CITY OF BELLEVILLE, ILLINOIS ORDINANCE AND LEGAL REVIEW COMMITTEE AUGUST 11, 2020 6: 00 PM VIA TELECONFERENCE Alderman Wigginton called the meeting to order. Aldermen present on roll call: Alderman Hazel, Alderman Puss, Alderman Randle, Alderwoman Stiehl and Alderman Wigginton. Guest Aldermen: Alderman Elmore. Staff Present: Mayor Eckert, City Clerk Meyer, City Treasurer Hardt, City Attorney Hoerner, Director of Residential and Commercial Development Services, Annissa McCaskill, Lt. Col. Matt Eiskant. PUBLIC PARTICIPATION None. MINUTES Alderman Randle made a motion seconded by Alderwoman Stiehl to accept the minutes of March 10, 2020. Members voting aye on roll call: Hazel, Puss, Randle, Stiehl, Wigginton, Mayor Eckert. ( 6) UNFINISHED BUSINESS Mayor Eckert advised he is still working on the Electrical Commission and will be brought to committee upon completion. s« s Alderman Randle refcrenced the March 10, 2020 meeting where privacy fences were discussed. Does staff have recommendations? Director of Residential and Commercial Development Services, Annissa McCaskill advised staff is still reviewing. Alderman Wigginton asked if this can be brought back in September; Director ofResidential and Commercial Development Services, stated yes. MISCELLANEOUS & NEW BUSINESS Possible motion to approve amendments to Title XIII( General Offenses), Chapter 130 Offenses Against Public Peace and Safety); Section 130. 03( A)(1)( Beggars and Panhandlers; Notification of Homeless Shelter Availability).  OrdiM & Leo Renew Minae Aught 11, 2020 Lt. Col. Eiskant advised there has been an influx of individuals putting up tents on sidewalks and public places within the City. The City Ordinance reads" no person shall be in violation of section unless the person is informed of whereabouts of a homeless shelter in the City". Due to the fact we do not have a homeless shelter at this time the language should be changed to " the person is informed of the whereabouts of a regional homeless shelter". St. Vincent de Paul built a new shelter. The City provides bus passes to the shelter and back to Belleville. Alderman Randle asked ifthe City offers any other transportation; Lt. Col. Eiskant advised the City does not. The individual( s) can come to the Police Department, Community Assistance or the Grants Department. Mayor Eckert advised in severe weather a couple of churches are using vans to transport. Alderman Wigginton asked how to do the people find out where to go and how to get there; Mayor Eckert stated many people have a cell phone and the programs which the City is involved in provide cell phones. Alderman Randle made a motion seconded by Alderman Puss to approve amendments to Title XIII ( General Offenses), Chapter 130 ( Offenses Against Public Peace and Safety); Section 130.03( A)( I) ( Beggars and Panhandlers; Notification of Homeless Shelter Availability). ( 6) Possible motion to approve amendments to Title XI ( Business Regulations), Chapter 124 Used Car Dealers), Section 124. 04( D)( Regulations). City Clerk Meyer advised this is a correction regarding( D) the striped parking spaces was never meant to be included; therefore, should be deleted. Alderman Randle made a motion seconded by Alderman Pusa to approve amendments to Title XI( Business Regulations), Chapter 124( Used Car Dealers), Section 124.04 ( D)( Regulations). Members voting aye on roll call: Hazel, Puss, Randle, Stiehl, Wigginton, Mayor Eckert. ( 6) Discussion on issuance of Business Licenses and/ or sales tax for self-storage units. City Attorney Hoemer advised this topic was previously addressed in this committee and Treasurer Hardt had communication with a colleague on this topic and was provided with Tinley Park' s Ordinance that they recently enacted. There was a discussion on having a license fee versus a storage tax. The distinction is a license fee would not be dependent on occupancy where a sales tax would be dependent on occupancy. A sales tax will be bom by the occupant and the license fee would be born by the owner. Pege 2 of 3  Ordin & LqW Review Minutes Augur It, 2020 License fees under Illinois Law are required to bear a reasonable relationship with the cost associated with regulating the activity of license. Alderman Elmore stated we are heavily reliant on sales tax revenue; we are looking for ways to increase our sales tax revenue through encouraging people to buy in Belleville. Alderwoman Stiehl stated Alderman Elmore made a good point that our services are required. Our police monitor the storage facilities day and night and we cannot pass up passing the tax on to people. Alderman Randle asked if they are operating as a business are they not required to also have a business license and is there a fee associated with that; City Clerk Meyer advised they are currently not listed as one of our entities that get a business license. Alderman Randle requested the City Attorney prepare a draft ordinance which will include the language of" implementation of tax January 1, 2021 and implementation of license May 1, 2021. Alderman Randle requested this be presented at the September S, 2020 Ordinance and Legal meeting and the September 21, 2020 Council meeting. City Attorney Hoemer stated this is a tax that will be administered and collected by the City. City Attorney Hoemer needs to know the percentage of the tax that is being recommended and the amount of the business license. Alderman Wigginton suggested 5%; Alderman Randle and Alderman Elmore concurred. City Clerk Meyer advised all licenses are $ 50.00 except for the Payday Loans which are$ 500. City Clerk Meyer stated she does not know how you would justify not charging$ 50.00 for this license. All aldermen concurred with the$ 50. 00 license fee. OLD BUSINESS None.
