Present on Roll Call: Alderwoman Puss, Alderman Hazel, Alderman Wigginton, Alderwoman Stiehl, Mayor Eckert and City Attorney Hoemer, Alderman Randle excused. Staff Present: City Clerk Jennifer Meyer, Director of Economic Development, Annissa McCaskill. Guest: Executive Director of Chamber of Commerce, Wendy Pfeil. PUBLIC PARTICIPATION None. MINUTES Motion made by Alderman Hazel and seconded by Alderwoman Puss to approve the May 9, 2017 Ordinance& Legal Review minutes. All members present voted aye. UNFINISHED BUSINESS None. MISCELLANEOUS& NEW BUSINESS CONSIDERATION OF AN ORDINANCE PERMITTING MOBILE COMMERCE VENDORS City Attorney Hoemer reviewed the document submitted by City Clerk Meyer, Director of Economic Development, Annissa McCaskill and Planner, Mathew Chandler. City Clerk Meyer stated they are looking to have an ordinance that would be a mobile commerce vendor which would cover food and retail vendors. This will require changes to the current ordinance for itinerant merchants and food trucks. When the itinerant merchants started that effected the Keller Com, Snow Stand, Tent Revivals etc. Those would now fall under the commercial occupancy as a seasonal and then that would require inspections. Page 1 00  Ordini n e& Legal Review Minutes June 26, 2017 Director of Economic Development, Annissa McCaskill stated with having this in place it would require inspections and the proper departments would review and sign off. By shifting an itinerant merchant to seasonal permit would be a safer route. City Clerk Meyer, stated the mobile commerce vendor " building structure vehicle apparatus that is not immobilized". This will do two things ( I) this will get rid of the itinerant merchant definition;( 2) along with creating a seasonal commercial occupancy definition. Mayor Eckert asked if the ice cream truck and snow cones customer require a background check; City Clerk Meyer stated no. Director of Economic Development, Annissa McCaskill stated if the city requires a background check for someone to go door-to-door to solicit why is the Schwann's driver aloud to go to door- to-door. City Attorney Hoemer stated that would be considered a solicitor ( which requires a background check). City Clerk Meyer, stated the mobile commerce vendor would be an annual license with an application. There are a couple of questions for the committee ( 1) the fee; and ( 2) will you delineate to say they are here for one( 1) day or three( 3) days for an event downtown. Will this be a onetime fee? City Attorney recommended treating the ice cream truck and Schwann's truck as a solicitor and they sell food stuffs (prepackaged, unprepared food). Recommending mobile commerce vendor definition " food that is prepared for immediate consumption". Anyone that knocks on a door has to be background check. City Clerk Meyer stated the mobile commerce vendor will only be on private property, no public property may be used unless it is approved by city council i. e. downtown event, if complaints are received verification of approval will be requested. If a request is made to have at a city park it must require city approval. City Clerk Meyer stated the city will ask for the following upon application: ( 1) provide a copy of their tax id number with the State of Illinois ( the next year the applicant will have to provide that they paid sales tax for the previous year); ( 2) provide a certificate of liability insurance with the minimum sum of$ 1, 000,000; ( 3) driver's license of the owner and operator of the vehicle; 4) vehicle insurance; ( 5) if it is food they will have to provide a copy of their local health department food license and a copy of vehicle registration. City Attorney Hoemer recommend prohibiting liquor and beer. City Attorney Hoerner will submit a draft ordinance for the July 11, 2017 meeting. Pi 2of3  ordinance& Legal Review Minutes June 28 2017 DISCUSSION CONCERNING ORDINANCE REGARDING RAFFLES City Clerk Meyer stated the City currently offers raffle license with a max of$ 25,000 for the prize. The Scottish Rite called and requested to do a Queen of Hearts and currently the City will not allow. St. Clair County just amended their raffle license ( 1) minimum of$25, 000; however, (2) added a specific sections that addresses Queen of Hearts which cannot exceed $ 500,000 and it allows for 54 weeks. They also require a fidelity bond in the amount of $25, 000 in favor of the organization. They charge $ 25. 00 for the license. City Attorney Hoemer will draft an ordinance and present at the July 11, 2017 meeting. Our current raffle license is only good for ninety( 90) days. Alderman Hazel made a motion seconded by Alderwoman Pusa to raise the raffle limit from 25, 000 to $ 50, 000. Members voting aye on roll call: Pusa, Hazel, Stiehl, Wigginton and Mayor Eckert.
