I. Call to order / Roll Call of members II. Approval of the meeting minutes from March 17, 2022 and March 24, 2022 III. Emergency procedures and departmental update IV. New Business: 1. 21-APR22 – City of Belleville Zoning Code Amendment: Request for amendments of Title XV (Land Usage) of the Revised Ordinances of the City of Belleville, Illinois, Sections 162.248(C), 162.278(C), 162.308(B) & 162.323(B) “Special Uses” with the following amendments: “Establishments that hold a Class A, B, C, D, or F liquor license;”. 2. 22-APR22 – City of Belleville Zoning Code Amendment: Request for amendment of Title XV (Land Usage) of the Revised Ordinances of the City of Belleville, Illinois, Section 162.570 “Variances” with the following amendments: “A VARIANCE is a relaxation of the requirements of this chapter that are applicable to a particular lot, structure, or use. A so-called use variance (which would allow a use that is neither permitted nor special in the district in question) is not a variance; it is an amendment, and may be granted only as provided for in § 162.574 of this chapter. Any area/bulk or use variance approved expires in one year unless substantial development (in excess of 80%) has been completed.” “A VARIANCE is a relaxation of the requirements of this chapter that are applicable to a particular lot, structure, or use. A so-called use variance (which would allow a use that is neither permitted nor special in the district in question) is not a variance; it is an amendment and may be granted only as provided for in § 162.574 of this chapter. No use or area/bulk variance shall be granted if it is in conflict with the standards of 162.570(A) of the Ordinance. Any area/bulk or use variance approved expires in one year unless substantial development (in excess of 80%) has been completed.” (A) The City Council shall not grant a variance unless it shall, in each case, make specific written findings based upon the particular evidence presented to it that support the following conclusions: 1. The variance requested arises from a condition which is unique to the property in question and which is not ordinarily found in the same zoning district, and is not created by an action or actions of the property owner or the applicant; 2. The strict application of the provisions of this Chapter, from which a variance is requested will constitute unnecessary hardship upon the property owner represented in the application; Zoning Board of Appeals, April 28, 2022 Page 1 / 2 3. The variance requested will not adversely affect the adjacent properties or public health, safety, order, convenience or general welfare of the community; 4. The variance granted does not allow for the establishment of a defined use identified within other underlying zoning districts; 5. Granting the variance desired will not violate the general spirit and intent of this Chapter 3. 13-APR22–Sri Lakshmi Mini Mart, LLC: Request for a Special Use Permit to operate a convenience store and a Special Use Permit for use of a liquor license at 530 N. Douglas (08-22.0-128-001) located in a “C-2” Heavy Commercial District. (Applicable sections of the zoning code: 162.145, 162.248, 162.515) Ward 1 4. 14 APR22– Nichole Hettenhausen: Request for a Use Variance to use a portion of an accessory building for a hair salon at 221 Abend St (08-27.0-26-028) located in an “A-1” Single-Family Residence District (Applicable sections of the zoning code: 162.093, 162.570) Ward 6 5. 15-APR22- Westhaven, LLC: Request for a Special Use permit for a liquor license and outdoor seating at 1513 S Illinois St. (08-33.0-200-031) located in a “C-2” Heavy Commercial District. (Applicable sections of the zoning code: 162.248, 162.515) Ward 5 6. 16-APR22–Daniel Elkan/Glenwood Equities: Request for rezoning of parcel 08-34.0-300-002 and part of the abutting parcel 08-34.0-302-026 from an “A-1” Single-Family Residence District to a “C-2” Heavy Commercial District located at 1906 S Illinois St. (Applicable sections of the zoning code: 162.593) Ward 5 7. 17-APR22 – Aza Properties, LLC: Request for a Special Use Permit to operate an Air B&B at 32 North 98th Street (02- 35.0-213-016) located in the A-1, Single Family Residential District. (Applicable section of the zoning code: 162.094, 162.515) Ward 4 8. 18-APR22 – Riverside Property Invest: Request for a Special Use Permit to operate an Air B&B at 315 Wabash Ave. (08-27.0-209-008) located in the A-1, Single Family Residential District. (Applicable section of the zoning code: 162.094, 162.515) Ward 7 9. 19-APR22 – Project Equity Illinois, Inc. : Request for a Special Use Permit to operate an adult-use cannabis dispensing organization at 4529 W. Main St. (08-18.0-210-002) located in a “C-2” Heavy Commercial District. (Applicable section of the zoning code: 123.005, 123.008, 162.515) Ward 3 10. 20-APR22 – Blounts & Moore Holdings, LLC: Request for a Special Use Permit to operate an adult-use cannabis dispensing organization located at 7300 Twin Pyramid Parkway (07-13.0-107-002) located in a “C-2” Heavy Commercial District.
