also stated the importance of finishing his education. Mr. Riley stated Marketing. Ms. Washington stated it is possible to maintain your business and also educate yourself. Detective Bush stated Mr. Riley’s statements are accurate. She stated occasionally there are items that do not have serial numbers or specific serial numbers. In reference to contact with Mr. Riley, he was cooperative and provided everything she asked for. Mr. Riley has had no contacts with the Battle Creek Police Department, Emmett Township Police, Calhoun County Sheriff’s Department or Michigan State Police. He has received one Moving Citation (Traffic). Ms. Garrett stated she realizes it is difficult when there is no serial number. She continued the law states the item would be seized and returned or given to the Police Department with Mr. Riley losing money on the item. She stated it would be to Mr. Riley’s benefit to make sure. Detective Bush stated on the Civil end there is a cost recovery. She stated there is a form at the Prosecutor’s Office. Ms. Washington asked if there was a disclaimer being posted at his business to notify consumers of items going through a screening process. Detective Bush stated notification to consumers is not required. Mr. Determann suggested the City Attorney draft language at businesses that could be posted to warn sellers of a screening process. Ms. Garrett agreed. She stated it gives leverage to Mr. Riley. Ms. Washington stated it protects against civil litigation. Mr. Riley stated he uses his best judgment on what he buys. He stated he has repeatedly rejected and turned items down. Ms. Washington applauds Mr. Riley’s efforts. Motion and Findings: A motion was made by Denise Washington, supported by Dan Determann to extend Mr. Riley’s License Permit until April 30, 2006, at which time he will go through a renewal process. All Yes. Motion carried. City Clerk to issue license. Ms. Garrett thanked Mr. Riley for the great job he is doing. The meeting was adjourned at 9:25 a.m. DAL/cjs
