City of Bellaire Texas Page 2 of 2 Page 5 of 28 AGENDA STATEMENT City of Bellaire MEETING: Board of Adjustment – April 17, 2025 PREPARED BY: Monique Alejos, Development Review Coordinator DEPARTMENT: Development Services ITEM TITLE: Docket # BOA-2025-01: A public hearing, consideration and possible action on an application for variance filed by Gregg Hollenberg, President of Meridian Signs, LLC, on behalf of The Houston Dentists, for the renovation of an existing sign located at the north corner of Bissonnet Street and Locust Street, 4914 Bissonnet Street, Bellaire, Texas 77401, which exceeds the maximum sign height by one (1) foot, and is located within the two-foot (2’) setback, as allowed by Chapter 24, Planning and Zoning, Section 24-1011, Permitted Signs for Commercial or Mixed-Use Buildings, Subsection (C), of the Code of Ordinances of the City of Bellaire, Texas. The property is located within the Residential-Office Mixed- Use (R-M.2-O) Zoning District. RECOMMENDATION: Based on staff’s analysis and the standards set forth in Section 24-1011 of the City of Bellaire Code of Ordinances, staff does not object to the approval of the variance request to allow the renovation of the existing sign, so long as the Board finds that the variance request meets the four (4) requirements set in Section 24-704, Standards, of the Code of ordinances. BACKGROUND/SUMMARY: Site Details Address: 4914 Bissonnet Street, Bellaire, Texas 77401 Property Owner: 4914 Bissonnet Venture, LLC Applicant: Gregg Hollenberg, President, Meridian Signs, LLC Zoning: Residential-Office Mixed-Use (R-M.2-0) Zoning District Date Filed: March 3, 2025 Legal Notice Issued: April 1, 2025 Background: On March 3, 2025, the applicant submitted a variance request to install a monument sign at the north corner of Bissonnet Street and Locust Street, 4914 Bissonnet Street, which exceeds the maximum sign height by one (1) foot, and is located within the two-foot (2’) setback, as allowed by Section 24-1011, Permitted Signs for Commercial or Mixed-Use Buildings. The proposed sign is intended to replace the previous monument sign that was destroyed during the Derecho Windstorm in May of 2024. Page 6 of 28 Sec. 24-1011. Permitted Signs for Commercial or Mixed-Use Buildings. The following signs are permitted on property in or for a commercial use. (C) Monument Signs. 1) Districts. All commercial and mixed-use districts. a) Number allowed. i) Generally. One per building. ii) Two monument signs are allowable: (a) When the building fronts two of the following streets: Bellaire Blvd., S. Rice Ave., Bissonnet St., or the 5700 and 5800 blocks of Newcastle, provided that neither sign is located within one hundred (100) feet of a residential property and the minimum spacing between the signs is three hundred (300) feet, or (b) On automobile service stations on a corner lot with frontage on at least two streets. b) Maximum area. 60 square feet. c) Maximum height. 8 feet above curb. d) Minimum setback. The greater of two feet from the property line or six feet from the edge of the street, whichever is more restrictive. e) Spacing limitations. Only one monument sign per 100 feet of linear feet or part hereof shall be permitted, except when more than one freestanding building is located on one site. Per Section 24-704, Standards, there are four requirements that the Board must find the application meets, which are listed below. Sec. 24-704. Standards. The Board shall not grant a variance unless it shall, in each case, make specific written findings based directly upon the particular evidence presented to it which support written conclusions that: (1) Such modifications of the height, yard, area, lot width, lot depth, off-street loading, screening wall, coverage, parking and sign regulations are necessary to secure appropriate development of a parcel of land which materially differs from other parcels in the district because of a special condition unique to and inherent in the parcel itself, such as restricted area, shape or slope, such that the parcel cannot be appropriately developed without modification; (2) A literal enforcement of the zoning ordinance from which the variance is requested would result in unnecessary hardship not self-created or personal, nor solely financial in nature; (3) The granting of the variance will not be materially detrimental or injurious to other property or improvements in the neighborhood in which the subject property is located, nor impair an adequate supply of light or air to adjacent property, substantially increase the congestion in the public streets, increase the danger of fire, endanger the public health, safety and well-being, or substantially diminish or impair property values within the neighborhood; and (4) The variance desired will not be opposed to the general spirit and intent of this chapter. Height: To allow the height of the monument sign to be 9 feet, which exceeds the 8-foot maximum height allowed by the ordinance. 2. Setback: To allow the monument sign to be set back less than 1 foot from the property line, in contrast to the required 2-foot setback. Facts Supporting the Request:  The Houston Dentists is a longtime Bellaire healthcare provider and taxpayer for over 30 years. The Houston Dentists has 12 local employees. The facility at 4914 Bellaire includes several businesses that serve hundreds of Bellaire residents.  The existing monument sign was installed in 2011 and was in compliance with the City’s sign code at that time.  In May 2024, the monument sign was destroyed and blown down during the Derecho Storm.  Due to the safety concerns posed by the damaged sign, the debris was promptly removed from the property.  The Houston Dentists has contracted Meridian Signs to design and install a replacement multi-tenant sign that updates the look and design while maintaining the same dimensions and location as the original sign.  The requested sign height of 9 feet and setback of less than 1 foot from the property line will merely replicate the conditions of the previous sign, which was previously permitted by the City of Bellaire. Justification for the Requested Variance: Page 12 of 28 As outlined in Section 24-704 of the Bellaire Sign Code, variances may be granted when certain findings are met. Below are the findings and how they apply to our situation: 1. Need for Modification Due to Unique Parcel Conditions: The parcel located at 4914 Bissonnet has a unique shape and orientation, with its property line not running parallel to the main thoroughfare, Bissonnet Street. Due to this unique property layout, the monument sign must be positioned near the property line and as tall as possible to ensure visibility. Without these modifications, the business would experience significant hardship, resulting in reduced visibility for drivers and pedestrians, and the possibility of confused wayfinding for patrons. Furthermore, a further setback would reduce the already limited parking for this multi-tenant building. This has already been impacted by changes to other codes. 2. Unnecessary Hardship: The hardship caused by the damage to the original sign was a result of a natural disaster (Derecho Storm), not a self-created or financial hardship. While the financial damage has been covered by insurance, the inability to replace the sign in the same size and location would severely limit the visibility of The Houston Dentists' practice and negatively impact the business's ability to direct traffic and patrons to its location. 3. No Detriment to Neighboring Properties: Granting this variance will not cause any material detriment or injury to neighboring properties or the public. The new sign will be of similar size and location as the original sign and will not affect the light, air, or safety of surrounding properties. In fact, there are other businesses in the vicinity that have monument signs of similar height (9 feet), demonstrating that such signage is consistent with the area. Additionally, the new sign will not increase traffic congestion or pose any other safety or environmental concerns. Without proper signage visibility, cars on Bellaire Boulevard may slow down and impact congestion to find the proper turnoff to the location. 4. Alignment with the Intent of the Sign Code: The intent of the sign code is to regulate signs in a manner that ensures public safety and orderly development. Our request seeks to replace a sign that was previously in compliance with the code, and the proposed sign will maintain the same size and location as the original. Thus, the variance is not opposed to the general spirit or intent of the sign code, as the new sign will help maintain the visibility and operational needs of The Houston Dentists, while also minimizing any negative impact on the surrounding area. Conclusion: We respectfully request the City of Bellaire’s Board of Adjustment to approve this variance application so that The Houston Dentists can replace the damaged monument sign with one of similar size and location, ensuring continued visibility for the business and the safety of its patrons. Denying this request would place an undue hardship on the business and result in a significant loss of visibility and wayfinding capabilities.
