BELGRADE CITY COUNCIL MEETING MINUTES COUNCIL CHAMBERS August 1, 2022 7: 00 PM This meeting was open to the public and attended in person and via Zoom video platform. Deputy Mayor Mike Meis called the meeting to order. Council Members in attendance were Martha Sellers, Jim Simon, Kristine Menicucci, Jim Doyle and Renae Mattimoe. City staff in attendance were City Manager Neil Cardwell, City Attorney Rick Ramler, City Clerk Susan Caldwell, Executive Assistant Dana Jambor, Planning Tech Kristin Spadafore, Finance Director Charity Wilson, Police Chief Dustin Lensing, City Engineer Tom Eastwood and City Court Judge Chris Gregory. Others in attendance were Kevin Cook and Judy Doyle. Other in attendance via zoom was Nicole Cardwell. ACTION: Council Member Simon moved to excuse Mayor Russ Nelson. Council Member Sellers seconded the motion. All voted aye, motion carried unanimously. PUBLIC FORUM Deputy Mayor Meis called three times for public comment. There being none, the public forum was closed. CONSENT AGENDA Resolution 2022- 42 Intent to Create Special Improvement Lighting District No. 2445 Bridger Heights and set date for public hearing on August 15, 2022 Resolution 2022- 43 Intent to Amend Annexation Policy and set date for public hearing on August 15, 2022 Council Meeting Minutes for July 18, 2022; September 7, 2021; September 20, 2021 ACTION: Council Member Menicucci moved to approve all Consent Agenda items as submitted. Council Member Sellers seconded the motion. All voted aye, motion carried unanimously. PUBLIC HEARING Consider Ordinance 2022- 11 ( 2nd reading) Establishing the Belgrade Senior Center Advisory Board City Manager Cardwell noted that the initial appointments to this board would be 1 to 2 year terms so that subsequent renewals would occur incrementally. Cardwell noted that the Memo of Page 1 of 3 Understanding had been fully executed. The Attorney General' s office was in the process of dissolving their previous non- profit entity so the assets could be transferred to the City of Belgrade. Discussion followed about efforts to advertise for this newly formed advisory board. The residency requirements were left open to include the greater Belgrade area, similar to the school district. Cardwell expected that several of the existing board members would probably apply to continue to serve. A member of Council could also be assigned to attend if they so desired. He noted they planned to hold meetings on a quarterly basis. Deputy Mayor Meis opened the public hearing and called for public comment. There was none and the public hearing was closed. ACTION: Council Member Simon moved to approve Ordinance 2022- 11 upon second reading and after public hearing, establishing the Belgrade Senior Center Advisory Board. Council Member Sellers seconded the motion. All voted aye, motion carried unanimously. PUBLIC HEARING Consider Annexation Service Plan for Top Star CFalls property Planning Tech Kristin Spadafore reviewed the Annexation Service Plan for the 2. 29 acre lot at the corner of Frank Road and Jackrabbit Lane. She noted it would be subject to the payback agreement applicable to the area. She also discussed sidewalks and easements along Frank Road. Kevin Cook, applicant, spoke about planned development of the area. He noted plans for a commercial tenant that would probably occupy at least 85% of the property with openings for some other smaller tenants. He hoped to get started right away on the project. Deputy Mayor Meis opened the public hearing and called for public comment. There was none and the public hearing was closed. City Manager Cardwell noted this would be one of the last old style annexation service plans. With consideration of an amended Annexation Policy coming up on a future agenda, the City would be using different annexation agreements moving forward. ACTION: Council Member Sellers moved to approve the Annexation Service Plan for Top Star CFalls, LLC for Tract A of COS 78A in accordance with 7- 2- 4610 Montana Code Annotated, with the adjustment to conditions as requested by staff. Council Member Simon seconded the motion. All voted aye, motion carried unanimously. Resolution 2022- 44 Annexation of Top Star CFalls property Planning Tech Spadafore noted that with the approval of the Annexation Service Plan, the Council could now consider annexation of the subject property. Deputy Mayor Meis opened the public hearing and called for public comment. There was none and the public hearing was closed. Page 2 of 3 ACTION: Council Member Menicucci moved to adopt Resolution 2022- 44 to Annex Top Star CFalls, LLC property, Tract A of COS 78A, into the City of Belgrade. Council Member Doyle seconded the motion. All voted aye, motion carried unanimously. REPORTS Deputy Mayor Meis had nothing to report. City Attorney Ramler had nothing to report. City Manager Cardwell thanked council members for coming in early to have their photos taken for the new website coming soon. Cardwell reported recent conversations about a park district for Belgrade that would follow the School District boundaries. He would be coming back to council for a letter of support that he would take to the County along with Public Works Director Klotz and City Attorney Ramler to start the process of obtaining authority to establish a Park District. This would also work along with plans for the Belgrade Aquatics Center to help those plans move forward. FOR YOUR INFORMATION Council Member Mattimoe reported on a Roller Derby event this Saturday. Council Member Doyle had nothing to report. Council Member Menicucci reported excessively tall weeds on the corner of Penwell and Quaw' s Blvd. She noted they were a fire hazard and were close to several houses. She requested that City staff and/ or Fire staff review the area. She also appreciated the way the City Code Enforcement Officers had handled a moose in the neighborhood. Council Member Simon asked about addressing excessive weeds in the Yellowstone Airport Plaza area. Police Chief Lensing reported that his newest Code Enforcement Officer had completed her training. He expected this to help in efforts to put out reminders on weed control.
