CITY COUNCIL MEETING MINUTES
Tuesday, April 16, 2024 at 7:00 PM

CALL TO ORDER
Mayor Olson called the meeting to order at 7:00 p.m.
ROLL CALL
Mayor Darrel Olson and Council Members Connie Lyscio, Zach Tabatt, Jeff Phillips, and Mark Cross were present.
City Administrator Brad Chapulis, Assistant City Administrator Kelly Steele, Assistant City Engineer Trevor
Thompson, Community Development Director Josh Doty, Finance Director Jeremy Vacinek, and Assistant Police
Chief Matt Maier were present.
PLEDGE OF ALLEGIANCE
All joined Mayor Olson in reciting the Pledge of Allegiance.
PRESENTATIONS
1. GFOA Certificate of Achievement for Excellence in Financial Reporting Presentation
Mayor Olson explained the City was granted the Certificate of Achievement award for its annual
comprehensive financial statements for the 12th consecutive year.
ADDITIONS OR CHANGES TO THE AGENDA
City Administrator Chapulis asked to add an item to the consent agenda to approve the conditional hire of
Andrew Buns as patrol officer.
PUBLIC COMMENTS - Comments received from the public may be placed on a future meeting agenda for
consideration.
CONSENT AGENDA - The following items are considered non-controversial by staff and are recommended to be read
and passed in one motion. Any council person, staff, citizen, or meeting attendee can request one or more items be
pulled from the Consent Agenda and the item will be pulled and addressed immediately after the passage of the
Consent Agenda; otherwise, the following items will be passed in one motion:

21. Adopt Ordinances 2024-008 and Resolution 2024-029 approving an ordinance text amendment to
amend the City’s Zoning Ordinance related to retail parking requirements and fences on retaining
wall
22. Accept the April 9, 2024 Planning Commission Meeting Minutes
23. Adopt Resolution 2024-037, Accepting Conveyance of Real Property Located within the City of Baxter
24. Approve Bolton & Menk Proposal for Engineering Services in the not to exceed amount of $4,976 for

MOTION by Council Member Cross, seconded by Council Member Lyscio to approve the consent agenda as
amended with the approval of the conditional hire of Andrew Buns as patrol officer. Motion carried
unanimously.
PULLED AGENDA ITEMS
Council Member Tabatt asked to pull consent agenda item 16 Adopt Resolution No. 2024-035 Ordering
Preparation of Report for the 2025 Mill & Overlay and Full Depth Reclamation Improvements Project, Municipal
Project No. 4425.
Council Member Tabatt inquired about the report including Joler Road, Fox Road, and Paris Road. Assistant City
Engineer Trevor Thompson explained these street segments were pulled from the 2023 improvement project to
be re-evaluated with the 2025 improvement project.
MOTION by Council Member Tabatt, seconded by Council Member Cross to Adopt Resolution No. 2024-035
Ordering Preparation of Report for the 2025 Mill & Overlay and Full Depth Reclamation Improvements Project,
Municipal Project No. 4425. Motion carried unanimously.
OTHER BUSINESS
26. Vacate all drainage and utility easements dedicated on Lot 1, Block 2, Forestview Drive Trail; Outlot
A, Eleventh Addition To Forestview On The River; and Outlot B, First Addition To Forestview Drive
Trail
1) PUBLIC HEARING at 7:00 p.m. or shortly thereafter
2) Adopt Resolution 2024-036 vacating all drainage and utility easements dedicated on Lot 1,
Block 2, Forestview Drive Trail; Outlot A, Eleventh Addition To Forestview On The River; and Outlot B,
First Addition To Forestview Drive Trail, according to the recorded plats thereof, Crow Wing County,
Minnesota
Community Development Director Doty explained the city is considering a preliminary and final plat
to be known as Fiberhood. The previous plats for the subject property included a standard drainage
and utility easement inset. Since the property is proposed to be re-platted with new easements
dedicated, the easements from the previous plat are no longer needed. The vacation is intended to
vacate the existing easements that are no longer needed.
Mayor Olson opened the public hearing at 7:14 p.m. and after hearing no public comments closed
the public hearing at 7:14:30 p.m.
MOTION by Council Member Cross, seconded by Council Member Lyscio to Adopt Resolution 2024-
036 vacating all drainage and utility easements dedicated on Lot 1, Block 2, Forestview Drive Trail;
Outlot A, Eleventh Addition To Forestview On The River; and Outlot B, First Addition To Forestview
Drive Trail, according to the recorded plats thereof, Crow Wing County, Minnesota. Motion carried
unanimously.
COUNCIL COMMENTS
27. Connie Lyscio – Was contacted by a parks and trails employee about people that are smoking at the
small city parking lot located along Grand Oaks Drive. Council Member Lyscio inquired if the city
could install a no smoking sign.

City Administrator Chapulis explained he will further discuss the item with Council Member Lyscio after the
meeting.
28. Zach Tabatt- No report.
29. Jeff Phillips – No report.
30. Mark Cross – Reminded motorists to watch out for motorcycles.
31. Darrel Olson – The Minnesota Mayor’s Association held its meeting in Baxter. Meeting attendees
toured Lindar and City Administrator Chapulis did a great job presenting information about traffic in
Baxter.
CITY ADMINISTRATOR'S REPORT
City Administrator Chapulis reminded the council of the annual League of Minnesota Cities conference, to be held
in June, and asked them to let him know by the end of the week if they plan to attend.
