May CITY COUNCIL SPECIAL MEETING MINUTES Thursday, April 25, 2024 at 5:15 PM Baxter City Hall, 13190 Memorywood Drive, Baxter, MN “A Growing Community” CALL TO ORDER Mayor Olson called the meeting to order at 6:17 p.m. ROLL CALL Mayor Darrel Olson and Council Members Connie Lyscio, Zach Tabatt, and Mark Cross were present. Council Member Jeff Phillips was absent. City Administrator Brad Chapulis, Assistant City Administrator Kelly Steele, and Public Works Director Trevor Walter were present. PRESENTATIONS 1. Supplemental Hearing on Improvements for the 2024 Mill & Overlay and Full Depth Reclamation Improvements Project Municipal Project No. 4424 Alex Bitter, with Widseth, presented the supplemental improvement hearing. On March 7, 2023 the council passed a resolution authorizing Widseth to prepare a feasibility report on the proposed improvement project. The amended report was approved by the council on January 16, 2024. The purpose of tonight’s supplemental improvement hearing is to review the recent amendment to the feasibility report. The report reviews existing conditions, proposes feasible improvements, estimates project costs, discusses project implementation, and present conclusions and recommendations for the project areas as required by the Minnesota Chapter 429 assessment process. There were two parcels that were included in the assessment calculations of the feasibility report but were not notified of the original improvement hearing and not clearly shown in the report, staff sought legal advice on how to proceed to include the two non-abutting commercial properties along Forthun Road in the assessment roll and the supplemental hearing was the recommended process. The three Costco outlot were assessed during the Elder Drive improvement project and Centra Care and Wings Financial were not assessed during the Elder Drive improvement project. Wings Financial and Central Care were not notified of the original improvement hearing for the 2024 mill and overlay and full depth reclamation improvement project. Mayor Olson asked the council for any questions. The council had no questions. OPEN PUBLIC HEARING Mayor Olson opened the public hearing at 5:32 p.m. Tom Schaenke, Wings Financial Credit Union, thanked Alex Bitter and the city attorney for providing him with information related to the project. Mr. Schaenke explained the purchase process of the property and that he was 4/25/2024 City Council Special Meeting Minutes Page 2 surprised to receive the assessment notice. Mr. Schaenke inquired if commercial properties are being assessed by the square footage and if the city will install directional signage during the detour. Mr. Schaenke explained he was happy to hear the outlets were assessed during the Elder Drive project and he would like confirmation they will not be assessed the next time Elder Drive is improved. CLOSE PUBLIC HEARING Mayor Olson closed the public hearing at 5:35 p.m. NEXT STEPS 2. Adopt Resolution No. 2024-039 Receiving 3rd Amended Feasibility Report for the 2024 Mill & Overlay and Full Depth Reclamation Improvements Project Municipal Project No. 4424 City Administrator Chapulis asked the council to adopt the resolution included in the packet. MOTION by Council Member Tabatt, seconded by Council Member Lyscio to Adopt Resolution No. 2024-039 Receiving 3rd Amended Feasibility Report for the 2024 Mill & Overlay and Full Depth Reclamation Improvements Project Municipal Project No. 4424. Motion carried unanimously. ADJOURN MOTION by Council Member Lyscio, seconded by Council Member Tabatt to adjourn at 5:37 p.m. Motion carried unanimously.
