CITY OF BELLEVILLE, ILLINOIS ORDINANCE AND LEGAL REVIEW COMMITTEE CITY HALL COUNCIL CHAMBERS AUGUST 16, 2018 5: 30 PM Rescheduled from August 14, 2018) Alderman Wigginton called the meeting to order. Aldermen present on roll call: Alderman Randle, Alderwoman Stiehl, Alderwoman Pusa and Alderman Wigginton. Aldermen absent on roll call: Alderman Hazel. Guest Alderman on roll call: Alderman Buettner, Alderman Ovian. Staff Present: Mayor Eckert, City Attorney Hoerner, City Clerk Jenny Meyer, City Treasurer Hardt, Director of Health and Housing, Bob Sabo, Director of Public Works, Jason Poole. PUBLIC PARTICIPATION None. MINUTES Alderwoman Pusa made a motion seconded by Alderwoman Stiehl to accept the minutes of July 16, 2018. All members present voted aye. UNFINISHED BUSINESS None. MISCELLANEOUS & NEW BUSINESS Consider amending ordinance Title XI ( Business Regulations), Chapter 111 ( Amusement and Recreation; Raffles), Sections 111. 001 and 111. 094. City Attorney Hoerner stated this will exclude microblading ( semi- permanent eyebrow). This is being proposed since the state considers this to be tattooing. Ordinance& Legal Review Minutes August 16, 2018 The second section is the raffle license portion of the code. This is being revised to be consistent with the city's practice. Alderman Randle questioned the word " promptly"; City Attorney Hoerner advised they do not report unless asked. Alderman Randle made a motion seconded by Alderwoman Stiehl to amend ordinance Title XI (Business Regulations), Chapter 111 ( Amusement and Recreation; Raffles), Sections 111. 001 and 111. 094. Members voting aye on roll call: Pusa, Randle, Stiehl, Wigginton, Mayor Eckert. ( 5) Consider amending ordinance Title XV ( Land Usage), Chapter 158 ( Streets, Sidewalks, Trees), Sections 158. 091 through 158.098. Discussion... City Attorney Hoerner stated this will eliminate the tree board committee. The Health and Housing Director will oversee trees which exist upon any private property. Alderwoman Pusa made a motion seconded by Alderwoman Stiehl to amend ordinance Title XV ( Land Usage), Chapter 158 ( Streets, Sidewalks, Trees), Sections 158. 091 through 158. 098. Members voting aye on roll call: Pusa, Randle, Stiehl, Wigginton, Mayor Eckert. ( 5) Consider amending ordinance Title XV (Land Usage), Chapter 154 ( Property Maintenance Code), by adding Sections 154. 70 through 154.83 ( Vacant Property Program). Discussion... City Attorney Hoerner stated this proposed ordinance has already been approved through Health and Housing which vacant properties are registered with the city and there are plans that will be put into effect and overseen by the Health and Housing Director to improve those vacant properties and to keep them up to code. This will identify a vacant building that is unoccupied, unsecure and in violation of city ordinance. There is a registration for vacant properties and the city will determine if the property meets the criteria. This is an attempt to address the problem with the homeowner. They will have to submit a plan to bring it up to code. This will not apply to a house for sale or unoccupied; it will only address to those that are considered a nuisance. Members voting aye on roll call: Pusa, Hazel, Randle, Stiehl, Wigginton, Mayor Eckert. ( 6) Alderman Randle made a motion seconded by Alderwoman Stiehl to amend ordinance Title XV Land Usage), Chapter 154 ( Property Maintenance Code), Section 154. 46( 3) ( Rental Property Registration) by increasing the annual registration from $25. 00 to $ 30.00 per rental unit, thereby raising the late fee from $50.00 to $60.00 per unit. Members voting aye on roll call: Pusa, Hazel, Randle, Stiehl, Wigginton, Mayor Eckert.
