PLANNING AND ZONING COMMISSION MEETING MINUTES Tuesday, September 09, 2025 at 6:00 PM Baxter City Hall, 13190 Memorywood Drive, Baxter, MN “A Growing Community” CALL TO ORDER The regular meeting of the Baxter Planning and Zoning Commission was called to order at 6:00 pm by Chair Hiltner. Approve Planning & Zoning Commission Meeting Minutes from August 12, 2025 COMMENTS MOTION by Commissioner Carleton, seconded by Commissioner Swanson to approve the Planning and Zoning Minutes from the August 12, 2025. Motion carried unanimously. Chair Hiltner stated that this Commission is a recommending body, and that final approval/denial of the applications on the agenda is taken up with the City Council on September 16, 2025. AND QUESTIONS None OLD BUSINESS None NEW BUSINESS 2. Consider amendments to the City Hunting Map Chair Hiltner asked for the staff report. Planner Gindele stated the City of Baxter is requesting amendments to the City’s Hunting Map. Specifically, the City of Baxter has hunting regulations and a Hunting Map that indicates where certain types of hunting is allowed and where hunting is not 9/9/2025 Planning and Zoning Commission Meeting Minutes Page 2 allowed. As land use changes occur within the City, the Hunting Map should be re-evaluated to see if changes need to be made to the map. Planner Gindele reviewed the three sites being requested for hunting with the Commission. Project Area One – PID 40310504 The City received a request to add the outlined property in the image shown to the Commission to add this area to the hunting map to be allowed for archery only hunting. The property owner has signed off on the request. The subject property is 12.37 acres in size and is zoned c-2, Regional Commercial. The subject property is vacant is comprised mainly of wetlands. Larger tracts of land are adjacent to the subject property which are either vacant or contain a single home. The one exception to this is the old Party World building adjacent to the subject property to the southeast. This tract is adjacent to the tract of land to the west which was added to the “Archery Hunting Only” zone in August. The request has been reviewed in conjunction with the police department. Staff recommends that this property be added to the “Archery Only” zone on the 2025 hunting map Project Area Two – 6617 Pine Beach Road The City received a request to add the outlined property in the image shown to the Commission to add this area to the hunting map to be allowed for archery only hunting. The property owner has signed off on the request. The subject property is 9.5 acres in size and has split zoning on it with Commercial/Industrial on the north half and Medium Density Residential on the south half. The subject property is vacant and is comprised mainly of wetlands with some upland on the north end. Larger tracts of land are adjacent to the subject property which are either vacant or contain a single home. The one exception to this is the mini storage building adjacent to the subject property to the west which is not staffed and has minimal traffic. This tract is adjacent to the tract of land to the east which was added to the “Archery Hunting Only” zone in August. The request has been reviewed in conjunction with the police department. Staff recommends that this property be added to the “Archery Only” zone on the 2025 hunting map. Project Area Three – 8216 Industrial Park Road The City received a request to add the outlined property in the image shown to the Commission to add to the hunting map to be allowed for archery only hunting. The property owner has signed off on the request. The subject property is 2.1 acres in size, however, only the northerly .67 acres is being requested for hunting. The subject property is located within the City’s primary industrial park and is zoned I, Industry Office. The property is developed with an active business and is adjacent to other properties developed with active businesses to the east, west, and south. The property to the north is owned by BNSF Railroad and is brownfield site meaning it has contaminated soils. There are no other larger tracts of land adjacent to this request that currently allow hunting. The request has been reviewed in conjunction with the police department. The police department has an agreement with BNSF to charge trespassers in this area. The Police department also has safety concerns being that this is in an active business area. Staff recommends that this property remain as “No Hunting” on the 2025 hunting map. 9/9/2025 Planning and Zoning Commission Meeting Minutes Page 3 Overall, staff recommends that Project Area 1 and 2 be added to the “Archery Only” hunting zone and Project Area 3 remain as “No Hunting” on the 2025 Hunting Map. Chair Hiltner asked if Project area 1 and 2 get developed in the future, does the hunting go away. Planner Gindele indicated there isn’t anything in code to make the hunting go away, but yearly the hunting map is reviewed and development is taken into consideration. Mr. Jason Kocer 14165 Cherrywood Dr-Baxter approached the podium. He stated that the person who requested the last parcel (Industrial Park) couldn’t be in attendance tonight. That person wanted a hunter’s perspective at tonight’s meeting. The reason for that location is because there is no hunting around that area and there needs to be due to the amount of deer in that area. Mr. Kocer stated this was done in his neighborhood where the lots are ¾ of an acre and houses are in a row that abuts a large track of land. Mr. Kocer indicated that Justin Barrick (the individual requesting this parcel be considered for hunting) is an acquaintance of the owner of the parcel that is being requested to be hunted on. He indicated that it does work successfully as he has seen the number of deer in his neighborhood go from 14 deer at a time to maybe one or two, and he is the only one that hunts on his street. He is asking that the Industrial piece be approved to lower the number of deer. If it is not allowed, Mr. Barrick would like a reason why it was not allowed. Chair Hiltner asked if the railroad property was fenced, Mr. Kocer was not sure. His understanding is the railroad requested any trespassers to be arrested and prosecuted, that was the reason why there wouldn’t be hunting in that location, however a hunter would be different. Per Mr. Kocer stated that a hunter is allowed by state law to go on to other person’s property to retrieve their deer. There wouldn’t be hunting on the railroad property just a potential retrieval of a deer. Planner Gindele believed the area is fenced. Mr. Kocer added that he has been urban hunting and people didn’t even know he was there, they were walking their dogs and kids getting off of buses 50’ feet away from him. Commissioner Swanson asked what the concerns were from the Chief. Mr. Kocer indicated in the email he was forward, the Chief was concerned about the homeless population, contaminated soils, the size of the area, and the trespassing. Additionally, staff has concern about the requested area being in an active business district. (these are the reasons for recommending that the parcel remain as no hunting). MOTION by Commissioner Carleton, seconded by Commissioner Kellerman approve Project 1 & 2 and Project 3 remaining “No Hunting” amendments to the City Hunting Map as presented by staff. Motion carried unanimously. 3. PUBLIC HEARING. Conditional Use Permits for a drive-through restaurant and joint access and Variance for the drive-through for development of a Chick-fil-A located at 7609 Excelsior Road (legally described as Lot 1, Block 1, Kohls Addition, Crow Wing County, Minnesota) (City file 2025- 012) Chair Hiltner asked for the staff report. CD Director Doty stated the applicant is requesting approval of the following items for the roughly 2-acre site located at 7609 Excelsior Road:  Conditional Use Permits to allow:  A restaurant drive through use  Amended joint access  Variance:  To allow a drive through lane between a building and a public street 9/9/2025 Planning and Zoning Commission Meeting Minutes Page 4 CD Director Doty the subject property is currently developed with the Bills Gun Club building and parking lot. The applicant is proposing to redevelop the site, which would include demo of the building to allow development of a Chick-fil-A restaurant and drive through. The applicant is proposing to construct the restaurant building and most of the drive through lanes within the footprint of the existing building. The applicant is proposing minimal changes to the existing parking lot. CD Director Doty reviewed the aerial showing the development area, the footprint of the building, the drive through location and how the drive through location would function and sidewalk locations. He reviewed the landscaping plan, trash enclosure screening, articulation and elevation of the building with the Commission. The Utility Commission reviewed the application on September 3, 2025 and recommended approval, subject to the following: 1) Enter into a Stormwater Facilities Maintenance Agreement prior to issuing a building permit. 2) Enter into an Escrow Agreement prior to issuing a building permit. The Utilities Commission did discuss another Chick-fil-A site and noted that the site was confusing to navigate and know which way you should go. The commission member encouraged ample signage to avoid circulation confusion for the site in Baxter. The applicant is requesting a conditional use permit to update the existing joint/cross-access between the subject property and the Kohl’s lot to the south and to the west. The zoning ordinance permits the setback for parking and drive aisles to be reduced to zero to allow joint driveway and parking across lot lines with approval of a conditional use permit, provided that: ● Driveways and parking areas are designed to accommodate a safe traffic pattern ● Design requirements are met. ● An access master plan is submitted ● A cross-access easement be submitted for approval by the city attorney and recorded. Staff notes that the attached plans for development serve as the master plan for joint access. Additionally, the joint access connection points on the shared property line are not changing. The CUP is to update easements as needed to reflect the new restraint use and new traffic pattern. Staff finds that the joint access meets the city’s design requirements for joint use and would include a safe traffic pattern. Staff has added a condition to the approving resolution that the applicant shall submit any required amendments to existing private joint access easements as required by the City Attorney. Said amended easement shall be reviewed and approved by the City Attorney and recorded with Crow Wing County. Regarding the Variance, the applicant is requesting a variance to allow a drive through lane between a building and a public street. The ordinance states that no portion of the drive through lane may be located between a the building and an a public street. The applicant is proposing a 40-car double drive through (20 cars per lane) on three sides of the restaurant. The drive through lanes are on the North, East and South sides of the building. The north frontage is the public street frontage of Excelsior Road, which requires the variance. Staff supports this variance request pursuant to the findings in this report. 9/9/2025 Planning and Zoning Commission Meeting Minutes Page 5 CD Director Doty stated restaurant uses require 1 parking stall for every 2.5 seats in the restaurant. The restaurant would have a total of 92 seats and would therefore, require 37 parking spaces. The applicant proposes to use the existing parking on site with minimal amendments. The site would have 105 parking stalls, providing a surplus of parking for the use. CD Director Doty stated that in the applicant’s narrative it spoke of joint use pylon signage, that is no joint pylon use signage as part of this request. He indicated that in the future the Commission may see an additional request for joint signage. He stated that the City sign ordinance only allows for one pylon per location and they would have to come back through to change signage. Staff recommends approval of the conditional use permits and variance, subject to the findings and conditions in the attached resolution. Commissioner Carleton asked for clarification on the site plan as to how customers leave the site. CD Director Doty reviewed the site plan showing two lanes that then merge. He then reviewed how the customers can get out of the site with the Commission. Commissioner Kellerman asked if the stacking was from the order point or the pick-up point. CD Director Doty stated the applicant can answer that question, as they have a different ordering system, with their employees being out and taking orders. Chair Hiltner asked if the northeast corner on Excelsior was an issue as it looked tight with the in/out in that spot. CD Director Doty stated staff didn’t have a concern as it is a right-in allowing free flow of traffic into the site. Chair Hiltner opened the public hearing. Mr. Joe Vavrina HR Green 1391 Corporate Dr. McHenry, IL 60050 approached the podium. He stated that staff did an awesome job with the staff report. He indicated regarding the drive through, there will be directional signage to assist customers. He then explained the “dual flex”, meaning the outside lane can be operated in a number of ways. It can be used for meal fulfillments, a bypass lane, or mobile through lane if you order on the app., you don’t have to park, he added that a lot of the time it is used as a by-pass lane. He discussed the peek hours at lunch and dinner you may see the dual lane open to do meal fulfillment to keep people moving, thus the 40 car stacking so there is no stacking out into the parking area. He added that during peek hours team members will be out there taking orders with iPad and delivering some orders. There is also a pick-up door so team members can come in and out with orders. He stated that this system came about due to Covid when people were only using drive throughs. Commissioner Swanson asked if there were any other restaurants that operate this way. Mr. Vavrina indicated there is a restaurant based mainly out of Chicago called Portillo’s that operates that way also. He noted that Chick-fil-A took it a step further and placed canopies over the order point and pick-up point with heaters in the winter and fans in the summer so teem members are protected from the elements. They really try to protect their team members. Chair Hiltner stated that they must have coordination with Kohl’s, Mr. Vavrina indicated that CD Director Doty had indicated that there are easements in place and Kohl’s has been part of all of the discussions. Chair Hiltner asked about semi-deliveries, Mr. Vavrina indicated the deliveries are at the back of the building and don’t circulate through the site. The trucks will come through the shared access site to the east side during off peek hours, 10:00 pm to 5:00 am. 9/9/2025 Planning and Zoning Commission Meeting Minutes Page 6 Commissioner Swanson asked about the seating compacity, per the plan it showed 92 people plus 12 outdoor seats. CD Director Doty asked for clarification on the drive lane and how they function. Mr. Vavrina indicated there will be delineators to guide customers to which lane(s) are open and staff will also be available to assist. Commissioner Hiltner noted there was a flagpole, he asked if one was going to be installed, Mr. Vavrina replied that every store has one if the flag is allowed. Chair Hiltner closed the public hearing MOTION by Commissioner Oswald, seconded by Commissioner Swanson to approve the Conditional Use Permit for a drive-through restaurant and joint access and Variances for the drive-through and trash enclosure for property located at 7609 Excelsior Road, as presented in the draft resolution. Motion carried unanimously. 4. PUBLIC HEARING. Interim Use Permit Amendment of Resolution 2020-160 to allow a one-year extension if the approval that allowed a lumber yard use with multiple accessory structures without a principal structure (legally described as Lot 2, Block 1, Potlatch Addition to Baxter, Crow Wing County, Minnesota) (City file 2025-027) Chair Hiltner asked for the staff report. CD Director Doty stated the applicant is requesting approval of an interim use permit amendment to allow revision of Resolution 2020-060 to allow a one-year extension to allow for temporary approval of an expanded lumber yard use with multiple accessory structures without a principal structure for Simonson Lumber for property located at 3915 Independence Road. The interim use permit amendment would extend the interim use permit expiration date from October 20, 2025, to October 20, 2026. All other conditions in Resolution 2020- 060 remain valid. Per the applicant’s narrative, the request for a one-year extension is based on market reasons. The planning commission staff report from 2020 and resolution 2020-060 were in the packet for the Planning Commission’s review. CD Director Doty gave the background history that was in the packet and reviewed the aerial with the Commission. Staff recommends approval of the interim use permit amendment, subject to the findings and conditions in the attached resolution. Chair Hiltner opened the public hearing. Mr. Richard Hobbs 646 Riverside Ave. Sartell approached the podium. He stated he is the former owner of Simonson Lumber. He was very grateful for the generosity the City has given them regarding this request. He explained a few things came up including a death in the family that caused them to sell the business to Kodiak Building Partners and disclosed to the new owners the requirement of the 12,000 square foot building. Mr. Hobbs stated that there are plans available and ready to build, however the plans have been put on hold not knowing what the tariffs would do to 9/9/2025 Planning and Zoning Commission Meeting Minutes Page 7 the industry. The request for the one year extension is so the 12,000 sq. ft. building could be built verses a smaller building should the extension not be approved. He indicated that they are also talking to Close Converse about potentially buying the building they are currently leasing, however it doesn’t sound like that will happen. He asked if there were any questions. Chair Hiltner asked where the building would go on the site. Mr. Hobbs indicated that they have intentionally left a pad for the building on the site. The aerial showed the location. Chair Hiltner closed the public hearing MOTION by Commissioner Swanson, seconded by Commissioner Carleton to approve Interim Use Permit Amendment of Resolution 2020-160 to allow a one-year extension if the approval that allowed a lumber yard use with multiple accessory structures without a principal structure as presented in the draft resolution. Motion carried unanimously. 5. PUBLIC HEARING. Preliminary and Final Plat of “Bitterroot Second Addition” for vacant property located on the east side of Kimberlee Drive (City file 2025-025) Chair Hiltner asked for the staff report. Planner Gindele stated the applicant is requesting approval of a preliminary and final plat to be known as “Bitterroot Second Addition” to create five new buildable lots and one outlot for the 16.9-acre parcel. Specifically, the proposed plat would replat an existing outlot to create five new lots along an existing road that already has city water and sewer services stubbed in for the five proposed lots. The remaining outlot is intended for future development of residential lots. The plat also dedicates right-of-way for a future road extension of Lynndale Drive and Dakar Road. The subject property currently has five water/sewer services stubbed out from Kimberlee Drive for the creation of five new residential lots. No mass tree clearing or mass grading is proposed with this plat. Clearing and grading for the development will occur on a lot-by-lot basis at the time of building permit review/issuance for homes to be constructed. Planner Gindele reviewed the aerial and pointed out a small portion of the preliminary plat being in the Shoreland Overlay District. The subject property is approximately 16.9 acres in size and has minimal topography that rises two feet as you travel from the northwest corner to the southeast corner of the property. A small area of the southwest corner of the subject property is located within the shoreland overlay district for White Sand Lake. The subject property does not contain any wetlands or FEMA floodplain. The site is heavily wooded with a mix of mature coniferous and deciduous trees. Staff has reviewed the application for consistency with City Code requirements, as well as City policies. The City’s discretion in approving or denying a preliminary and final plat is limited to whether the proposed plat meets the standards outlined in the City Code. If it meets these standards, the city must approve the plat. Planner Gindele reviewed the blocks, lots, streets, easements & conveyances, drainage and park dedication with the Commission, that were in the packet. 9/9/2025 Planning and Zoning Commission Meeting Minutes Page 8 The Utility Commission reviewed the preliminary and final plat of “Bitterroot Second Addition” at its regular meeting on September 3, 2025 and recommends approval of the plat application. Staff recommends approval of the preliminary and final plat of “Bitterroot Second Addition”, subject to the findings and conditions in the attached draft resolution. There was a revision just before the meeting and that revision was in the power point and on the Commission’s table. Char Hiltner asked if the short stub of Lynndale Dr. was existing, it was. Planner Gindele indicated that there was no right-of-way previously, this plat is platting the right-of-way for that stub. Chair Hiltner asked if the utilities were stubbed in, Planner Gindele indicated they are stubbed to the end of the pavement on Lynndale Dr. Chair Hiltner opened the public hearing. Mr. Branden Callenius 6251 Dakar Rd Baxter, approached the podium. He asked when Dakar Rd. is extended will he lose 40 ft. of his property and how will the assessments work. CD Director Doty stated that the original owner who built the home was made aware that Dakar Road had been officially mapped across the north 40 feet of his property and of the intention of Dakar Rd. being extended in the future, and that the house was placed to make sure the 40’ setback was met when the road goes through. He added that at this point there is no intension to extend Dakar Rd. Mr. Callenius asked if Dakar Rd. is going to meet Rockrose at a T-point. CD Director Doty stated the intent was to extend Dakar Rd. all the way to Kimberlee Dr. with future development. Chair Hiltner asked if there was an existing easement across Mr. Callenius property, CD Director Doty indicated it was officially mapped that way. Mr. Callenius asked if he bought Outlot A would that stop Dakar Rd. from going through. CD Director Doty indicated potentially, if there was no development proposed and the land was purchased by a person not interested in developing the land, but he couldn’t rule out the possibility that the road could be extended without development occurring. CD Director Doty stated that the Council approved that east west Dakar Road mapping prior to the house being built for additional development. At this time the plat is only dedicating the north 40 feet, and that is not enough right-of-way for a road to go through as the ROW needs to be 80 feet wide. He stated that after the five lots are built, if another developer wants to extend past those lots then there will need to be street connections built. He explained that each developer that comes in is set-up so the next developer coming in can connect into the system. Commissioner Carleton asked if it was 66 ft. or 80 ft. needed for a road. CD Director Doty stated that 80 ft. is preferred, however 66 ft. is what is in this neighborhood. He stated that 80 ft. is what you see on Clearwater Rd. with a detached trail separate from the street. Mr. Chad Connor-Widseth approached the podium, he is here representing the applicant. He stated staff has been great to work with regarding the issues of item such as road right-of-ways. Chair Hiltner closed the public hearing MOTION by Commissioner Swanson, seconded by Commissioner Kellerman to approve the Preliminary and Final Plat of “Bitterroot Second Addition” for vacant property located on the east side of Kimberlee Drive as presented in the draft resolution. Motion carried unanimously. 6. PUBLIC HEARING. Conditional Use Permit Amendment to allow a parking lot expansion for a church located on the east side of Kimberlee Drive (City file 2025-026) 9/9/2025 Planning and Zoning Commission Meeting Minutes Page 9 Chair Hiltner asked for the staff report. Planner Gindele stated the applicant is requesting approval of a conditional use permit amendment to allow for the expansion of an existing parking lot for Lakewood Church located at 6284 Fairview Road. Planner Gindele reviewed the aerial and site plan with the Commission. The Utility Commission reviewed the application on September 3, 2025 and recommends that the Planning and Zoning Commission approve the Lakewood Evangelical Free Church Conditional Use Permit Amendment with the Condition of entering into a Stormwater Facilities Maintenance Agreement prior to grading permit issuance for the parking lot expansion. The subject property is zoned R-1, Low Density Residential in which “Religious Institutions” are identified as a conditional use. The existing church was issued a conditional use permit (CUP) in the past for the existing church use. The proposed expansion of the parking lot is considered an expansion of the church use, and therefor requires an amendment to the existing CUP. Planner Gindele reviewed traffic hazards (none), site plan context, landscaping/parking lot islands and parking lot design that were in the packet with the Commission. Staff recommends approval of the conditional use permit amendment to allow for the expansion of the church parking lot for property located at 6284 Fairview Road, subject to the findings and conditions in Resolution 2025- 074. Chair Hiltner asked with the additional paving is the storm water ponding adequate, Planner Gindele indicated that engineering has reviewed the application and the ponding is sufficient. Chair Hiltner opened the public hearing. Mr. Chris Korwes 6284 Fairview Rd. approached the podium. He did not have any questions and stated that staff was great to work through this process with. Chair Hiltner asked if there were any questions regarding the conditions, there were none. Chair Hiltner asked about the north parking lot beyond the paving going to remain parking, Planner Gindele indicated that it will remain a legally non-conforming surface. Commissioner Swanson asked when was the last time it was paving, Mr. Korwes believed it was 25 years ago. Chair Hiltner closed the public hearing MOTION by Commissioner Kellerman, seconded by Commissioner Swanson to approve the Conditional Use Permit Amendment to allow a parking lot expansion for a church use for property located north of 6284 Fairview Road as presented in the draft resolution. Motion carried unanimously. 7. Review of HRA Redevelopment Plan Amendment to determine if the plan amendment is consistent with the City’s Comprehensive Plan Chair Hiltner asked for the staff report. CD Director Doty indicated the Crow Wing County HRA, Housing and Redevelopment Authority is requesting that the Planning Commission review if the HRA Redevelopment Amendment is consistent with the City’s Comprehensive Plan. Specifically, under 9/9/2025 Planning and Zoning Commission Meeting Minutes Page 10 State Law, Crow Wing County is required to sell tax forfeited lots at estimated market value and that any special assessments are paid. To date, the lots in question have not been acquired due to these combined costs. The attached HRA Plan Amendment would allow the County HRA to acquire lots and sell them to a developer to allow development of the properties. CD Director Doty explained that the HRA and the city are pairing together to get tax forfeited lots, that have assessments on them back into the tax rolls by creating some affordable housing. Should the City choose to do this it is required by state law that the Planning Commission find the request to confirm it is consistent with the Comprehensive Plan. CD Director Doty indicated that there are four lots and one outlot that would be sold to a developer with the assistance of tax increment financing (TIF) as a tool to forgive the assessments and making the lots more affordable. The question is the development of affordable homes consistent with the Comprehensive Plan. Looking at the Comprehensive Plan there is a whole section on housing within the plan. CD Director Doty reviewed the locations of each parcel with the Commission and asked if there were any questions about each parcel. He explained the four lots that are single family lots were not used for affordable housing that the assessments would be placed back on the lot and sold like a regular sale with the assessments having to be paid. The fifth lot is a larger lot for medium density, and a developer is looking at this for future development. Staff recommends approval of the HRA Redevelopment Plan Amendment, subject to the findings and conditions in the attached resolution. Chair Hiltner asked how affordable housing is defined. City Administrator Chapulis approached and stated a collaboration between Crow Wing County HRA and the City of Baxter to reduce the number of tax forfeited lots from back in the recession when people let the lots go. These lots have been in that state for an extended period of time. He explained what the County HRA has been able to do the assistance of the Crow Wing County Board of Commissioners they have been able to take those lots and make them available for residential development, with the HRA wanting them to be affordable housing. Each one of those parcels has an assessment. The Cities roll in this is the use of TIF which there is a pool of this funding to put towards affordable housing. He stated it is not new as this has been done with Habitat For Humanity with multiple tax forfeited lots. It is now getting out to the to the open market. City Administrator Chapulis stated how affordable housing is outlined for ownership to be at 100 percent of area median income for households of 1 or 2 persons and 115 percent for area median income for households of 3 or more persons. Commissioner Swanson asked what is the area median income in Baxter. City Administrator Chapulis indicated area median income for 1-2 is $116,000.00 and 3 or more is $134,000. Chair Hiltner asked if the assessments were from city water and sewer project. City Administrator Chapulis replied city water and sewer and street projects. Commissioner Swanson asked if all of the lots are being treated the same, City Administrator Chapulis the larger lot is not being proposed for an affordable project, therefore the City is not a participant. Commissioner Carleton asked if Habitat For Humanity is still building in Baxter. City Administrator Chapulis indicated that yes, they are, there was an agreement for 5 houses and to date 3 have been built a couple down in the Ironwood Meadows area. 9/9/2025 Planning and Zoning Commission Meeting Minutes Page 11 Chair Hiltner asked for a quick run down of TIF, he asked if the TIF goes back on the homeowner. City Administrator Chapulis indicated that it does not go back to the homeowner it goes back to the developer so the entry level is reduced by the amount of the assessments. The agreement is written that way in case the developer doesn’t sell the home to a qualified home buyer then the developer has to pay the City back the assessment. City Administrator Chapulis explained how TIF works and the multiple uses including multiple family for profit and non-profit. CD Director Doty stated when putting together the packet there is a resolution in the packet, after talking to legal counsel it was determined that a finding and motion was needed and not the resolution. The resolution is not being forwarded to the Council; there are other items that will go to Council. He stated a motion would be prudent stating that the HRA Redevelopment Plan Amendment is consistent with the Comprehensive Plan. MOTION by Commissioner Carleton, seconded by Commissioner Swanson to approve the Review of HRA Redevelopment Plan Amendment is consistent with the City’s Comprehensive Plan, as presented.
