Regular Meeting March 2, 2015 Page 1 REGULAR MEETING OF THE BAYONNE MUNICIPAL UTILITIES AUTHORITY, OF THE CITY OF BAYONNE, IN THE COUNTY OF HUDSON, NEW JERSEY HELD IN THE DOROTHY E. HARRINGTON MUNICIPAL COUNCIL CHAMBERS, MUNICIPAL BUILDING, 630 AVENUE C, ON MONDAY, MARCH 2, 2015 THE BAYONNE MUNICIPAL UTILITIES AUTHORITY met at 6:58 p.m. John Budnik Secretary for the BMUA read the opening statement: “The notice requirements provided for in the “Open Public Meetings Act” have been satisfied. Notice of this meeting has been filed with the Clerk of the City of Bayonne and posted on the Bulletin Board in City Hall, as well as being transmitted to the Jersey Journal and Newark Star Ledger for this Regular Meeting of March 2, 2015.” Commissioner Budnik led the Pledge of Allegiance to the Flag. John Budnik, Secretary for the BMUA called the roll. Present were: Commissioners Augusto, Budnik, Colbath, Lynch, Flores & Furmaniak Not Present: Chairman Metro Also present were: Tim Boyle, Executive Director for the Bayonne M.U.A.; Donna M. Russo, Esq., Acting General Counsel for the Bayonne M.U.A.; John Rolak, General Engineer for the Bayonne M.U.A.; Robert Doria, Accountant/Auditor for the Bayonne M.U.A.; Karen Makowski, Financial Specialist for the Bayonne M.U.A. ……………………………………………………………………………………………… Director’s Report: SEE ATTACHED BMUA Director Tim Boyle spoke about the following: 1. United Water 2. Water/Sewer Line Breaks 3. CSO Disinfection Demonstration Project 4. Aqueduct Leak 5. Regulator 18, Collapsing Brick Sewer ……………………………………………………………………………………………… NOTE: Although Commissioner Furmaniak voted, his vote was not required for a quorum. R1 - RESOLUTION OF THE BAYONNE MUNICIPAL UTILITIES AUTHORITY (Approving minutes of prior meeting.) The above resolution was read by Commissioner Budnik, moved by Commissioner Augusto and seconded by Commissioner Colbath and adopted by all. Yeas – Commissioners Augusto, Budnik, Colbath, Lynch, Flores & Furmaniak Nays – None Absent – Chairman Metro R2 - RESOLUTION OF THE BAYONNE MUNICIPAL UTILITIES AUTHORITY (Resolution authorizing the payment of bills.) The above resolution was read by Commissioner Budnik, moved by Commissioner Augusto and seconded by Commissioner Colbath and adopted by all. Yeas – Commissioners Augusto, Budnik, Colbath, Lynch, Flores & Furmaniak Nays – None Absent – Chairman Metro R3- RESOLUTION OF THE BAYONNE MUNICIPAL UTILITIES AUTHORITY (Resolution ratifying and confirming the BMUA’s participation in the CSO Public Notification System in conjunction with to the Passaic Valley Sewerage Commission PVSC). The above resolution was read by Commissioner Budnik, moved by Commissioner Augusto seconded by Commissioner Budnik and adopted by all. Yeas – Commissioners Augusto, Budnik, Colbath, Lynch, Flores & Furmaniak Nays – None Absent – Chairman Metro R4- RESOLUTION OF THE BAYONNE MUNICIPAL UTILITIES AUTHORITY (Resolution authorizing payment to the City of Bayonne for emergency Repairs done by its contractor with respect to a drainage problem on Lower Hook Road). The above resolution was read by Commissioner Budnik, moved by Commissioner Colbath and seconded by Commissioner Lynch and adopted by all. Yeas – Commissioners Augusto, Budnik, Colbath, Lynch, Flores & Furmaniak Nays – None Absent – Chairman Metro R5- RESOLUTION OF THE BAYONNE MUNICIPAL UTILITIES AUTHORITY (Resolution authorizing Interagency Services Agreement by and between the Passaic Valley Sewerage Commission and the Bayonne Municipal Utility Authority, relative to the provision of services related to green infrastructure Planning). The above resolution was read by Commissioner Budnik, moved by Commissioner Colbath and seconded by Commissioner Budnik and adopted by all. Yeas – Commissioners Augusto, Budnik, Colbath, Lynch, Flores & Furmaniak Nays – None Absent –Chairman Metro R6- RESOLUTION OF THE BAYONNE MUNICIPAL UTILITIES AUTHORITY (Providing for a Meeting Not Open to the Public in Accordance with The New Jersey Open Public Meetings Act, N.J.S.A. 10:4-12) (Followed by a Return to Open Session). The above resolution was read by Commissioner Budnik, moved by Commissioner Colbath seconded by Commissioner Budnik and adopted by all at 7:05 p.m. Yeas – Commissioners Augusto, Budnik, Colbath, Lynch, Flores & Furmaniak Nays – None Absent – Chairman Metro The Meeting was reconvened at 7:21 p.m. from closed session, a motion was made by Commissioner Budnik moved by Commissioner Colbath and seconded by Commissioner Augusto and adopted by all. Yeas – Commissioners Augusto, Budnik, Colbath, Lynch, Flores & Furmaniak Nays – None Absent – Chairman Metro R7- RESOLUTION OF THE BAYONNE MUNICIPAL UTILITIES AUTHORITY (Resolution authorizing a settlement of ongoing Litigation). The above resolution was read by Commissioner Budnik, moved by Commissioner Colbath and seconded by Commissioner Budnik and adopted by all. Yeas – Commissioners Augusto, Budnik, Colbath, Lynch, Flores & Furmaniak Nays – None Absent –Chairman Metro R8- RESOLUTION OF THE BAYONNE MUNICIPAL UTILITIES AUTHORITY (Resolution authorizing a Shared Services Agreement with the City of Bayonne ("City") in order for the Authority to utilize the services of BATHGATE, WEGENER & WOLF, P.C. and MERLIN LAW GROUP, P.A. to pursue the Authority’s claims for property damage and other covered claims to its insurance carrier(s) and to the Federal Emergency Management Agency (“FEMA”) arising out of and due to the effects of SuperStorm Sandy, through an Agreement between the City of Bayonne and BATHGATE, WEGENER & WOLF, P.C. and MERLIN LAW GROUP, P.A. dated September 20, 2013 and amended February 10, 2015). The above resolution was read by Commissioner Budnik, moved by Commissioner Colbath and seconded by Commissioner Budnik and adopted by all. Yeas – Commissioners Augusto, Budnik, Colbath, Lynch, Flores & Furmaniak Nays – None Absent –Chairman Metro A motion was made by Commissioner Budnik to adjourn the meeting it was moved by Commissioner Augusto and seconded by Commissioner Colbath and adopted by all.
