CITY COUNCIL MEETING MINUTES

CALL TO ORDER
Mayor Olson called the meeting to order at 7:00 p.m.
ROLL CALL
Mayor Darrel Olson and Council Members Connie Lyscio, Zach Tabatt, John Ward and Mark Cross were present.
City Administrator Brad Chapulis, Assistant City Administrator Kelly Steele, Community Development Director Josh
Doty, Finance Director Jeremy Vacinek, Police Chief Jim Exsted, IT/GIS Director Todd DeBoer, Assistant Finance
Director Brenda Brooks were present.
PLEDGE OF ALLEGIANCE
All joined Mayor Olson in reciting the Pledge of Allegiance.
ADDITIONS OR CHANGES TO THE AGENDA
None.
PUBLIC COMMENTS - Comments received from the public may be placed on a future meeting agenda for
consideration.
None.
CONSENT AGENDA - The following items are considered non-controversial by staff and are recommended to be read
and passed in one motion. Any council person, staff, citizen, or meeting attendee can request one or more items be
pulled from the Consent Agenda and the item will be pulled and addressed immediately after the passage of the
Consent Agenda; otherwise, the following items will be passed in one motion:

3. Approve the Payment of Bills and Finance Report (Addendum A)

the City of Baxter for Student Supervised Pre-Internship Training
MOTION by Council Member Cross, seconded by Council Member Ward to approve the Consent Agenda.
Motion carried unanimously.

OTHER BUSINESS
15. Future Connection Charge Committee Recommendations
City Administrator Chapulis summarized the council heard a request by Jeanne and John Foss on April 5th
regarding the future connection charges applicable to 14285 Kimberlee Drive. The council formed a
committee consisting of council members Cross and Lyscio to review the city’s future connection charge
policy and to report back to the council with any recommendations. The committee completed its review
and determined the policy still serves the same purpose today as it did when first adopted; there is no
justification to warrant consideration of the Foss’s offer; and to avoid any future connection charge
misunderstandings, the city will record all future connection charges with the county. While the future
connection charge for 14285 Kimberlee Drive is not required to be paid at this time, if the Foss’s wish to
pay of the balance in full, the 2022 payoff amount is $93,846.22. The city will incur approximately $3,800
in recording fees plus any legal fees to record the current 74 future connection charges. Staff is requesting
the council to concur with the committee’s recommendation and reject the Foss offer and direct staff to
record all existing future connection charges by year end.
MOTION by Council Member Cross, seconded by Council Member Tabatt to concur with the committee’s
recommendation and reject the Foss offer and direct staff to recording all existing future connection
charges by the end of 2022. Motion carried unanimously.
COUNCIL COMMENTS
16. Connie Lyscio – Reminded everyone to watch out for busses and students walking home now that
school has resumed.
17. Zach Tabatt - Anticipates a future EDA meeting to discuss options to sell city owned property and to
be more active to spur new development.

19. Mark Cross – No Comment.
20. Darrel Olson – Explained the triathlons were very successful and thanked city staff that helped with
the events and reminded everyone of the special council meeting scheduled for September 8th.
CITY ADMINISTRATOR’S REPORT
City Administrator Chapulis explained the city has received notice from the USPS that they are closing the Baxter
Post Office. Staff will explore installing a secure mailbox at city hall. The council consensus was to move forward
with a secure mailbox to be installed at city hall.
CITY ATTORNEY'S REPORT
21. Closed Session – Labor Negotiations
MOTION by Council Member Tabatt, seconded by Council Member Lyscio to enter into a closed session
under Minnesota Statute 13D.03 to discuss labor negotiations at 7:13 p.m. Motion unanimously carried.
Mayor Olson resumed the regular meeting at 8:40 p.m.
City Administrator Chapulis explained the council provided staff direction during the closed session and that
no council action will be taken tonight.

MOTION Council Member Ward, seconded by Council Member Cross to adjourn at 8:41 p.m. Motion
unanimously carried.
