Pine Street, Bellevue, ID 83313. Call to Order: Council President Shay called the Regular Meefing to order at 5:30 p.m. Roll Call: Chrisfina Giordani, Mayor – Present Diane Shay, Council President – Present Tammy E. Call for Conflict as Outlined in Idaho Code §74-404: No conflict was noted. 3. MAYOR AND COUNCIL REPORT Mayor Giordani thanked the Public Works Department for their efforts with snow removal. Council Member Obenauf said she was going to collaborate with Ashton from the ERC for the annual Clean Sweep event and spoke about reaching out to the County to get fees waived. Council Member Wrede spoke about the progression of the transifion to the City’s new website from CivicPlus. 4. The change was noted by the Clerk. Council Member Bergin Inquired about how the Snowplow Contract amendment would affect the budget. Discussion was had about how extra money could be reallocated if needed. Mofion: Council President Shay moved to approve the Consent Agenda as presented. Council Member Obenauf Seconded the Mofion. Request for Authorizafion for the Mayor to sign a Memorandum of Understanding (MOU) in coordinafion with the City of Bellevue and the Blaine County Sherriff’s Department for cooperafive public safety services in their respecfive jurisdicfions during the 2025 World Cup Finals: Kirtus Gaston, Bellevue Marshall | ACTION ITEM Marshal Gaston explained the purpose of the MOU is to help the Sherriff’s office with anything they need during the World Cup Finals when resources in the Valley Will be spread thin. Council Member Wrede asked the Marshal about the license plate readers for Bellevue. Marshal Gaston said that is something the City will need in the future, but it may cost a bit of money. Mofion: Council Member Obenauf moved to authorize the Mayor to sign a Memorandum of Understanding (MOU) in coordinafion with the City of Bellevue and the Blaine County Sherrif’s Department for cooperafive public safety services in their respecfive jurisdicfions during the 2025 World Cup Finals. WORK SESSION a. Discussion regarding a new fee structure moving forward for water hydrant connecfions, future bulk water hookups and dump-stafion opportunifies: Chris Johnson, Public Works Director | ACTION ITEM Public Works Director Chris Johnson went over opfions for a bulk water fill stafion and the costs associated with them, as well as potenfial grant opportunifies. He menfioned the approval of an RV dump site at the Maverick Gas Stafion that he didn’t know about unfil recently. He stated his concern with chemicals that would be used and potenfial problems it could cause with biology at the wastewater treatment plant and the current lagoon situafion. He went on to compare pricing for fill stafion permits with surrounding jurisdicfions. Mayor Giordani asked about the potenfial of implemenfing a mobile meter unit. Mr. Johnson said this opfion would be the quickest, most economical possibility to use as a starfing point and the lift stafion area would be the best place for it. He went on to discuss the enforcement of the City Ordinance associated with water theft and proposed increases for annual water permit fees. Further discussion was had about penalfies for theft of water from hydrants and concern about water contaminafion from possible backflow. The Council discussed the current methods of providing water, including short-term use from hydrants and long- term fill stafions. They also discussed the potenfial benefits and drawbacks of these methods, including the cost of providing water and the impact on the City's water system. They agreed that the current system of charging a flat fee for a 30-day permit may not be the most effecfive way to monefize water usage. The Council considered a metered rate system, which would require infrastructure upgrades. The Council circled back to discuss revising the water use permit system to befter regulate and charge for water usage and implemenfing a base fee plus a yearly permit fee, using the current commercial water rate to calculate this. They also discussed an administrafive fee for tracking usage suggesfing a yearly permit regardless of usage volume. Council President Shay asked to revisit the topic of the RV dump site at the Maverik that was brought up at the beginning of this workshop. Brian Parker, Community Development Director explained that the approved Design Review applicafion idenfified the RV dump site and there is no addifional approval associated with it. They sfill need to get a water and sewer permit, which he stated he will work out with Chris Johnson and Rick Allington. Council President Shay and Council Member Wrede expressed their disapproval with the idea of Bellevue becoming an RV dumping ground. Mayor Giordani said there are RV dump stafion in every City. Chris Johnson, Public Works Director explained that Bellevue’s exisfing RV park is no different and expressed concern with having two operafional dump sites before the wastewater facility is back online. Council Member Bergin said he thought that if the RV Dump Stafion was not correctly reviewed during the inifial design review maybe it could be put on hold unfil it was thoroughly reviewed. Mayor Giordani looped back to the original workshop topic of pursuing a fill stafion in Bellevue. The Council agreed it was something they would like to see further pursued. b. Discussion and review of the City of Bellevue Comprehensive Plan Brian Parker, Community Development Director discussed the review of the City's comprehensive plan, assigning a homework task to the Council Members to review and provide feedback in a month from this meefing. Council President Shay reviewed the implementafion secfion of the Comp plan and asked the Council to consider the implementafion of the plan and needed updates. Chris Johnson, Public Works Director addressed the issue of disrespect and threats faced by the City's Street Department, emphasizing the need for a more supporfive and respecfful community especially revolving around the snow removal efforts. Sgt. Shelamer went to ICRMP Executive Leadership Training held at the Blaine County Public Safety Facility. We will be continuing with several training courses over the next coming months. I encourage all council members to take a walk or drive from 2nd street east to 7th street and from Wanut North to Spruce and see for yourself the conditions of the roads. The warm days and the runoff and the freezing temperatures at night are causing frost heaves breaking apart the surface then the runoff again the next day is washing the gravel and creating massive potholes or clusters of potholes. Unfortunately, there isn’t much the department can do until it dries out and we can start filling and repairing them to what extent we can. Water – Still working on the consolidated meter list and filling in missing information like meter size and type of use (single family, business, mixed use). We had a productive meeting with our water project team, just finishing up a few clarifying questions and holding another meeting with our engineers and our legal team to develop a MOU so Ee Da Ho and our project team are on the same understanding of intent, scope of work and location. We are expecting to start survey work once the snow clears and finish out the environmental document. Then we can move into preliminary engineering and should have the engineering complete and ready for public comment and DEQ review this fall. With the transition to Cassell we can start moving forward to bringing our meters online. We need to ensure the accuracy of the meter list and the accounts in Cassell are correct and we can import that list into the Neptun Meter reading software. I anticipate we could start seeing live reads in June and transition to a metered rate by September/October. Wastewater – Electricians are making good progress and have removed the old wires and panels. They have set the new panels and have much of the conduit hung and in place. We have had some setbacks with getting the proper couplers for two of the pumps, but they arrived on March 3rd and should be installed on Friday March 7th. We also found that most of the sensors have corroded and cannot be repaired. We have identified them and have sent lists to suppliers for quotes and hope to order them as soon as possible. Parks, Building and Grounds – We are seeing new graffiti around town primarily on signs. The upgrade to snow plus tires was not considered. Even with all wheel drive the loader loses traction when the roads become covered in snow and ice. This presents a hazard to the operator and reduces the work the loader can do. Upon completion of the lease the loader must be returned with at least 50% tread life on the tires. Recommendation: To get full use out of the loader, Snow Plus tires should be installed. Purcell Tire and Rubber Co. provided a quote for $14,569.26. The other quote was nearly $6000 more. The current tires can be covered and stored until completion of the lease and then reinstalled to meet the 50% tread life requirement. On the State of Idaho Liquor License Application instructions page at the bottom in bold states “City and County license are required before you can serve alcohol.” In the social media promotions made by Lucy’s Breakfast it shows what appears to be shots and mixed drinks being handled to include using what appears to be a liquor bottle “toasting” within the unlicensed establishment. On 02-12-2025 the City of Bellevue received an application for Annual Retail Alcoholic Beverage amending Lucy’s Breakfast to allow liquor by the drink. At this time Lucy’s Breakfast is only open until 1500 hours per her business license and online recourses. The City of Bellevue passed an ordinance for Resort City Liquor license allowing up to 3 licenses be issued with hours of service for such sales be between 1600 and 2200 hours. On 02/24/2025 the applicant amended her application giving a dinner menu with future operation hours of 1600 to 2200 hours “when/if we get the license.” Idaho Code 23-903c (2) states “no less than sixty percent (60%) of gross sales from the preceding twelve (12) month operation of a licensed restaurant be derived from food services.” 23-903c(3)b states “no resort city restaurant licensed pursuant to this section shall promote or operate the restaurant as a bar and lounge.” It is the recommendation of the Bellevue Marshal’s Office to deny the application. 1.) Due to possible violation of BCC 3-2-2, 2.) Being warned on the State License application not to serve prior to obtaining City and County licenses and clearly having served as part of a promotional video. 3.) Not currently open the hours of allowable service for liquor per BCC.  If the establishment opened for food 52 sales during the allowable service times and amended their business license to reflect those hours they could potentially come into compliance with this provision.
