CITY OF BELGRADE COUNCIL MEETING MINUTES COUNCIL CHAMBERS May 6, 2024 7: 00 pm This meeting was open to the public and attended in person. Mayor Russell C. Nelson called the meeting to order. Council Members in attendance were Jason Guffey, Mike Meis, Jim Simon, Kristine Menicucci, Jim Doyle, and Renae Mattimoe. City staff in attendance were City Manager Neil Cardwell, Assistant City Manager Greg Tryon, City Attorney Rick Ramler, Executive Assistant Dana Jambor, Director of Information Technology Ryan Curtis, Director of Community Development Jason Karp, Director of Human Resources Becky Wilbert, Director of Parks and Recreation Steve Klotz, Public Works Director Camaree Uljua, Library Director Gale Bacon. Others in attendance were Gordon Hardaway, Ryan Graf, Bjorn Boyer, Erin Howard, Garrett Schultz, Josh Knoedler, and Tracy Knoedler. PUBLIC FORUM Mayor Nelson for public comment. Erin Howard stood to introduce herself. She explained that she had submitted her application for the Library Advisory Board. Mayor Nelson called for public comment two more times. There being none, the public forum was closed. CONSENT AGENDA Consider Approval of Council Minutes Draft( S): 4- 15- 24. Consider Approval of FY23- 24 Belgrade Regional Parks, Trails, and Recreation District Budget Amendment. Consider Approval of a Reduction of the Letter of Credit for Meadowlark Ranch Phase 5 Commensurate with Work That Has Been Completed. Consider Approval of an Updated Improvements Agreement and Financial Guarantee for Guffey Belgrade Sales and Service). At 7: 03 pm, Council Member Guffey recused himself from the Consent Agenda and exited the Council Chambers. ACTION: Council Member Simon moved to approve the Consent Agenda items as submitted. Council Member Mattimoe seconded the motion. All voted aye, motion carried unanimously. Page 1 of 5 At 7: 05 pm, Council Member Guffey returned to the table. PUBLIC HEARING Discuss and Consider Resolution No. 2024- 5 Approving the Annexation of Property and the Annexation Agreement for Hardaway. Director of Community Development Karp explained that all three annexations on the agenda are infills. This one is to annex the Hardaway property, located on Companion Way. This annexation will connect West Post to Jackrabbit Crossing and is adjacent to the Williams Annexation. He also mentioned that Jackrabbit Crossing will put a traffic light on Companion Way. Garrett Shultz, with Headwaters Engineering, appeared as representative for the Applicant, Dr. Gordon Hardaway. Schultz thanked the Community Development Department for all their hard work, as this project has been in the making for quite some time. He also wanted to mention that Dr. Hardaway is excited to be constructing an expansion to his Veterinary Clinic. Mayor Nelson called three times for public comment. There was none. ACTION: Council Member Menicucci moved to adopt Resolution No. 2024- 5, approving the annexation of the property and the annexation agreement for Hardaway. Council Members Doyle and Meis seconded the motion. All voted aye, motion carried unanimously. Discuss and Consider Resolution No. 2024- 6 Approving the Annexation of Property and the Annexation Agreement for Montana Investments One LP. Director of Community Development Karp explained that this parcel is a vacant lot across from Haraway' s Vet Clinic at the intersection of Companion Way and Jackrabbit Ln. It will bring this vacant lot into Belgrade City limits and have access to the water and sewer installed in Companion Way. Garrett Schultz, representing the Applicant, mentioned that the Applicant expressed their gratitude to Community Development for all their hard work and is excited to be joining the City. Mayor Nelson called three times for public comment. There was none. ACTION: Council Member Simon moved to adopt Resolution No. 2024- 6, approving the annexation of the property and the annexation agreement for Montana Investments One. Council Member Mattimoe seconded the motion. All voted aye, motion carried unanimously. Discuss and Consider Resolution No. 2024- 7 Approving the Annexation of Property and the Annexation Agreement for Birddog Lighting. Director of Community Development Karp said this property is located in the North Business Park along the north side of Jackrabbit Lane. This annexation would make the entire Page 2 of 5 length of Jackrabbit Lane a city street. This property is on its own well and septic system, which will continue indefinitely. If they decide to ever connect to the City' s utilities, it will not trigger sidewalk improvements or contract approaches. Mayor Nelson called three times for public comment. There was none. ACTION: Council Member Menicucci moved to adopt Resolution No. 2024- 7, approving the annexation of the property and the annexation agreement for Birddog Lighting. Council Member Doyle seconded the motion. All voted aye, motion carried unanimously. DISCUSSION AGENDA Discuss and Consider Approval of 5- Year Enterprise Agreement with Cisco- Meraki. Director of Information Technology Curtis explained that this agreement would streamline licensing renewals, ensuring all renewals occur simultaneously each year and simplify the addition of new devices without the need for specific licensing. This agreement would include networking switches, wireless access points, cameras, and DUO security, our multi- factor authentication throughout the City of Belgrade' s facilities. The Agreement is projected to save the City $ 270, 670 over five years. Annually, it would save an average of$ 54, 000. Mayor Nelson called three times for public comment. There was none. ACTION: Council Member Meis moved to Authorize the City Manager to enter into a 5- year term agreement with Meraki. Council Member Mattimoe seconded the motion. All voted aye, motion carried unanimously. Discuss the 2023 Annual Drinking Water Quality Report. Director of Public Works Uljua explained that any drinking water utility in Montana requires an annual drinking water quality report. These reports detail general information about the water utility and the quality control testing from the previous year, which is generally favorable in Belgrade. Uljua also noted this report coincides with Drinking Water Week. Uljua thanked the City' s water operators for keeping the water clean and flowing. She also said that the report is available on the City' s website. A notice will go out in the mail with the utility bills. It will also be posted in public places like the library, Senior Center, and the post office. Mayor Nelson asked Uljua, in her professional opinion, how long she thought until the City would have to start chlorine treating the water. Uljua said Belgrade is the largest untreated water system in Montana, but she hopes the City will not need to use chlorine treatment for a long time. Mayor Nelson called three times for public comment. There was none. Page 3 of 5 Discuss and Consider the Results and Recommendations of the 2024 Utility Rate Study. Assistant City Manager Tryon explained that a rate study must be done before the City can adjust utility rates. He also explained that no decision would be made about utility rates in the meeting being held tonight. Instead, notice must be given to the public and the opportunity for a public hearing on the issue must be afforded. Tryon noted the City Attorney, Finance Director, and City Clerk have worked together to schedule such a hearing for June 17`h, 2024. He then introduced Ryan Graf of AE2S to speak. Rayn Graf of AE2S gave a PowerPoint presentation on the final results and recommendations of the rate study. The Council briefly discussed whether the rate increase should be a one or two-year adjustment. They also asked Graf if he could get 2024' s current impact so that they could compare those to past years, in order to help determine whether this should be a one- year or two- year adjustment. Executive Director of Finance VanKirk recommended the one- year adjustment. Mayor Nelson called three times for public comment. There was none. ACTION: Council Member Mattimoe moved to accept the proposed utility rates and rate structure and set the public hearing date for June 17, 2024. Council Member Doyle seconded the motion. All voted aye, motion carried unanimously. REPORTS Mayor Nelson had nothing to report. City Attorney Ramler had nothing to report. City Manager Cardwell had nothing to report. FOR YOUR INFORMATION Council Member Guffey had nothing to report. Council Member Meis had nothing to report. Council Member Simon had nothing to report. Council Member Menicucci said the Local Water Quality Board is also discussing raising fees. Currently, there are no recommendations. She also wished Council Member Mattimoe a happy birthday. Page 4 of 5 Council Member Doyle had nothing to report. Council Member Mattimoe attended the Regional Parks Board meeting, where they discussed the budget amendment that was on the Consent Agenda. The Parks Board also talked about the Master Plan, which has a survey out that has already gotten a lot of feedback. Council Member Mattimoe Festival at the Chamber on May also mentioned there will be a planning meeting for the Fall May 15th, 2024. She also noted there will be a debut roller derby bout on 18th, 2024, for Gallatin Roller Derby. Finally, Mattimoe noted she will be absent for the May 20th, 2024, Council meeting.
