HEARING NOTICE INCORPORATED VILLAGE OF BAYVILLE ZONING BOARD OF APPEALS PLEASE TAKE NOTICE that the Zoning Board of Appeals of the Incorporated Village of Bayville will hold a Public Hearing at the Village Hall, 34 School Street, Bayville, Nassau County, New York, on Wednesday, June 27, 2018 at 7:30 p.m. to consider the following application: #Z-9-18, DeNatale Residence, (James Carballal, Arch) : Application to construct a second story addition, deck and storage building requiring the following variances: Sec 80-82 Any alteration to a nonconforming use, building or structure that would change the building's or structure's front setback, side yard or rear yard, shall not be permitted hereunder unless an application for variance is made to the Board of Appeals and such application is granted by the Board of Appeals. In any such application, the applicant shall demonstrate to the satisfaction of the Board of Appeals that the cost of all alterations proposed to be made to such building or structure, in the aggregate, will not exceed 50% of the adjusted market value of the affected parcel, as reflected in the then-current assessment role for the Village. Nothing herein is intended or shall be deemed to preclude the maintenance and good repair of any nonconforming use or building. Sec 80-26 Lot Requirements No building or structure shall be erected on any lot within the Residence D District that has less than: (1) One hundred feet of street frontage. (2) One hundred feet of lot width at any point from the front property line to a depth of 40 feet from the front property line. (3) Fifteen thousand sq. feet of lot area. The existing lot street frontage is 72 ft. and the existing lot area is 11,628 sq. feet. Sec 80-27 Yard Requirements A. There shall be front, rear and side yards on each plot of not less than the following depth or width or depth: (1) Front yard: 40 feet. The existing front yard setback is 24’8”. The proposed front yard setback is 43’1”. Sec 80-30 Detached Garages, accessory buildings and structures A. Accessory building shall be located at least 5 ft. from the primary building on the lot. The proposed storage building is located less than 5 ft. from the primary building. This property is known on the Land and Tax Maps of Nassau County as Section 29, Block 62, Lots 80, 142 in the Residential D District. BY ORDER OF THE ZONING BOARD OF APPEALS Georgia Giaccone, Clerk June 8, 2018 0HEARING NOTICE INCORPORATED VILLAGE OF BAYVILLE ZONING BOARD OF APPEALS PLEASE TAKE NOTICE that the Zoning Board of Appeals of the Incorporated Village of Bayville will hold a Public Hearing at the Village Hall, 34 School Street, Bayville, Nassau County, New York, on Wednesday, June 27, 2018 at 7:30 p.m. to consider the following application: #Z-10-18, Archambault Residence : Application to maintain a completed addition, requiring the following variances: Sec 80-20 Lot Requirements (A) No building or structure shall be erected on any lot within the Residence D District that has less than: 1. Seventy five feet of street frontage; the existing frontage is 14 feet. 2. Seventy five feet of lot width at any point from the front property line to a depth of forty feet; the lot width at forty feet is 14 feet. Sec 80-21 Yard Requirements (A) Lot Requirements: There shall be front, rear and side yard on each plot of not less than the following depth or width: (2) Rear Yard: minimum setback required is 25 feet; existing rear yard setback is 17.7 feet. (3) Side Yard: minimum setback is eight feet provided the sum of two side yards shall not be less than twenty feet. The left side yard is 11.5 feet; the right side yard is 3.9 feet; the sum total is 15.2 feet. (B) Lot Coverage: The building area shall not exceed 25% of the first 7,500 square feet of lot coverage, and 12.5% of that portion of the lot area, if any, in excess of 7,500 square feet. The property is 9,000 square feet; with 2,062.5 square feet permitted. The current lot coverage with Building Permit #7408 is 2,109 square feet. Sec 80-60 Supplementary Area and Height Provisions (D) Permitted projections or encroachments. Setbacks of buildings and sizes of yards, wherever required in this chapter and except as otherwise specifically provided herein, shall be the distance from the lot line to the nearest exterior finished all of the building, which shall include the foundation wall of any attached garage, open or enclosed porch, and all other projections, except that the following shall be permitted, notwithstanding their encroachment into a minimum required setback: (5) to the extent that any building or structure lawfully encroaches into a required minimum yard due to either the grant of a variance with respect thereto granted by the Board of Appeals, or as a preexisting, nonconforming building or structure, none of the foregoing encroachments shall be permitted in such diminished yard unless a variance is granted therefor by the Board of Appeals. Sec 80-77 Size and Location (A) All swimming pools shall be so located as to confirm to one of the following applicable requirements: Zone C: Side Yard Minimum Distance: 6 feet; Rear Yard Minimum Distance: 6 feet. All above dimensions are minimum distances from property lines to the pool. The existing swimming pool rear yard distance is zero feet and the side yard distance is 5.63 feet. Sec 80-82 Alterations Any alteration to a nonconforming use, building or structure that would change the building's or structure's front setback, side yard or rear yard, shall not be permitted hereunder unless an application for variance is made to the Board of Appeals and such application is granted by the Board of Appeals.
