CITY OF BELLEVILLE, ILLINOIS ORDINANCE AND LEGAL REVIEW COMMITTEE DECEMBER 11, 2018 6: 00 PM Alderman Wigginton called the meeting to order. Aldermen present on roll call: Alderman Randle, Alderwoman Pusa, Alderman Hazel and Alderman Wigginton. Aldermen excused on roll call: Alderwoman Stiehl. Staff Present: Mayor Eckert, City Clerk Meyer, Director of Economic Development, Annissa McCaskill and Assistant Director of Economic Development, Eric Schauster. PUBLIC PARTICIPATION Sal He cuts through 6th Street and thinks it would be easier if they would open the gates ( 6th and Main) for at least the weekend; Mayor Eckert advised there are deep holes in the area and the city has requested an update from the contractor. MINUTES Alderwoman Pusa made a motion seconded by Alderman Randle to accept the minutes of October 19, 2018. All members present voted aye. UNFINISHED BUSINESS None. MISCELLANEOUS & NEW BUSINESS CONSIDER MOTION TO CONSIDER APPROVAL OF INFILL DEVELOPMENT ORDINANCE Assistant Director of Economic Development, Eric Schauster, stated this will allow the city to work on city owned vacant lots, buildings that were acquired via a tax sale, demolition. This will allow the city to negotiate with a developer ( on city owned properties) for a rehab or new construction. The items in 164.2 Product Requirements give the opportunity to use any listed. Alderman Randle stated this has been talked about for several years and this will give the tools available to make those types of programs available to outside companies. Director of Economic Development, Annissa McCaskill, stated this is a first step to have people to look at the lots. Ordinance& Legal Review Minutes December 11, 2018 Alderman Wigginton asked if the city has an active list and does the city try and sell the lots or properties; Director of Economic Development, Annissa McCaskill, advised the city clerk has a list of the properties; Mayor Eckert advised once a year this is taken to health and housing. Assistant Director of Economic Development, Eric Schauster, stated the city will focus on certain areas of the city so you will see the progress in a concentrated area. Alderman Randle stated if you cluster in certain areas i.e. Martin Luther King Drive in E. St. Louis. Alderman Randle asked if there is a budget for this enterprise; Assistant Director of Economic Development, Eric Schauster, stated there will not out of pocket from the city. Any taxes will be abated. If the property in a TIF area the rebate can be discussed. Alderman Randle asked what other communities have this in place; City Clerk Meyer advised it is sporadic; however, infill has been enacted in University City, Missouri ( does not give abatements) and in Chicago, Illinois. City Clerk Meyer advised she reached out to IML for a model and they do not have a model yet; therefore, it took staff brainstorming and consulting with the city attorney. This ordinance is meant to be a tool. Alderman Hazel cautioned with this tool for a future administration to aggressively use this tool to acquire property. Alderman Hazel asked if the city heard from the realtors association; Director of Economic Development, Annissa McCaskill, stated the realtors association approaches the city regarding abatement. Alderwoman Pusa made a motion seconded by Alderman Randle to approve of Infill Development Ordinance. Members voting aye on roll call: Hazel, Pusa, Randle, Wigginton, Mayor Eckert. ( 5) CONSIDER APPROVAL OF AMENDMENTS TO TITLE XI (BUSINESS REGULATIONS), CHAPTER 119 ( HEALING ARTS & MASSAGE SERVICES) SECTION 119. 99 ( PENALTY) OF THE BELLEVILLE, ILLINOIS REVISED CODE OF ORDINANCES Alderman Wigginton stated Paragraph B is being stricken. City Clerk Meyer stated the city will no longer license massage services since they are licensed through the State of Illinois. This was overlooked during codification. Alderwoman Pusa made a motion seconded by Alderman Randle to approve amendments to Title XI (Business Regulations), Chapter 119 ( Healing Arts & Massage Services) Section 119. 99 Penalty) of the Belleville, Illinois Revised Code of Ordinances. Members voting aye on roll call: Hazel, Pusa, Randle, Wigginton, Mayor Eckert. ( 5) Page 2 of 3 Ordinance& Legal Review Minutes December 11, 2018 CONSIDER TO APPROVE OF AMENDMENTS TO TITLE III (ADMINISTRATION), CHAPTER 31 ( OFFICIALS AND EMPLOYEES; GENERAL ADMINISTRATION), SECTION 31. 017 ( C)( 2)( C)( 1.) AND SECTION 31. 017 ( D)( 7) ( POLICY PROHIBITING SEXUAL HARASSMENT) OF THE BELLEVILLE, ILLINOIS REVISED CODE OF ORDINANCES Alderman Randle asked when did this change to the Illinois Human Rights Act; City Clerk Meyer state the city received notification approximately 45- days ago and it must be changed by January 1, 2019. Alderman Randle made a motion seconded by Alderwoman Pusa to approve of amendments to Title III (Administration), Chapter 31 ( Officials and Employees; General Administration), Section 31. 017 ( C)( 2)( c)( 1.) and Section 31. 017 ( D)( 7) ( Policy Prohibiting Sexual Harassment) of the Belleville, Illinois Revised Code of Ordinances. Members voting aye on roll call: Hazel, Pusa, Randle, Wigginton, Mayor Eckert. ( 5) CONSIDER APPROVALAMENDMENT TO OF TITLE IX (GENERAL REGULATIONS), CHAPTER 94 ( PARKS AND RECREATION), SECTION 94.01( T) PARK REGULATIONS) OF THE BELLEVILLE, ILLINOIS REVISED CODE OF ORDINANCES Alderman Wigginton stated Southside Park is being added. Mayor Eckert stated the police will have the authority to stop the drinking at Southside Park. If someone wants to have a party with alcohol they will have to apply with the city with council approval. Alderman Randle made a motion seconded by Alderman Hazel to approve amendment to Title IX ( General Regulations), Chapter 94 ( Parks and Recreation), Section 94. 01( T) ( Park Regulations) of the Belleville, Illinois Revised Code of Ordinances. Members voting aye on roll call: Hazel, Pusa, Randle, Wigginton, Mayor Eckert.
