Call to Order The meeting was called to order by Council President Lilliquist at 7:00 p.m. Announcements & Upcoming Meetings: 1. On Monday, October 23 at 7 p.m. in Council Chambers, there will be a Public Hearing for the consideration of a request to adopt an Institutional Master Plan for the Whatcom Community College. Bellingham City Council meets all requirements of the State of Washington Open Public Meetings Act. Pledge of Allegiance Led by Council President Lilliquist. Consideration of Application for Bureau of Justice Grant in the Amount of $22,828 City of Bellingham Regular City Council Meeting Page 1 of 5 9/25/2017  Deputy Chief, Flo Simon, gave a short presentation and explained the grant that was awarded to the Bellingham Police Department for software to aid in downloading video from body cameras. Council President Lilliquist opened the public hearing. No citizens spoke and the public hearing was closed. 15-Minute Public Comment Period Pamela Sorenson, explained the latest American Cancer Society's campaign called Real Men Wear Pink. She presented Council Member Terry Bornemann with a promotional bag. She also thanked him for his involvement with the cause. Throughout the month of October, men who want to participate in the campaign can wear pink to raise awareness for breast cancer. Shovia Muchirawehondo, recommended that the City provide diversity training. Chris Deile, complained about an incident where he encountered an unrestrained dog and felt threatened. He suggested there be an ordinance that requires dogs to be restrained at all times. Joseph McDonald, spoke against the idea of hell and President Trump. Bret Beaupain, followed up with notification that he sent Council Members about a Puget Sound Energy project he feels is not in compliance with the City Code. He listed the ways it is out of compliance. Yoshe Revelle, warned against climate change and asked that we make changes to stop climate change. Lynn Murphy, a representative of Puget Sound Energy, reported that the process to shut down coal fired units has begun. Everett Barton, proposed that communities of faith could create ways to partner with older individuals and students to all live in housing together. Council Standing Committee Meetings: Planning 21672 1. Committee Discussion of Potential Regulatory Approaches and Techniques to Provide Additional Housing Choice in Bellingham City of Bellingham Regular City Council Meeting Page 2 of 5 9/25/2017  Council Member Knutson reported that so far, the Committee has had several meetings to address housing choices in the City. The first meeting was a Town Hall on June 13th, as well as Planning Committee work sessions on July 24th, August 14th and September 11th and Sept 25th. On October 9th, the Committee plans to continue discussion on housing. Scheduled for the meeting on October 23rd, the Committee has asked staff to present on the In-Fill Tool Kit's history to show where tools are being used and where they can expand. Information only. Justice 21730 1. Discussion of the Role of the Prosecutor and Municipal Court and How a Case Moves Through the Court System Presentation during Committee. Prosecutor Ryan Anderson and Judge Lev reported on how a case moves through the court system. Bellingham Municipal Court focuses on rehabilitation. Clarifying points included that persons with civil infractions will not go to jail for unpaid fines. Criminal offenses are what must be enforced and may end up in jail. Persons that fail to appear in court could be as high as 50%. Information only. Public Works / Public Safety 21704 1. Wholesale Water Contract with Lummi Nation Staff presented three potential options for negotiations during Committee. Terry Bornemann / Gene Knutson moved to direct staff to negotiate with the Lummi Nation to develop a water contract that takes into account: One, Business as usual: retail rate plus out of City Multiplier, and 11.5% UT; or two, create a wholesale rate and evaluate UT % that includes a combination depending which works best for both entities, and for staff to look into developing a contingency plan if the development does not proceed as planned. MOTION CARRIED 7-0. Committee Of The Whole 1. Approval of City Council Committee and/or Special Meeting Minutes Roxanne Murphy / April Barker moved approval of the September 11, 2017 minutes of the regular City Council meeting as submitted. MOTION CARRIED 7-0. 2. Old/New Business City of Bellingham Regular City Council Meeting Page 3 of 5 9/25/2017  April Barker requested an update on the property search for a suitable site for a low- barrier shelter. Rick Sepler, Planning and Community Development Director, reported no properties that are for sale or vacant lots meet the criteria. April Barker /Gene Knutson moved to appoint Michael Lilliquist as liaison to County Council and express our desire to partner with the County and other local agencies in finding a suitable site. MOTION CARRIED 7-0. Gene Knutson informed all that the Bloedel Donovan locomotive Engine No. 7 was retired from the Bloedel Donovan Park last week on September 21st. It was sent to the Northwest Railway Museum in Snoqualmie. Pinky Vargas reported on the Georgetown Prize. Unfortunately, the University has not reported yet on the Top 10 Cities or given a status of where the City of Bellingham is in the running. She thanked everyone for their efforts to reduce our carbon footprint and expressed that every little bit helps. Michael Lilliquist went to this weekend's SeaFeast. He said it was well attended. He entered the Shuck and Slurp Contest and won second place. Dan Hammill attempted to go to Missoula to meet with the Mayor, Council, Project Development department to discuss their recent downtown redevelopment project. However, the flight was cancelled and turned around due to mechanical problems. He will attempt to meet with them again at a later time and report back to Council. Brian Heinrich, Deputy Administrator, reported there will be discussion on the biennial budget adjustments at the next couple of meetings, October 9th and October 23rd. Michael Lilliquist also informed the Council that the Vera Institute will be in town to present to the County Council. We have invited them to also present to Council during the Justice Committee session on October 23, 2017. Consent Agenda All matters listed on the Consent Agenda are considered routine and/or non-controversial items and may be approved in a single motion. A member of the Council may ask that an item be removed from the Consent Agenda and considered separately. 21731 1.
