City of Belleville Public Health and Housing Committee City Hall 2nd Floor Conference Room Meeting Minutes Wednesday, August 7, 2019 In Attendance: Members: Alderwoman Joe Hazel (Chairman), Ward 1 Present Alderman Carmen Duco, Ward 2 Present Alderman Scott Ferguson, Ward 3 Excused Alderman Raffi Ovian, Ward 4 Present Alderman Roger Barfield, Ward 8 Present Citizen Member Tricia Tialdo Present Staff: Mayor Mark W. Eckert Annissa McCaskill, Director of Residential and Commercial Development Services Jeff Heidorn, Building Commissioner Matt Eiskant, Assistant Chief of Police Guests: Alderman Kent Randle I. Call to Order Chairman Hazel called the meeting to order at 7:00 pm. II. Roll Call of Members/Staff Roll Call of members was taken. Attendance was noted as provided above. III. Approval of the Minutes The minutes from the July and August 2019 were approved. IV. Emergency Procedures Alderman Hazel provided the emergency procedures, if necessary, for those present. V. Public Participation None VI. New Business There was none VII. Old Business 1. Vacant Properties Director Annissa McCaskill provided the complete list as provided to Former Director Sabo on 10/11/2018. It was noted that the original property provided by Alderman Ovian was replaced by 820 N. 89th Street. Building Commissioner Jeff Heidorn provided an update of the properties on the original list. There was a discussion of the 2. Demolition List Update Director Annissa McCaskill explained the process by which properties may be added to the demolition list. The committee was advised that all the TIF-eligible demolition properties, asbestos reports have been received and were in the process of utility shut-off for each property. There was further discussion regarding the DCEO budgeted allocation for demolition and infrastructure improvements to be utilized for demolitions not in TIF districts. 3. Discussion and possible action on minimum refuse collection standards for multi-family residential buildings. Alderman Hazel introduced his proposal to require a minimum size and number of refuse collection containers for multi-family residential buildings. The size of the containers would be directly related to the possible increase in the number of refuse collection dates for the buildings. There was concern expressed regarding the lack of weekly pick-ups. Alderman Hazel expressed that this language would require weekly collection at minimum. The proposed language does not address minimum siting locations (fencing, padding, etc.), but that could happen for the future. A motion was made and seconded to forward the referenced item to Ordinance and Legal Committee for action with the recommendation that weekly refuse collection be required. The motion was unanimously approved. 4. Discussion of and possible action on an amendment to the Crime Free Housing Ordinance due to changes in the State Statute. Assistant Chief Matt Eiskant provided information regarding changes to the Illinois Human Rights Act regarding what is classified as an arrest v. a conviction. Due to those changes, evictions cannot occur if there is an arrest, only due to a conviction. The City’s Crime Free Housing Ordinance stated “at or near” the residence, Assistant Chief Eiskant advised that “near” would be a violation of the Human Rights act, therefore, he proposed redacting “or near” from the Crime Free Ordinance. There is a clear differentiation being drawn between convictions and arrests. Motion was made to approve this change and properly seconded. The motion passed unanimously. 5. Miscellaneous/ Aldermanic Discussion Director Annissa McCaskill advised the Committee of the creation of a new permit fee schedule for solar installation projects. Staff also advised that the Electrical Code had been approved the previous night to the 2014 version and explained the parameters for its application.
