CITY COUNCIL MEETING MINUTES Tuesday, September 06, 2022 at 7:00 PM Baxter City Hall, 13190 Memorywood Drive, Baxter, MN “A Growing Community” CALL TO ORDER Mayor Olson called the meeting to order at 7:00 p.m. ROLL CALL Mayor Darrel Olson and Council Members Connie Lyscio, Zach Tabatt, John Ward and Mark Cross were present. City Administrator Brad Chapulis, Assistant City Administrator Kelly Steele, Community Development Director Josh Doty, Finance Director Jeremy Vacinek, Police Chief Jim Exsted, IT/GIS Director Todd DeBoer, Assistant Finance Director Brenda Brooks were present. PLEDGE OF ALLEGIANCE All joined Mayor Olson in reciting the Pledge of Allegiance. ADDITIONS OR CHANGES TO THE AGENDA None. PUBLIC COMMENTS - Comments received from the public may be placed on a future meeting agenda for consideration. None. CONSENT AGENDA - The following items are considered non-controversial by staff and are recommended to be read and passed in one motion. Any council person, staff, citizen, or meeting attendee can request one or more items be pulled from the Consent Agenda and the item will be pulled and addressed immediately after the passage of the Consent Agenda; otherwise, the following items will be passed in one motion: 1. Approve City Council Work Session Minutes from August 16, 2022 2. Approve City Council Minutes from August 16, 2022 3. Approve the Payment of Bills and Finance Report (Addendum A) 4. Adopt Ordinance 2022-012 and Summary Ordinance 2022-013 approving amendments to the Electrical Ordinance 5. Approve Pickleball Netting and Fencing at Loren Thompson Park in the amount of $7,394.98 6. Approve Amendments to the City Hunting Map for the 2022 Season 7. Accept the Parks and Trails Commission Meeting Minutes from August 22, 2022 8. Approve Easement Agreement for Lot 1, Block 1, Central Lakes Crossing Second Addition 10. Approve City Administrator to Renew Heartland Animal Rescue Team (HART) Contract 11. Approve Purchase of Fee Title Land, Drainage and Utility Easement, and Temporary Easement for 2022 Foley Road, Isle Drive, and Forthun Road Improvement Project for Parcel 40070660 12. Approve TH 210 Layout No. 1A Copy No. 1 from 0.26 Miles West of Timberwood Drive to Baxter Drive (SP 1805-81) 13. Authorize Abdo Financial Solutions to Issue an RFP for Integrated Local Government Software and Implementation Services 14. Approve Agreements between Minnesota State College and Universities, Central Lakes College, and the City of Baxter for Student Supervised Pre-Internship Training MOTION by Council Member Cross, seconded by Council Member Ward to approve the Consent Agenda. Motion carried unanimously. PULLED AGENDA ITEMS None. OTHER BUSINESS 15. Future Connection Charge Committee Recommendations City Administrator Chapulis summarized the council heard a request by Jeanne and John Foss on April 5th regarding the future connection charges applicable to 14285 Kimberlee Drive. The council formed a committee consisting of council members Cross and Lyscio to review the city’s future connection charge policy and to report back to the council with any recommendations. The committee completed its review and determined the policy still serves the same purpose today as it did when first adopted; there is no justification to warrant consideration of the Foss’s offer; and to avoid any future connection charge misunderstandings, the city will record all future connection charges with the county. While the future connection charge for 14285 Kimberlee Drive is not required to be paid at this time, if the Foss’s wish to pay of the balance in full, the 2022 payoff amount is $93,846.22. The city will incur approximately $3,800 in recording fees plus any legal fees to record the current 74 future connection charges. Staff is requesting the council to concur with the committee’s recommendation and reject the Foss offer and direct staff to record all existing future connection charges by year end. MOTION by Council Member Cross, seconded by Council Member Tabatt to concur with the committee’s recommendation and reject the Foss offer and direct staff to recording all existing future connection charges by the end of 2022. Motion carried unanimously. COUNCIL COMMENTS 16. Connie Lyscio – Reminded everyone to watch out for busses and students walking home now that school has resumed. 17. Zach Tabatt - Anticipates a future EDA meeting to discuss options to sell city owned property and to be more active to spur new development. 9/6/2022 City Council Meeting Minutes Page 3 18. John Ward - No comment. 19. Mark Cross – No Comment. 20. Darrel Olson – Explained the triathlons were very successful and thanked city staff that helped with the events and reminded everyone of the special council meeting scheduled for September 8th. CITY ADMINISTRATOR’S REPORT City Administrator Chapulis explained the city has received notice from the USPS that they are closing the Baxter Post Office. Staff will explore installing a secure mailbox at city hall. The council consensus was to move forward with a secure mailbox to be installed at city hall. CITY ATTORNEY'S REPORT 21. Closed Session – Labor Negotiations MOTION by Council Member Tabatt, seconded by Council Member Lyscio to enter into a closed session under Minnesota Statute 13D.03 to discuss labor negotiations at 7:13 p.m. Motion unanimously carried. Mayor Olson resumed the regular meeting at 8:40 p.m. City Administrator Chapulis explained the council provided staff direction during the closed session and that no council action will be taken tonight. ADJOURN MOTION Council Member Ward, seconded by Council Member Cross to adjourn at 8:41 p.m. Motion unanimously carried.
