ZONING BOARD OF APPEALS
The meeting was called to order at 7:00 p.m. by Chairman Danny Nollman. Roll called, quorum declared.

Chairman Nollman asked for a motion to approve the minutes of Dec. 27, 2012. Roger Wigginton made a motion to
approve and seconded by Steve Zimmerman with all present members voting aye. Motion carried.
All Zoning Board cases heard on this date will go to City Council for consideration on Feb. 4, 2013, unless noted
otherwise.

Case #76-Dec12 – Sharon & Heather Noblitt/The Acropolis – Requesting a Sign Permit for the Area of Special Control in
order to install an approx. 25 square foot awning sign and two (2) window signs totaling approx. two (2) square feet
each, for a total of 29 square feet of signage located at 124 E. Main St. (Applicable portion of Sign Code: 53-4-6) This
case was tabled at the December 2012 meeting.
Applicant, Sharon Noblitt explained the signage request. Steve Zimmerman noted that since the applicant had not given
a rendering of the signage she would be required to stay within the Sign Code guidelines for the Area of Special Control,
the applicant agreed. Rebecca Boyer asked who is installing the signs and will they be permanent; the applicant didn’t
know the name of the company and they will be permanent. It was discussed that the signs that are currently painted
on the windows were done so under a temporary sign permit, and will remain as the permanent signs. Since there were
no further questions from the Board or Aldermen and no one in the audience to speak in favor or against the case,
Chairman Nollman asked for a motion.
Roger Wigginton made a motion to APPROVE the request and seconded by Steve Zimmerman, with all members
present voting aye. Motion carried.
Case #1-Jan13 – Donald J. Harwerth – Requesting a Special Use permit for a liquor license at 1021 W. Main St. located in
a C-2 Heavy Commercial Zoning District. (Applicable portion of zoning code: 60-6-50)
The applicant did not appear at the meeting. There was a brief discussion held on tabling the request until the applicant
can attend.
Rebecca Boyer made a motion to TABLE the request until the February 2013 Zoning Board meeting and
seconded by Don Rockwell with all members present voting aye. Motion carried.
Case #2-Jan13 – Missionary Oblates of Mary Immaculate – Requesting to rezone the property at 2 Whiskey Road from A
-1 Single Family Zoning District to C-2 Heavy Commercial Zoning District. (Applicable portion of zoning code: 60-6-47)
Mike Murphy, representative of the applicant, explained that they would like the zoning classification changed due to
the property always been used as commercial property and he has two prospective buyers who would like to use it in
the same manner. There was a brief discussion on the acreage. Joe Putlinski, 37 Morningside, Carlyle IL, has been

utilizing the property as a commercial business and supports the request. Since there were no further questions from
the Board or Aldermen and no one in the audience to speak in favor or against the case, Chairman Nollman asked for a
motion.
Don Rockwell made a motion to APPROVE the request and seconded by Rebecca Boyer, with all members
present voting aye. Motion carried.
Case #3-Jan13 – Jeff Butzinger – Requesting to rezone the property at 2500, 2506 and 2512 Mascoutah Ave. from C-4
Commercial District to Agricultural District. (Applicable portion of zoning code: 60-6-101)
The applicant did not appear at the meeting. There was a brief discussion held on tabling the request until the applicant
can attend.
Rebecca Boyer made a motion to TABLE the request until the February 2013 Zoning Board meeting and
seconded by Roger Wigginton, with all members present voting aye. Motion carried.
Case #4-Jan13 – Rick Casey Jr./St. Clair County Highway Department – Requesting a Use Variance in order to build a
canopy over the fuel pump system, a small shed to house equipment, and an approximately 250 square foot metal sided
garage, at 40 North Water Works Drive, in an A-1 Single Family Residential Zoning District. (Applicable portion of
zoning code: 60-6-1)
Rick Casey, representative of St. Clair County Highway Department, explained that the Highway Dept. needs to place a
canopy over their fuel pumps and place a shed on the property to house equipment. Since there were no further
questions from the Board or Aldermen and no one in the audience to speak in favor or against the case, Chairman
Nollman asked for a motion.
Roger Wigginton made a motion to APPROVE the request and seconded by Rebecca Boyer, with all members
present voting aye. Motion carried.
Case #5-Jan13 – St. Paul’s Home for the Aged – Requesting an amendment to the PUD in order to allow for up to 134
beds, rather than the previously approved 130 beds. (Applicable Portion of the Zoning Code: 60-4-1 and 60-6-24)
Susan Franklin, representative of St. Paul’s Home for the Aged, explained that they were asking to amend the current
PUD to place 134 beds at the facility instead of 130. Steve Zimmerman asked if there were any more changes being
made; Ms. Franklin answered, not at this time. Alderman Meyer stated her support of the request and the overall
project. Since there were no further questions from the Board or Aldermen and no one in the audience to speak in favor
or against the case, Chairman Nollman asked for a motion.
Steve Zimmerman made a motion to APPROVE the request and seconded by Rebecca Boyer, with all members
present voting aye. Motion carried.
Roger Wigginton made motion to ADJOURN and seconded by Rebecca Boyer with all members present voting
aye. Motion carried.
Chairman Nollman adjourned the meeting at 7:18 p.m.
