Belton City Council Meeting April 12, 2016 - 5:30 P.M. The Belton City Council met in regular session in the Wright Room at the Harris Community Center with the following members present: Mayor Marion Grayson, Mayor Pro Tern David K. Leigh, and Councilmembers Craig Pearson, Dan Kirkley, Paul Sanderford, Jerri Gauntt and Guy O'Banion. Staff present included Sam Listi, Gene Ellis, Amy Casey, Brandon Bozon, Erin Smith, Bruce Pritchard, Kim Kroll, Chris Brown, Aaron Harris, Angellia Points, Matt Bates, Paul Romer, Ed Bandas, Byron Sinclair, Charlotte Walker and Cynthia Hernandez. The Pledge of Allegiance to the U.S. Flag was led by Councilmember Dan Kirkley, the Pledge of Allegiance to the Texas Flag was led by Grants and Special Projects Coordinator Aaron Harris, and the Invocation was given by Mayor Pro Tern David K. Leigh. 1. Call to order. Mayor Marion Grayson called the meeting to order at 5:30p.m. 2. Public Comments. Rae Schmuck, 2200 Legacy Lane, Apt #511, gave an update on the 1874 Church renovation project, saying progress continues to be made. Matt Bates, City of Belton Director of Parks & Recreation, discussed two Spring cleanup events that have recently occurred. On April 2, 2016, 56 volunteers from the University of Mary Hardin-Baylor helped clean up behind Jaycee Field. On April 9, 2016, 126 volunteers helped clean 25 work sites in the One Community, One Day event coordinated by the City's Youth Advisory Commission. Cynthia Hernandez, Belton Rotary President, spoke about the Rotary After Work (RAW) events taking place on Tuesday nights at the Harris Community Center. She invited the Council to stop by the food truck and get dinner after the Council meeting. 3. Presentations and Recognitions: A. Presentation by Genevieve Gregg on the legacy of Jeff Hamilton. Ms. Genevieve Gregg gave a presentation on Jeff Hamilton, her great grandfather. She talked about his life and how he impacted the community and the nation. She challenged the City to honor Jeff Hamilton as he deserves, in some appropriate way. B. Introduction of New Employees. Department Heads introduced new employees that were hired during the first quarter of 2016. If discussion is desired by the Council, any item may be removed from the Consent Agenda prior to voting, at the request of any Councilmember, and it will be considered separately. 4. Minutes of previous meetings: A. March 22, 2016, City Council Workshop B. March 22, 2016, City Council Meeting 5. Consider an Amendment to the lnterlocal Cooperation Agreement between the City and Municipal Utility District No. 1 regarding the provision of solid waste and recycling services. 6. Consider authorizing extension of lease agreement between the City and Belco Manufacturing Company, Inc. for property located on Taylor's Valley Road. 7. Consider designating signatories for safe deposit box at the City's depository bank. 8. Consider a resolution directing Oncor electric delivery company, LLC to file certain informatioh with the City of Belton: setting a procedural schedule for the gathering and review of necessary information in connection therewith: setting dates for the filing of the City's analysis of the company's filing and the company's rebuttal to such analysis: ratifying the hiring of legal counsel and consultants: reserving the right to require the reimbursement of the City of Belton's rate case expenses: setting a public hearing for the purposes of determining if the existing rates of Oncor electric delivery company are unreasonable or in any way in violation of any provision of law and the determination by the City of Belton of just and reasonable rates to be charged by Oncor electric delivery company, LLC. 9. Consider authorizing the City Manager to execute Change Order No. 1 to the Performance Contracting Agreement between the City of Belton and Siemens Industry, Inc. to extend the completion date for the Automated Metering Infrastructure project. Upon a motion by Mayor Pro Tern David K. Leigh to approve Consent Agenda items 4, 5, 7-9 (item 6 was withdrawn at the beginning of the meeting), and a second by Councilmember Craig Pearson, Consent Agenda items 4, 5, and 7-9, including the following captioned resolution , were unanimously approved upon a vote of 7-0. Belton City Council Meeting April 12, 2016 - Page 3 RESOLUTION NO. 2016-15-R DIRECTING ONCOR ELECTRIC DELIVERY COMPANY, LLC TO FILE CERTAIN INFORMATION WITH THE CITY OF BELTON; SETTING A PROCEDURAL SCHEDULE FOR THE GATHERING AND REVIEW OF NECESSARY INFORMATION IN CONNECTION THEREWITH; SETTING DATES FOR THE FILING OF THE CITY'S ANALYSIS OF THE COMPANY'S FILING AND THE COMPANY'S REBUTTAL TO SUCH ANALYSIS; RATIFYING THE HIRING OF LEGAL COUNSEL AND CONSULTANTS; RESERVING THE RIGHT TO REQUIRE THE REIMBURSEMENT OF THE CITY OF BELTON'S RATE CASE EXPENSES; SETTING A PUBLIC HEARING FOR THE PURPOSES OF DETERMINING IF THE EXISTING RATES OF ONCOR ELECTRIC DELIVERY COMPANY ARE UNREASONABLE OR IN ANY WAY IN VIOLATION OF ANY PROVISION OF LAW AND THE DETERMINATION BY THE CITY OF BELTON OF JUST AND REASONABLE RATES TO BE CHARGED BY ONCOR ELECTRIC DELIVERY COMPANY, LLC. Regular Agenda 10. Consider reaffirming the Fund Balance Policy for the City of Belton. Director of Finance Brandon Bozon stated that the City has established a Fund Balance Policy that defines the elements of the City's fund balance. The policy sets guidelines on the amount of money to maintain in fund balance in order to mitigate future risk and to preserve liquidity. He explained that it is essential that the City maintain adequate levels of unassigned fund balance to mitigate financial risk that can occur from unforeseen revenue fluctuations, unanticipated expenditures and similar circumstances. The unassigned fund balance is what the City's uses for things such as grant matches, land acquisition or any other capital items that come up during the year. Mr. Bozon said that some questions about the amount to keep in fund balance have come up recently. He explained that the City's policy is to keep 25°/o of the annual operating expenditures plus 100% of the annual debt service in Unassigned Fund Balance. He presented the following balances as of October 1, 2015: General Fund • Unassigned Fund Balance: $4,774,571 • In Excess of Minimum: $1,697,067 Water & Sewer Fund • Unassigned Fund Balance: $5,127,110 • In Excess of Minimum: $2,690,255 Drainage Fund • Unassigned Fund Balance: $260,959 Belton City Council Meeting April 12, 2016 - Page 4 • In Excess of Minimum: $170,273 He said that there are no proposed revisions to the policy for 2016; however, the policy should continue to be periodically reviewed and revised by Council as appropriate and necessary. Upon a motion by Councilmember Paul Sanderford and a second by Councilmember Guy O'Banion , item 10 was unanimously approved upon a vote of 7-0. 11. Hold a Public Hearing and consider approval of an ordinance on second and final reading amending an exclusive franchise to Waste Management to include service to Bell County Municipal Utility District No. 1, and authorize the City Manager to execute an amendment to the Municipal Solid Waste Collection and Transportation Agreement between Waste Management and the City of Belton to reference the inclusion of the Bell County Municipal Utility District No. 1 in the exclusive service area granted to Waste Management. Director of Finance Brandon Bozon stated that this is the second reading of the revised franchise ordinance authorizing Waste Management to provide residential solid waste service to the customers of the Municipal Utility District No. 1 through its exclusive franchise with the City of Belton. Mr. Bozon said that it is a win-win for the City, the customers of the MUD and for Waste Management. He reminded Council that the existing agreement is in effect through 2018 and may be extended for two additional years. The Mayor opened the public hearing on this item. Seeing no one wishing to speak for or against the item , the Mayor closed the public hearing. Upon a motion by Councilmember Craig Pearson and a second by Councilmember O'Banion, the following captioned ordinance was unanimously approved on second and final reading upon a vote of 7-0. ORDINANCE NO. 2016-15 AN ORDINANCE AMENDING AN EXCLUSIVE FRANCHISE TO WASTE MANAGEMENT OF TEXAS, INC., TO INCLUDE PROVIDING RESIDENTIAL SOLID WASTE COLLECTION, DISPOSAL AND RECYCLING SERVICES WITHIN THE BOUNDARIES OF BELL COUNTY MUNCIPAL UTILITY DISTRICT NO. 1. 12. Consider authorizing the purchase of an ambulance through the BuyBoard Cooperative Purchasing Network from Frazer, Ltd., via Mac Haik Dodge Chrysler Jeep in the amount of $154,025 to be funded through the Greathouse Trust Fund. Belton City Council Meeting April 12, 2016 - Page 5 Fire Chief Bruce Pritchard explained that the Greathouse Trust held a meeting prior to the Council meeting and authorized the funding for the purchase of a new front line ambulance. This new ambulance will replace a 2008 ambulance with over 140,000 miles of use which will be traded in for $5,000 credit toward the purchase of the new ambulance. The new ambulance should be available in late December 2016. The cost of the new ambulance, to be funded through the Greathouse Trust Fund , is $154,025. Upon a motion by Councilmember Jerri Gauntt and a second by Mayor Pro Tern Leigh , item 11 was unanimously approved upon a vote of 7-0. Mayor Grayson presented biographical information on lora Lee Greathouse and discussed how she provided for a trust to be established to help the emergency medical service of the Belton Fire Department. Mayor Grayson expressed the City's appreciation for such a thoughtful community gesture by one of our citizens. 13. Consider authorizing the City Manager to execute the First Amendment to the Ownership and Management Agreement for the Temple-Belton Wastewater Treatment Plant between the City of Temple and the City of Belton. Director of Finance Brandon Bozon stated that, in 2013, ownership of the Temple- Belton Wastewater Treatment Plant was transferred from the Brazos River Authority to the Cities of Temple and Belton. At that time, the cities entered into an Ownership and Management Agreement. The O&M Agreement outlines each City's responsibility with regards to ownership, operation and management of the plant. Mr. Bozon said that the current agreement acknowledges that Temple owns an undivided 75°/o share of the plant, and Belton owns an undivided 25°/o share of the plant. He explained that legally the relationship between the two cities is referred to as a "tenancy in common." As tenants in common, the Cities have the responsibility to account for any profits received , and the Cities must share those profits according to their respective ownership interests. The Cities must also share in any maintenance and operation costs related to those profits according to their ownership interests. Mr. Bozon added that in 2013 the City of Temple entered into an "Effluent and Water Purchase Agreement" with Panda Temple Power II, LLC which requires Temple to sell a certain amount of plant effluent to Panda over a 30 year period. Because Temple is receiving payment for the effluent, it must account for Belton's 25%> share of the payments received from Panda and pay those amounts to Belton , as a tenant in common . For this reason, the O&M Agreement should be amended to acknowledge the existence of the current agreement with Panda Energy; to provide for payment to Belton of its 25o/o share of all amounts already received from Panda (minus any maintenance & operation costs); to provide a process for accounting for future sales Belton City Council Meeting April 12, 2016 - Page 6 of effluent from TBP; and to extend the term of the O&M Agreement from 5 years to 10 years. Additionally, Mr. Bozon said that the First Amendment states that if either City begins discussions or negotiations with a third party for the sale of effluent, the City involved in the discussions must notify the other City immediately regarding such discussions and allow the other City to participate. The Cities will agree to act in good faith and use their best efforts to involve the other City in all discussions or negotiations regarding the possible sale of effluent. He explained that the amount due to the City of Belton is calculated as 25%> of the total billed for effluent water sales less 25% of the operating and maintenance costs associated with the re-use operation. The amount billed for effluent water sales for FY 2015 was $400,272.42. The gross amount due to the City of Belton is $100,068.11. This amount is reduced by 25% of the operating and maintenance costs associated with the re-use operation of $3,184. The net amount due to the City of Belton for FY 2015 is $96,884.11. The amount billed for effluent water sales for FY 2016 through March 31, 2016 is $348,528.05. The gross amount due to the City of Belton is $87,132.01. This amount will be reduced by 25% of the operating and maintenance costs associated with the re-use operation. Upon a motion by Councilmember Craig Pearson and a second by Councilmember Paul Sanderford, item 13 was unanimously approved by a vote of 7-0.
