CITY OF BELLEVILLE, ILLINOIS ORDINANCE AND LEGAL REVIEW COMMITTEE CITY HALL COUNCIL CHAMBERS OCTOBER 14, 2014 6:00 PM Alderman Kinsella called the meeting to order. Alderman Kinsella stated everyone in the room is aware of the disaster procedures. Members present on roll call: Alderman Kinsella, Alderman Musgrove, Alderman I-lult, Alderman Galetti, Alderman Davidson, Mayor Eckert and City Clerk Cook. City Attomey excused: Garrett Hoerner. PUBLIC PARTICIPATION None. MINUTES Alderman Hult made a motion seconded by Alderman Musgrove to accept the minutes of September 9, 2014 All members present voted aye. ACTION ITEMS CONSIDER APPROVAL OF RETAINING NANCY SULVESTER FOR PARLIMENTARY PROCEDURE SERVICES City Clerk Cook stated he attended Finance Committee meeting and requested to transfer $2500 from the salary line item to other professional services. City Clerk Cook stated he had spoken to both parliamentarians this date and followed up with references. Chris Dickey is from St. Louis and Nancy Sylvester is from Chicago. Chris Dickey is much cheaper; however, after speaking with both individuals, City Clerk Cook recormnends Nancy Sylvester. Ms. Sylvester spoke with City Clerk Cook on different ways she would engage and help for rough meetings. City Clerk Cook stated Ms. Sylvester has written two books, Parliamentary Procedure and Roberts Rules of Order. City Clerk Cook stated Chris Dickey charges $350 minimum and Nancy Sylvester charges $2200 plus travel. Alderman Kinsella stated he had downloaded Ms. Sylvester’s book on his Kindle and its common sense, conversational. City Clerk Cook stated he had contacted their references. City Clerk Cook stated he can send invites to other municipalities to help with the costs and include the public.  Ordinance & Legal Review Minutes October 14. 20I4 Mayor Eckert stated do we do this now or after May 1, 2015; City Clerk Cook stated that is why is bringing it this evening. . .other cities have been getting hit for lack of procedure. Alderman Davidson recommended going with the lesser speaker and have everyone purchase the book. Alderman Hult stated we are within six months of the election and recommended waiting; Mayor Eckert stated putting $3000 in the budget for training and ear mark it for May 2015. Alderman l-lult asked if other city clerks’ or city attomeys become parliamentarians; City Clerk Cook stated there is only one clerk in the process of becoming a parliamentarian. City Clerk Cook stated there are only thirty official parliamentarians in the country. Alderman Kinsella recommended that everyone read the book before the training and discussed some examples that were given in the book i.e. types of motions. Mayor Eckert recommended waiting until May (newly elected aldermen) and reach out to other communities; Alderman I-lult concurred. Aldemian Hult asked if handout will be available; City Clerk Cook stated yes, she will bring handouts. CONSIDER APPROVAL OF ORDINANCE AMENDING CHAPTER 3, 23, 24 AND 25 Mayor Eckert stated this has been discussed before and in all probability there will be two building/electrical inspectors retiring in the next number of months. Mayor Eckert stated there is no preconceived reason why he is doing this; however, appointing a "Paul Bauman" hypothetically there are certain skills required and the pay is around $52,000. With doing this it will expand those who can apply or show interest i.e. City Attorney. Mayor Eckert requested to amend the Ordinance to include the HVAC inspector, as well. Alderman Kinsella stated this should reflect Ordinance amending Chapter 3, 23 (added that the person lives within ten miles), 24 and 25 should be added. Alderman Hult made a motion to postpone discussion until the next meeting due to the fact the alderman was not given the ordinance in advance seconded by Aldemian Galetti. Discussion". Mayor Eckert stated this has been discussed twice before. Alderman Hult stated she had a recent conversation with a former member of another community and shared her frustration, specifically, about the St. Elizabeth’s resolution and he said the committees he was on that they did not vote on anything that was not included-in the packet. Alderman Galetti asked if this will be affected by the review of the codification; Mayor Eckert stated this will not change the codification since it the City’s own ordinance. Mayor Eckert stated in recent years with union contract changes and then what was done with the city attomey is the first time in the last five years that residency was adjusted. Mayor Eckert stated that all other full time employees had to always live in the corporate city limits. Page 2 ol`4  7 Ordinance & Legal Review Minutes October I4, ZOI4 Alderman Davidson stated it does not seem to him that there is a rush for this. lf the references should have been in the packet it should have been in the packet so it should not necessarily be voted on until everyone has an idea. Mayor Eckert stated he know one person is going to retire soon but has not given his letter yet. Members voting aye: Kinsella, Musgrove, Hult, Galetti, Davidson. (5) Members voting nay: Mayor Eckert (l) DISCUSSION ITEMS SOLICITOR ORDINANCE Alderman Kinsella asked Alderman Schneider if she has anything new to add; Alderman Schneider stated she was not aware it was on last month’s agenda. Aldennan Sclmeider stated nothing has changed; however, feels changes are needed before coditication is completed. Alderman Schneider asked if she should put a letter in the newspaper asking how people feel and to contact their aldermen. Alderman Schneider said she recently ran into ATT and Charter Cornrnunications representatives; Mayor Eckert stated some are doing it by appointment. Mayor Eckert stated there was a ruling that changed so|icitor’s rights and would recommend before putting an article in the newspaper to seek the city attomey’s opinion. Mayor Eckert stated around the time he came on city council the City of Belleville was effected by a law that came out stating our law was to stringent on solicitors. Mayor Eckert requested getting out "safety tips” via outside agencies. Alderman Davidson requested Alderman Kinsella to submit the questions of the committee to the city attorney so the committee can have answers for the next meeting. Aldemian l-lult asked about the law regarding political signs; Mayor Eckert stated that goes back to 1993. The Court’s decision was April 27, 1993. When the new group came in it was never changed. Alderman Schneider stated this went to police and tire committee July 2014 and Chief Clay gave a handout of what was discussed in August 2014. Mayor Eckert asked Alderman Schneider to contact Sharon Strausbaugh and request the "safety tips" be included in the January 2015 Newsletter. Mayor Eckert recommended that Chief Clay and the City Attomey work together to help create the safety tips. Alderman Kinsella spoke regarding the fine which is now $5-$500 and the decision of the amount of the fine is made by the courts. Alderman Kinsella stated he has a problem with the line going to $5000 since most of the people are out trying to make a living.
