CITY COUNCIL MEETING MINUTES Tuesday, February 06, 2024 at 7:00 PM Baxter City Hall, 13190 Memorywood Drive, Baxter, MN “A Growing Community” CALL TO ORDER Mayor Olson called the meeting to order at 7:06 p.m. ROLL CALL Mayor Darrel Olson and Council Members Connie Lyscio, Zach Tabatt, and Jeff Phillips were present. Council Member Mark Cross was absent. City Administrator Brad Chapulis, Assistant City Administrator Kelly Steele, Public Works Director Trevor Walter, Finance Director Jeremy Vacinek, Community Development Director Josh Doty, and Police Chief Jim Exsted were present. PLEDGE OF ALLEGIANCE All joined Mayor Olson in reciting the Pledge of Allegiance. PRESENTATIONS None. ADDITIONS OR CHANGES TO THE AGENDA None. PUBLIC COMMENTS - Comments received from the public may be placed on a future meeting agenda for consideration. Dave Lange, 13838 Cherrywood Drive, explained he is asking the council for the last time to add a neighborhood trail to White Sand Lake. There are a lot of people in the neighborhood that would like to Cross County Ski to the lake. At one time, the former property owner was willing to provide an access easement to the city for $10,000. CONSENT AGENDA - The following items are considered non-controversial by staff and are recommended to be read and passed in one motion. Any council person, staff, citizen, or meeting attendee can request one or more items be pulled from the Consent Agenda and the item will be pulled and addressed immediately after the passage of the Consent Agenda; otherwise, the following items will be passed in one motion: 1. Approve City Council Work Session Minutes from January 16, 2024 2. Approve City Council Minutes from January 16, 2024 3. Approve the Payment of Bills and Finance Report (Addendums A and A-1) 4. Accept the Parks and Trails Commission Minutes from January 22, 2024 2/6/2024 City Council Meeting Minutes Page 2 5. Approve the Pay Equity Report and Authorize Submittal of the Report to the Department of Minnesota Management and Budget 6. Approve the Campbell Development, LLC First Amendment to Limited Use Agreement (Pinehurst Apartments) 7. Adopt Resolution 2024-013 Receiving the Amended Feasibility Report for the 2024 South Forestview Area Improvements project, Municipal Project Number 4138 8. Adopt Resolution 2024-015, Awarding the Proposal for Depository and Banking Services and Authorizing Execution of Contracts 9. Approve the Sale of Decommissioned 2017 Squad MOTION by Council Member Tabatt, seconded by Council Member Phillips to approve the consent agenda. Motion carries unanimously. PULLED AGENDA ITEMS None. OTHER BUSINESS 10. Public Hearing - Wellhead Protection Plan Part II Mayor Olson opened the public hearing at 7:10 p.m. Widseth staff presented the Wellhead Protection Plan Part II. The development of the plan included a scoping meeting with the Minnesota Department of Health, updating contaminate source inventory, establishing wellhead protection plan goals, preparing plan of action, creating an evaluation program, and conducting the public hearing. No public comments were received. Mayor Olson closed the public hearing at 7:19 p.m. MOTION by Council Member Tabatt, seconded by Council Member Lyscio to submit the Wellhead Protection Plan Part II to the Minnesota Department of Health. Motion carried unanimously. COUNCIL COMMENTS 11. Connie Lyscio – No comment. 12. Zach Tabatt – Asked for council consensus to direct Community Development Director Doty to complete the gateway plan by year end, review the CIP for sewer and water expansion into neighborhoods, and review if the Long Range Planning Commission is needed. The council consensus was to support the requests. 13. Jeff Phillips – Asked for council consensus to review historical data of the lodging tax. The council consensus was to support the request. 14. CITY ADMINISTRATOR'S REPORT City Administrator Chapulis explained unless the council objects, the city will stop maintaining the skating rinks due to the warm temperatures. CITY ATTORNEY'S REPORT 16. Closed Session under Minnesota Statute 13D.05, subd. 3(b) Attorney-Client Privilege City Administrator Chapulis asked the council to enter into a closed session under Minnesota Statute 13D.05, subd. 3(b), attorney-client privilege, to discuss ongoing litigation pertaining to Crow Wing County PIDs 40170621 and 40080712. MOTION by Council Member Lyscio, seconded by Council Member Tabatt to enter into a closed session at 7:29 p.m. Motion carried unanimously. MOTION by Council Member Lyscio, seconded by Council Member Phillips to return to an open session at 7:58 p.m. Motion carried unanimously. The council provided the city attorney and city administrator with direction pertaining to the ongoing litigation and there is no action to be taken at this time. ADJOURN MOTION by Council Member Tabatt, seconded by Council Member Phillips to adjourn at 7:59 p.m. Motion carried unanimously.
