TORGERSON, LLC-CASE IH SIGNAGE CONDITIONAL USE PERMIT

SUBJECT/APPLICANT: Conditional Use Permit for Torgerson LLC-
Case IH for exceeding sign requirements.
LEGAL DESCRIPTION: Lot 1, Minor Sub #306, located in the NW ¼
of Section 13, T.1.S, R.4.E., Gallatin County,
Montana
COMMON DESCRIPTION: 5900 Jackrabbit Lane
PROPOSED CONDITIONAL USE: The applicant is requesting a Conditional Use
Permit to allow signage on a tract of record to
exceed the City’s signage requirements. An
applicant is allowed exceed the signage
requirements subject to the conditional use
permit process per Section 10-13-10 of the
Belgrade City Code.
PROJECT SUMMARY:
The request is to construct 2nd free standing sign that exceeds 15 feet in height and 50
square feet in area. Current zoning allows one 35 foot tall sign with a maximum of 100
square feet in area, and a second 15 foot tall sign with a maximum 50 square feet of area.
The applicant is seeking to install another free-standing sign on their lot to advertise as a
Case IH Dealership. The exiting signs advertises as a New Holland Dealer. A copy of the
applicant’s written request is attached.

Chapter 10-6-4 of the Belgrade Zoning Ordinance states that the City Council may make the
granting of a conditional use permit subject to reasonable limitations or conditions as it may
deem necessary to enhance the appearance of the property, to reduce any adverse effects on
nearby property or residences, to preserve the character of the area, or to make it more
acceptable in other ways.
1. A new Conditional Use Permit application shall be made for any expansion or increase
of the signage.
2. All applicable City Zoning Codes must be met.
3. The required electrical and building permits shall be obtained from the State of
Montana Building Codes Bureau.
4. The signage shall be designed and installed to withstand local wind and earthquake
loads.
5. The signage must be located within the property line and not in any public right-of-
way or any utility easement unless written permission is obtained from the utility
providers within the easements.
6. Failure to abide by all of the restrictions and conditions of the conditional use permit
shall be adequate grounds for the City Council to revoke such conditional use permit
and order that the conditional use shall be discontinued within thirty (30) days of the
revocation of the conditional use permit (Belgrade Zoning Ordinance Chapter 10-6-
6).
