CITY OF BELLEVILLE, ILLINOIS SPECIAL ORDINANCE AND LEGAL REVIEW COMMITTEE CITY HALL COUNCIL CHAMBERS JANUARY 13, 2015 6:00 PM Alderman Kinsella called the meeting to order. Members present on roll call: Alderman Kinsella, Alderman Musgrove, Alderman Galetti, Alderman Davidson, Alderman Meyer and Mayor Eckert. PUBLIC PARTICIPATION Michael Hagberg, Belleville, Illinois. Mr. Hagberg referenced the Rules of Registration ¶g. First, the title reads “Renewal Land Termination” and should actually read “Renewal and Termination”; the third line down “person” should be replaced with “parties” to keep it consistent throughout the document. On the second line where it says “three (3) year period the City Clerk may provide written notice by regular mail to the interested parties” and if you read the law the law states that at a minimum the Rules and Registration shall provide a renewal period of registration of not less than three year and notification to the registered organization or individuals by mail at the address provided on the registration prior to termination of their registration unless the city wishes not to have a termination and not to terminate it. It’s not up to the clerk as to whether he may or may not provide it…it must be provided. MINUTES Alderman Musgrove made a motion seconded by Alderman Davidson to accept the minutes of December 11, 2014. All members present voted aye. ACTION ITEMS CONSIDER APPROVAL OF RESOLUTION 3210 (INDUCEMENT RESOLUTION) Discussion… Eric Schauster, Economic Development Specialist/Grants Coordinator, stated this is related to the subsequent items related to the TIF/Business District. This resolution states the city’s intent to create a Business District and TIF district for the 33 acres north of the Shrine per the annexation agreements. This must be done per the statute to start the process. Alderman Galetti questioned the second WHEREAS¶; Mayor Eckert stated this is just to begin the process; the Development Agreement is forthcoming. The developer has made it clear that without TIF/Business District his project cannot go forward. Mayor Eckert stated there is between $35 and $40 million dollars worth of investment. Ordinance & Legal Review Minutes January 13, 2015 Alderman Galetti stated it will take some time for the TIF to come into existence; Mayor Eckert stated three to four months; Alderman Galetti stated to have money in it; Mayor Eckert stated not until they start paying property tax. Alderman Galetti asked once the resolution passes what is the next step; Mayor Eckert stated there is a waiting period for other proposals and once that is done the final development agreement can be presented to the committee. Mr. Norber stated he has a seven page schedule for the process. Alderman Meyer made a motion seconded by Alderman Davidson to approve the Inducement Resolution 3210. Members voting aye on roll call: Musgrove, Davidson, Meyer, Mayor Eckert, Kinsella. (5) Member abstaining on roll call: Galetti. (1) CONSIDER APPROVAL OF ORDINANCE 7840 (AN ORDINANCE ESTABLISHING A SPECIAL TAX ALLOCATIN FUND FOR THE AREA SUBJECT TO RESOLUTION 3210) Discussion… Eric Schauster, Economic Development Specialist/Grants Coordinator, stated this is to be able to do what the TIF can and a line item in the budget for the particular TIF fund. Until the TIF generates money there will be a line that is at zero on the books. Alderman Musgrove made a motion seconded by Alderman Meyer to approve Ordinance 7840. Members voting aye on roll call: Musgrove, Davidson, Meyer, Mayor Eckert, Kinsella. (5) Member abstaining on roll call: Galetti. (1) CONSIDER APPROVAL OF ORDINANCE 7841 (AN ORDINANCE AUTHORIZING THE ESTABLISHMENT OF THE PROPOSED TAX INCREMENT FINANCING DISTRICT “INTERESTED PARTIES REGISTRIES” AND ADOPTING REGISTRATION RULES FOR SUCH REGISTRY) Discussion… Eric Schauster, Economic Development Specialist/Grants Coordinator, stated also part of the statue there must be “an interested parties registry” and what this does is allows anyone anywhere to register to be an interested party and they are notified by mail and for certain things in the TIF under Item J in the Rules that are in the packet are a list of items. Alderman Meyer made a motion seconded by Alderman Davidson to approve Ordinance 7841 with including the suggestions from Mr. Hagberg. (1) CONSIDER APPROVAL OF ORDINANCE 7842 (AN ORDINANCE ESTABLISHING A BUSINESS DISTRICT TAX ALLOCATION FUND FOR THE AREA SUBJECT OT RESOLUTION 3210) Discussion… Eric Schauster, Economic Development Specialist/Grants Coordinator, reminded the committee that the business district allows an addition 1% sales tax on certain items and any food that is consumed onsite. Any retail items i.e. grocery, pharmaceuticals, cards are not covered. Alderman Meyer made a motion seconded by Alderman Davidson to approve Ordinance 7842. Members voting aye on roll call: Musgrove, Davidson, Meyer, Mayor Eckert, Kinsella. (5) Member abstaining on roll call: Galetti. (1) DISCUSSION ITEMS None. MISCELLANEOUS None.
