The following items are heard in the Regular Meeting only: Call to Order The meeting was called to order by Council President Knutson at 7:00 p.m. Announcements & Upcoming Meetings: Bellingham City Council meets all requirements of the State of Washington Open Meetings Act. Pledge of Allegiance Led by Theresa Meurs Roll Call Present: Jack Weiss, Council Member, First Ward Gene Knutson, Council Member, Second Ward Daniel Hammill, Council Member, Third Ward Pinky Vargas, Council Member, Fourth Ward Terry Bornemann, Council Member, Fifth Ward Michael Lilliquist, Council Member, Sixth Ward Roxanne Murphy, Council Member, At Large Excused: 15-Minute Public Comment Period James, reported to the Council his experience attempting to secure housing assistance from Bellingham Whatcom County Housing Authority. City of Bellingham Regular City Council Meeting Page 1 of 8 8/31/2015  Judy Collins, addressed the Council about her lack of water service. Garey Vodopich, informed the Council of problems with rental properties in his neighborhood. He would like the single family zoning enforced. Steve Abell, also spoke on the issue of single family zoning in his neighborhood. He asked the Council to direct staff to enforce the code for single family zoning. Darcy Jones, requested the Council consider the High Population Growth, (or med high) and annex the south half of the Caitec property and put the north half in reserve status. (AB 20898) John Mutchler, urged the City Council to participate in the jail plan that the County is proposing. (AB 20757) Donna Macomber, thanked Council members for not adopting the high number of the UGA/Comp Plan. (AB 20898) Irene Morgan, of Restorative Community Coalition, addressed the Taxpayer's Report, she delivered earlier in the day to the Council and the Mayor. She recommended the Council read the report and alternatives to the jail proposal. (AB 20757) Theresa Meurs, reported the new Francis House building project has been completed and 24 previously homeless residents of Bellingham have been placed there. Clayton Petree, reported from sources that support the high population growth and asked the Council to keep those numbers in mind when approving the UGA resolution. (AB 20898) Wendy Harris, spoke about her concerns regarding habitat corridors within the City. Lynn Murphy, of Puget Sound Energy, updated the Council on the status of restoring power in the community that was lost from last weekend's storm. Public Hearing 20940 1. Resolution to Relinquish 30-Foot Water Easement Located at Division Street and Bakerview Spur Council President Knutson opened the public hearing. City of Bellingham Regular City Council Meeting Page 2 of 8 8/31/2015  Ted Carlson, Public Works Director, addressed the Council and explained the resolution is to relinquish the water main and vacate the water easement. In exchange, the City obtains a storm water easement in the same area. Public comment was taken and the public hearing was closed. Terry Bornemann / Jack Weiss moved final approval of Resolution #2015-13. MOTION CARRIED 7-0 Presentation 20941 1. Update on Bellingham's Future Use of the Whatcom County Jail Whatcom County Sheriff, Bill Elfo, addressed the Council and explained the need for a new jail facility. He urged the City of Bellingham, to join the County in an agreement to build a jail facility that is large enough for Bellingham to use along with the rest of the cities in Whatcom County. Council Member Lilliquist, expressed frustration about the Interlocal jail agreement. He feels the operational and capital costs are not an equitable responsibility to the City. He feels the City should pay a fair share. County Executive, Jack Louws, explained that he asked the Council to propose specific changes to the agreement so that he can present those changes to the County Council and small cities of Whatcom County. Council Member Bornemann proposed a special meeting with the City Council to discuss changes to the interlocal agreement that would be presented to the Whatcom County Council. Council President Knutson / Pinky Vargas moved to schedule a special meeting of the City Council to discuss the jail. MOTION CARRIED 7-0. Public Works / Public Safety 20942 1. Interlocal Agreement with Western Washington University, Whatcom Transportation Authority and the City for Sidewalk Improvements to Lincoln Street Terry Bornemann / Pinky Vargas moved to approve the interlocal agreement. Bid Award for the Water Treatment Plant Pre-Treatment (DAF) Project - DAF Equipment, Bid #28B-2015 Terry Bornemann / Dan Hammill moved to award Bid No. 28B-2015 for the Water Treatment Plant Pre-Treatment (DAF) Project to Xylem Water Solutions of Zelienople, PA as the lowest responsive, responsible bidder and to authorize the Mayor to enter into a contract with them for the amount of their bid, which is $986,000.00, which includes any applicable WSST. MOTION CARRIED 7-0. 20945 4. Project # ES-0513 - Holly Street Overlay - 30% Design Review Information only. Planning 20898 1. Consideration of a Resolution and Findings Reflecting the Planning Committee's Recommendations for the New 20-year Population and Employment Growth Forecast and Potential Changes to the Bellingham's Urban Growth Boundary Council Member Weiss reported on the Planning Committee's resolution that recommends a mid-range 2036 population forecast, adopts a high range employment growth forecast, and makes no change to the City's urban growth boundary. He noted that there were mixed recommendations for adding the Caitac property and Yew Street area to reserve status. Terry Bornemann / Dan Hammill moved to approve the resolution. Motion failed 3-4. Weiss, Murphy, Knutson and Vargas opposed. Following the failed motion, the Council discussed the points of the resolution individually. Jack Weiss / Michael Lilliquist moved to accept a medium growth, high employment growth forecast in the resolution. MOTION CARRIED 4-3. Knutson, Murphy and Vargas opposed. Terry Bornemann / Dan Hammill moved for the south Caitec property be kept in reserve status. MOTION CARRIED 6-1. Weiss opposed. Rick Sepler, Planning Director, reminded the Council that it was necessary to vote to approve the resolution as amended by the three previous votes. Michael Lilliquist / Dan Hammill moved for final approval of Resolution #2015-14 with modifications that reflect the actions that were voted on. MOTION CARRIED 5-2. Weiss and Murphy opposed. Parks and Recreation 20946 1. Parks and Recreation Department, Design and Development Division Update Information only. Committee Of The Whole 20947 1. Communications Update Information only. 20948 2. City Council Resolution Regarding Social Media Guidelines Gene Knutson / Michael Lilliquist moved final approval of Resolution # 2015-15. MOTION CARRIED 7-0. 20949 3. Waterfront District Implementation Status Report Information only. 4. Approval of Minutes Michael Lilliquist / Terry Bornemann moved approval of the August 10, 2015 minutes of the regular City Council meeting as submitted. MOTION CARRIED 5. Old/New Business Jack Weiss gave a commentary on antiquated electrical infrastructure. Mayor's Reappointment of Jan Hayes to the Design Review Board (Approval) Michael Lilliquist / Terry Bornemann moved to reappoint Jan Hayes to the Design Review Board. MOTION CARRIED 7-0. 20951 2. Mayor's Appointment of Erich Kleinknecht to the Public Works Advisory Board (Information) The Mayor appointed Erich Kleinknecht to the Public Works Advisory Board. Consent Agenda 20952 1. Approve Amendment #1 to the Interagency Agreement #C1400056 with the Department of Ecology to add $100,000 20953 2. AN ORDINANCE AMENDING THE 2015/2016 ADOPTED BUDGET INCREASING REVENUE IN THE GENERAL FUND BY $51,880.00 FOR A FEMA ASSISTANCE TO FIREFIGHTERS GRANT AWARD, REALLOCATING $5,188.00 IN EXPENDITURES IN THE FIRE DEPARTMENT GENERAL FUND, AND APPROPRIATING $57,068.00 FOR THE PURCHASE OF A VEHICLE FOR THE COMMUNITY PARAMEDIC PROGRAM Terry Bornemann / Roxanne Murphy moved approval for third and final reading.
