Roll called, quorum declared. Chairman Nollman noted that all Zoning Board cases heard at this meeting will be considered at the Monday, December 7, 2015 City Council meeting. Chairman Nollman asked if there were any corrections to be noted for the October 22, 2015 Zoning Board of Appeals meeting minutes. No corrections were made hence the minutes were approved by the Board. -------------------------------------------------------------------- The following cases were heard: 1. 35-Nov15 – Tejendra Patel– A request for a Special Use permit for a liquor license for Hotshots Liquor at 1809 Central Plaza Drive located in a C-2 Heavy Commercial zoning district. (Applicable Section of the zoning code: 60-6- 50) Ward 1. The applicant explained the request stating that there will be security cameras located outside on the exterior of the building as well as a new illuminated sign, and the hours of operation will be 10:00am – 10:00pm, Monday-Sunday. As of right now, the applicant plans on selling wine, beer, liquor and tobacco. The hours available to sell liquor are determined by the Mayor’s office. He will not sell groceries but he was unsure if other services will be offered such as check cashing. With no further discussion by the Board, Chairman Nollman asked for a motion. A motion was made by Steve Zimmerman to APPROVE the request in the name of the applicant only. It was seconded by Tim Price. All members present voted in the affirmative. The motion carried. 4-0. Zoning Board of Appeals, November 19, 2015 ~Page 1 ~ 2. 36-Nov15 – Mohammed Ali Bamuquabel – A request for a Special Use permit to operate a used car dealership at 1013 Sherman St. located in a C-2 Heavy Commercial zoning district. Ward 1. The applicant explained the request stating that he will lease the car lot, the current entrances and exits will remain as is, there will be no repairing or detailing cars on the lot, his employees will park on the lot and not on the street, and he will affix security cameras and lights to the outside of the building. He approximated that he could fit fifteen to twenty cars on the lot at once. Sheryl Sucic spoke in opposition to the request and stated her concerns. With no further discussion by the Board, Chairman Nollman asked for a motion. A motion was made by Steve Zimmerman to APPROVE the request with the following stipulation: Only ten (10) cars allowed for sale on the lot at one time and two (2) parking spaces allowed for customer parking. It was seconded by Don Rockwell. All members present voted in the affirmative. The motion carried. 4-0. 3. 37-Nov15 – Dahm & Schell, Inc. dba The Edge – A request to rezone the property at 114 State Street from A-1 Single Family to C-2 Heavy Commercial Zoning District. (Applicable portion of the zoning code: 60-6-1 through 60-6-7 and 60-6-47 through 60-6-52) Ward 5. The applicant’s representative, Richard Dahm, explained the request stating that they will demolish the current house standing at the address to make way for more parking for The Edge. The current exits and entrances should remain in use, and lighting will be similar to the other parking lot lighting adjacent to this property. Alderman Dintelman spoke in favor of the request. With no further discussion by the Board, Chairman Nollman asked for a motion. A motion was made by Don Rockwell to APPROVE the request. It was seconded by Steve Zimmerman. All members present voted in the affirmative. The motion carried. 4-0. Cases 38-Nov15 and 39-Nov15 were heard together but voted upon separately. 4. 38-Nov15 – Mac’s Convenience Stores - A request to rezone the property at 755 South Belt West from A-1 Single Family to C-2 Heavy Commercial Zoning District. (Applicable portion of the zoning code: 60-6-1 through 60-6-7 and 60-6-47 through 60-6-52) Ward 5. 5. 39-Nov15 – Mac’s Convenience Stores– A request for a Special Use permit for a liquor license for Circle K at 755 S. Belt West located in an A-1 Single Family zoning district. (Applicable Section of the zoning code:60-6-50.) Ward 5. The applicant’s representative explained the request stating that Circle K will be purchasing two of the Quik Trip locations in Belleville, there will be no changes made to the type of convenience store just a rebranding for Circle K. They plan on both stores operating 24 hours a day. The hours available to sell liquor are determined by the Mayor’s office. With no further discussion by the Board, Chairman Nollman asked for a motion. Regarding case # 38-Nov15: A motion was made by Steve Zimmerman to APPROVE the request. It was seconded by Tim Price. All members present voted in the affirmative. The motion carried. 4-0. Regarding case # 39-Nov15: A motion was made by Steve Zimmerman to APPROVE the request in the name of the applicant only. It was seconded by Tim Price. All members present voted in the affirmative. The motion carried. 4-0. 6. 40-Nov15 – Mac’s Convenience Stores– A request for a Special Use permit for a liquor license for Circle K at 1800 Lebanon Ave. located in a C-2 Heavy Commercial zoning district. (Applicable Section of the zoning code: 60-6-50) Ward 1. The applicant’s representative explained the request stating that this is the second store that Circle K is purchasing from Quik Trip and will be similar to the South Belt West location. The hours available to sell liquor are determined by the Mayor’s office. All members present voted in the affirmative. The motion carried. 4-0. Don Rockwell made a motion to ADJOURN, which was seconded by Tim Price. All members present voted aye.
