MINUTES BOARD OF TOWN COMMISSIONERS December 20, 2021 The regular meeting of the Board of Town Commissioners was called to order on Monday, December 20, 2021 at 7:30 p.m. at Town Hall, 39 Hickory Avenue, Bel Air, Maryland. MEMBERS PRESENT: Kevin M. Bianca, Chair Mary F. Chance Paula S. Etting Erin S. Hughes Donna L. Kahoe STAFF PRESENT: L. Jesse Bane, Town Administrator Trish Heidenreich, Director of Economic Development Charles Dawson, Department of Public Works Michael Krantz, Director of Administration Charles Moore, Chief of Police Kevin Small, Director of Planning Joan Suitt, Recording Secretary ABSENT: Stephen Kline, Director of Public Works Lisa Moody, Director of Finance Patti Parker, Community & Public Relations Manager Charles Keenan, Town Counsel APPROVAL OF AGENDA: Commissioner Kahoe moved and Commissioner Chance seconded the motion to approve the Agenda as written. Ayes: Commissioners Chance, Etting, Hughes, Kahoe and Bianca Nays: None The motion carried. APPROVAL OF MINUTES: Commissioner Kahoe moved and Commissioner Chance seconded the motion that the minutes of the Bel Air Board of Town Commissioners’ meetings held on December 6, 2021 and December 14, 2021, be approved as submitted. Ayes: Commissioners Chance, Etting, Hughes, Kahoe and Bianca Nays: None The motion carried. PRESENTATION: Disc Golf Course – Greg Adolph Greg Adolph advised there is a Disc Golf Course at Rockfield Manor that has been a great addition to the Town of Bel Air. Mr. Adolph extended appreciation to the Town of Bel Air, the Greater Bel Air Community Foundation and Mr. Small for their support. Mr. Adolph displayed the course layout at Rockfield and informed of the disc golf club JarnDG that participates in tournaments. JarnDG would like to host a Bel Air tournament in 2022. 2021.12.20.MIN.BOTC.TH Page 1 of 4 Chair Bianca acknowledged Greg Adolph for his work in bringing this sport to the Town. Certificate of Appreciation - Mark G. Zulauf Officer Mark Zulauf started his service with the Bel Air Police Department in October, 2000 and began a 21 year commitment to excellence in Police Service, culminating as a PCO, a Police Officer, Officer First Class, and on July 1, 2021 as a Senior Officer. Officer Zulauf's commitment, service and dedication to the Bel Air Police Department and the Town of Bel Air community was acknowledged. On behalf of the citizens of the Town of Bel Air, the Bel Air Police Department, and the Bel Air Board of Commissioners, Chair Bianca presented Officer Mark G. Zulauf with a Certificate of Appreciation. Chief Moore advised Officer Zulauf has had a very distinguished career that includes leadership, integrity and loyalty. Chief Moore stated Officer Zulauf served the citizens of Bel Air and officers relied on his expertise. Chief Moore congratulated Mark Zulauf and stated we will miss you and wish you the best. Acting Deputy Chief Marchesani stated we worked together for 20 years and appreciates Officer Zulauf for his dedication. Acting Deputy Chief Marchesani presented Mark Zulauf with his retired ID and Badge. Chief Moore invited guests to a reception at the Police Department. NEW BUSINESS: Resolution No. 1176-21 - Extending Temporary Tents and Temporary Uses Due to COVID-19 Commissioner Hughes moved and Commissioner Kahoe seconded the motion that Resolution No. 1176-21, extending the use of temporary tents and temporary uses, due to COVID-19, in the Town of Bel Air, through December 31, 2022, be approved by the Bel Air Board of Town Commissioners. Chair Bianca inquired if establishments will be informed of the change. Mr. Small, Director of Planning, stated information will be extended to establishments and those who attended the Town meetings to inform them how the Temporary Use process is utilized. Commissioner Hughes asked for the types of complaints that could cause revocation of the entertainment permit. Mr. Small notified if an establishment has an event that provides music or recreation and causes disturbance to neighbors, it would be a factor the Town would consider for reissuing the next month. Mr. Small informed if a complaint is received and the establishment does not correct the issue, it also affects the issuance. Ayes: Commissioners Chance, Etting, Hughes, Kahoe and Bianca Nays: None The motion carried. 2021.12.20.MIN.BOTC.TH Page 2 of 4 Resolution No. 1177-21 Opioid Lawsuit Settlement Authorization Commissioner Chance moved and Commissioner Kahoe seconded the motion that Resolution No. 1177-21, authorizing the Town Administrator of the Town of Bel Air, special counsel, and staff, to execute and deliver the opioid lawsuit settlement, recommended for approval by special counsel, be approved by the Bel Air Board of Town Commissioners. Chair Bianca inquired if there is an expected time when funds may be received. The Director of Administration notified there is no date and the settlement is across the entire nation. Ayes: Commissioners Chance, Etting, Hughes, Kahoe and Bianca Nays: None The motion carried. English Country Manor Pump Station Emergency Generator Purchase Commissioner Kahoe moved and Commissioner Chance seconded the motion that the proposal to remove and replace the Emergency Generator and Automatic Transfer Switch for the English Country Manor Sanitary Sewer Pump Station by P.D. Valle Electric Company, Inc, 34 Idlewild Street, Unit 3, Bel Air, Maryland 21014, for the price of $68,342.00 be accepted by the Bel Air Board of Town Commissioners. Ayes: Commissioners Chance, Etting, Hughes, Kahoe and Bianca Nays: None The motion carried. Quality Assurance Contract Commissioner Etting moved and Commissioner Kahoe seconded the motion that the Amendment to the Profession Service Agreement between Crabtree, Rohrbaugh & Associates, 401 East Winding Hill Road, Mechanicsburg, PA, 17055, and the Town of Bel Air to provide all labor, equipment and materials for Testing and Inspection Services for the construction of the new Police Station and Town Hall Renovations in the amount of $108,791.00 be accepted by the Bel Air Board of Town Commissioners, Ayes: Commissioners Chance, Etting, Hughes, Kahoe and Bianca Nays: None The motion carried. Cultural Arts Commission Appointment Commissioner Kahoe moved and Commissioner Hughes seconded the motion that the appointment of Margaret S. Lucas to the Bel Air Cultural Arts Commission, for a term of three (3) years, effective immediately, be approved by the Bel Air Board of Town Commissioners. Commissioner Kahoe informed Ms. Lucas has been involved in many art projects and initiatives in the Town and will be a great fit to the Cultural Arts Commission. 2021.12.20.MIN.BOTC.TH Page 3 of 4 Ayes: Commissioners Chance, Etting, Hughes, Kahoe and Bianca Nays: None The motion carried. PUBLIC ANNOUNCEMENTS: Chair Bianca reported Town Hall and offices in Town will be closed on Thursday, December 23rd and Friday, December 24th. The Town Commissioners wished everyone Happy Holidays. PUBLIC COMMENTS: Cyndi Stewart, 102 Nichols Street, Bel Air, Md. still has concern regarding the extended use of tents in 2022. Ms. Stewart may not have a total understanding of the Resolution but appreciates it has been brought. Ms. Stewart advised the noise continues to be an issue and explained last weekend at 8:00 p.m. she could recognize every song played. During that time, Ms. Stewart contacted many residents in the building who were also having the same issues. Ms. Stewart asked the Town Board to keep the residents in mind because IBC has not made any changes the residents are able to recognize. Ms. Stewart commented, we need the help of this Board to protect our quality of life. COMMISSIONER COMMENTS: Commissioner Hughes thanked those who volunteered or participated in Winter Wonderland. Commissioner Hughes stated it was well received from the public and the Winter Market, Sheriff’s Office decoration, and Ferris Wheel were big hits. Chair Bianca advised of seeing lots of smiles throughout the Town and the lights will continue through January 2nd.
