CITY OF BELLEVILLE, ILLINOIS ORDINANCE AND LEGAL REVIEW COMMITTEE CITY HALL COUNCIL CHAMBERS JULY 16, 2018 5: 30 PM Alderman Wigginton called the meeting to order. Aldermen present on roll call: Alderman Randle, Alderman Hazel, Alderwoman Stiehl, Alderwoman Pusa and Alderman Wigginton. Guest Alderman on roll call: Alderman Ovian. Staff Present: Mayor Eckert, City Attorney Hoerner, City Clerk Jenny Meyer, City Treasurer Hardt. PUBLIC PARTICIPATION None. MINUTES Alderwoman Pusa made a motion seconded by Alderman Hazel to accept the minutes of June 12, 2018. All members present voted aye. UNFINISHED BUSINESS None. MISCELLANEOUS & NEW BUSINESS Consideration of Motion to Consider Small Cell Wireless Ordinance. City Attorney Hoerner stated this in an ordinance amending Article 15 by adding Chapter 163 Small Wireless Facilities providing the regulations and application for small wireless facilities. This is in response to the recently enacted Public Act 100- 585 which created the Illinois Small Wireless Facilities Employment Act. Essentially, this is the State' s requirements to function as a small wireless facility versus having an entire southern power. The State has provided requirements for municipalities that municipalities must allow. It restricts municipalities to regulate this under home rule.  Ordinance& Legal Review Minutes July 16, 2018 Alderman Randle inquired as to whether they can use a piece of city owned property to mount devices; City Attorney Hoerner stated within the right- of-way. Alderman Randle asked if they will be allowed to use the streetscape; City Attorney Hoerner stated the city will encourage them to go to a side street. Alderman Ovian asked if the city can charge a fee; Alderman Randle stated there is an application fee of$ 1, 000 and$ 200 annual fee. City Attorney Hoerner stated he hopes the providers will work with the municipalities. Alderman Hazel asked if there is a designation that can be placed on the streetscape pole; Alderman Wigginton stated to suggest alternatives. Alderman Wigginton asked if there is a maximum that can be installed, Mayor Eckert stated 1000. Alderwoman Stiehl made a motion seconded by Alderman Randle to approve the Small Cell Wireless Ordinance. Members voting aye on roll call: Randle, Hazel, Stiehl, Pusa, Wigginton, Mayor Eckert.
