BACKGROUND/SUMMARY: The City of Bellaire, Texas, held its Runoff Election on Saturday, December 9, 2023, for the purpose of electing a Mayor. According to the Texas Election Code, Chapter 67, Canvassing Elections, Section 67.004, Procedure for Local Canvass, the canvass is the official tabulation of the ballots cast and votes received in each precinct for early voting and on Election Day and the sum of precinct totals for each candidate. The Harris County Clerk's Office will compile and prepare the City of Bellaire's Official Canvass Report by December 20, 2023. The Official Canvass Report will be provided on the dais on that date. Dutton DEPARTMENT: City Clerk's Office ITEM TITLE: Consideration of and possible action on the adoption of an ordinance of the City Council of the City of Bellaire, Texas, canvassing the returns and declaring the results of the City of Bellaire, Texas, Runoff Election held on the 9th day of December, 2023, for the purpose of electing a Mayor - Submitted by Tracy L. Dutton, City Clerk. RECOMMENDATION: Tracy L. Dutton, City Clerk, recommends that City Council adopt the ordinance. BACKGROUND/SUMMARY: Following the reading of the tabulation of the total number of votes cast in each precinct (0128, 0214, 0215, 0268, and 0919) and the sum of the precinct totals cast in the City of Bellaire Runoff Election held on December 9, 2023, for the purpose of electing a Mayor, City Council will be asked to take action on the adoption of an ordinance as presented declaring the results of the Runoff Election. An ordinance has been prepared for this purpose and is attached hereto. Teneshia Hudspeth, Harris County Clerk, will compile and prepare the City of Bellaire's official Canvass Report. The Canvass Report is expected to be available on December 20, 2023, after the official posting of the agenda. The Canvass Report will be distributed to the members of the City Council on Monday, December 20, 2023. The Canvass Report will serve as Exhibit "A" to the ordinance. FISCAL IMPACT: None. CITY ATTORNEY REVIEW: ☑ Yes ☐ No Page 7 of 11  City of Bellaire ORDINANCE NO. 23-____ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BELLAIRE, TEXAS, CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE CITY OF BELLAIRE, TEXAS, RUNOFF ELECTION HELD ON THE 9TH DAY OF DECEMBER, 2023, FOR THE PURPOSE OF ELECTING A MAYOR. WHEREAS, on August 7, 2023, the City Council of the City of Bellaire, Texas, approved and adopted Ordinance No. 23-056 ordering a General Election to be held on November 7, 2023, for the purpose of electing a Mayor and three (3) Council Members for Position Nos. 2, 4, and 6; calling a Special Election to authorize the sale and conveyance of the Ruffino Hills Property previously dedicated as park land; establishing the date of the General and Special Elections; and providing a Runoff Election, if necessary; and WHEREAS, the General and Special Elections were held on November 7, 2023, and on November 20, 2023, the City Council of the City of Bellaire, Texas, approved and adopted Ordinance No. 23-083 canvassing the returns and declaring the results of the General and Special Elections held on November 7, 2023; and WHEREAS, none of the candidates for the office of Mayor received a majority of the votes cast for that office in the General Election, thereby requiring a Runoff Election to be held on December 9, 2023; and WHEREAS, it is hereby found and determined that the notice of the Runoff Election was duly given in the form, manner, and time required by law, and was in all respects legally held in accordance with applicable laws of the State of Texas and the proceedings calling and governing the holding of such Runoff Election; and Ord. Pappas, who shall be administered the Oath of Office and shall assume the duties of office immediately thereafter at the first regular City Council meeting scheduled for January 8, 2024, all in accordance with the Charter of the City of Bellaire, Texas, as amended on November 3, 2020. Friedberg, Mayor) will issue a Certificate of Election to the elected official to the office of Mayor. The purpose of the Certificate of Election is to verify the election of officials.
