Present on Roll Call: Alderwoman Pusa, Alderman Hazel, Alderman Randle, Alderman Wigginton, Alderwoman Stiehl, Mayor Eckert, City Attorney Hoerner, City Clerk Jennifer Meyer and City Treasurer Dean Hardt, Director of Human Resources, Sherry Favre, Director of Economic Development, Annissa McCaskil1, City Planner, Mathew Chandler. PUBLIC PARTICIPATION None. MINUTES Motion made by Alderwoman Pusa and seconded by Alderwoman Stiehl to approve the March 14, 2017 Ordinance & Legal Review minutes. All members present voted aye. UNFINISHED BUSINESS Alderman Hazel requested an update on the Secondhand Dealers ordinance i.e. 17th Street; City Attomey Hoerner stated she has been cited three times which has been referred to the Courts. In the meantime, the City is taking action related to the business occupancy. *** CONSIDERATION OF AN ORDINANCE ESTABLISHING CITY OF BELLEVILLE GENERAL AND COMMUNITY ASSISTANCE {FORMER BELLEVILLE TOWNSHIP FUNCTIONS). DISCUSSION AND CONSIDERATION OF AN ORDINANCE CONCERNING RESALE AND CONSIGNMENT SHOPS. City Attorney Hoerner stated this is a follow up with respect to the ordinance city council passed on May 2, 2016 that approved the discontinuance and abolislnnent of Belleville Township with an effective date of May 15, 2017. There is a proposed Ordinance that has been provided and there are provisions in the revised Code that address the fact that the City is now pursuant to Article 28 of the Township Code taking over those responsibilities that were previously performed at functions of Belleville Township. There is an addition from the proposed ordinance, there will need to be two funds created; (1) General Assistance; and (2) Community Assistance. Community Assistance Fund (Section 34.121) All of the other functions (non—general assistance) i.e. senior citizen services, youth services, mental health services, services in cooperation with another governmental entity (non profit or corporation), social services for the poor and aged, public transportation, transient services and any other community services and purposes authorized by law. With respect to Section 1 under the Organization Chapter of the Code they established the General Community Assistance Department which will be administered by the Director of Human Resources and Community Development. Discussion". Alderman Wigginton asked if the Director of Human Resources will oversee the two funds; City Attorney Hoerner stated it will be administered by the Director of Human Resources; however, will be monitored and maintained by the Finance Department. Alderman Randle asked how the $245/mo will be disseminated; Director of Human Resources, Sherry Favre, stated it could be in the form of gift card, rent receipt, gas cards. Director of Human Resources, Sherry Favre, stated they will use the gift cards until they no longer have them which will give more time to study to see if there is a better method by which to give the assistance. Alderman Randle asked how many gifts card do they have; Director of Human Resources, Sherry Favre, stated they have thousands of dollars in gift cards. Mayor Eckert stated their initial thinking they can find a better method and are not here to criticize past practice. Mayor Eckert stated the office will be inventoried on May 16, 2017. City Attorney Hoerner is currently reviewing the present lease and the City will be allowed to continued on a month-to- month until such time the clerk and treasurer go back to city hall. Mayor Eckert stated the department will be housed at 512 West Main Street. City Attorney Hoerner stated the purpose this evening is to formulate a framework so there is a seamless transition. (7) DISCUSSION CONCERNING ORDINANCE CHAPTER 115 PEDDLERS AND SOLICITORS gITINERANT MERCHANTS, FOOD TRUCKS, MOBILE RETAIL SHOPS AND RELATED APPLICATIONgS)). City Attorney Hoerner stated as part of the re-codification there were changes to this chapter. The itinerant merchant provisions that are currently being used need to be updated. City Attorney Hoerner stated the portion regarding itinerant merchant application needs to be updated. The clerk's office has submitted a draft. There is a constant inquiry about food trucks and now dovetailing there are mobile retail trucks that do not sell food they sell merchandise. The administration has gathered information from other communities on how they are handling. Regarding food trucks: some communities limit on where they can be, how often they can be out of Peoria has a special service area and they limit food trucks to three license and i.e. the City they can only be on the street in front of the courthouse; the City of Urbana has two different licenses (private property or street side parking). What needs to be decided is (1) if you want to permit these; (2) where and what type of restrictions; and (3) when. Mayor Eckert stated in 1997 there was a discussion regarding a food cart that would be placed in front of the courthouse. The downtown merchants did not want the food cart and it was turned down. City Clerk, Jennifer Meyer, stated anything that has to do with food the Health Department regulates and they permit. City Clerk, Jennifer Meyer, stated the language could be the following: they must follow the St. Clair County Code for food and sanitation regulations. The City does not want to get into the business that the health department is doing. Director of Economic Development, Amiissa McCaskill, stated they should provide their certification from the health department. Alderman Wigginton asked if this will be grouped together i.e. solicitor, peddlers, itinerant merchant; City Attorney Hoerner stated there will need to be subsections. Alderman Hazel discussed brick and mortar businesses as opposed to a snow cone shack. Director of Economic Development, Annissa McCaskill, stated she is present because this topic has been going on for over two years and the city needs something in place. When you talk about brick and mortar there is currently a vendor that operates a truck in St. Louis County and is looking to brick and mortar in Belleville. You now have your brick and mortar business that is looking into the food truck so they can travel as well. The city currently has vacant stores where they can transition trucks into brick and mortar. City Attorney Hoerner stated fixed versus mobile will need to be addressed i.e. snow• cones. Direction of Economic Development, Annissa McCaskill, recommended an additional seasonal occupancy permit which would require inspections necessary i.e. electrical, tire department, building department. City Attorney Hoerner requested administration draft a proposal and submit for the meeting in June. All members present voted aye.
