Meeting 3/3/2014 ZONING BOARD OF APPEALS The meeting was called to order at 5:00 p.m. by Chairman Danny Nollman. Roll called, quorum declared. Rebecca Boyer Present Tim Price Excused Don Rockwell Present Toni Togias Present Roger Wigginton Present Steven Zimmerman Present Dan Nollman, Chairman Present Staff present: Emily Fultz Brian Flynn Elle Davis Paul Bauman Guests: Sally Murphy, Chris Eckert Aldermen present: Alderman Hult, Alderman White, Alderman Seibert Chairman Nollman noted that all Zoning Board cases heard at this meeting will be considered at the City Council meeting at 7:00 pm the same evening, in the same location. -------------------------------------------------------------------- 11-Mar14 – Eckert Orchards, Inc. – Requesting a Special Use Permit to construct a 2,304 square foot metal building addition at 946 Green Mount Road, specifically on parcel 13-01.0-200-001, in a C-4 Commercial District. (Applicable portion of the Zoning Code: 60-6-63.) The Board held a brief discussion on the request and generally asked questions as to what exactly the applicant wants to do and why the request is necessary. The board also asked for details as to the structure and exact location of the proposed building addition. In response, Chris Eckert stated the building addition will allow for a larger machine shed area that will be completely under roof and insulated. The building will also have concrete floors. The addition will be visible from Green Mount Road and Route 15, and will be generally near the top/center of parcel 13-01.0-200-001. There were no comments from the audience or aldermen. With no other discussion, Rebecca Boyer made a motion to approve the request, which was seconded by Don Rockwell, with all members present voting aye. Motion carried. Chairman Nollman stated that the Board would discuss the following two amendments together, but noted that motions would be made separately. Amend Section 60-2-2 to include the term “Pawnbrokers” and amend Section 60-6-50 to include the term “Pawnbrokers.” The board held a brief discussion, during which Ms. Fultz explained the amendments in detail, noting that the Ordinance and Legal Review Committee, at their February meeting, voted to approve the amendments. Alderman Hult stated that the language is more aligned with the state’s requirements. Additionally, the board questioned and Ms. Fultz verified that the limit of two (2) pawnbrokers in the City will remain. There were no other comments from the audience, aldermen, or board. ~1~ With no other discussion, Steve Zimmermann made a motion to approve an amendment to Chapter 60-2-2, adding the definition of “Pawnbrokers.” The motion was seconded by Roger Wigginton and all members present voted aye. Motion carried. With no other discussion, Steve Zimmermann made a motion to approve an amendment to Chapter 60-6- 50, adding the term “Pawnbrokers” to the list of Special Uses. The motion was seconded by Rebecca Boyer and all members present voted aye. Motion carried. Steve Zimmermann made a motion to adjourn, which was seconded by Rebecca Boyer.
