Belton City Council Meeting May 14, 2019 - 5:30 P.M. The Belton City Council met in regular session in the Wright Room at the Harris Community Center with the following members present: Mayor Marion Grayson, Mayor Pro Tern Craig Pearson and Councilmembers David K. Leigh, Dan Kirkley, Guy O'Banion, John R. Holmes, Sr. and Wayne Carpenter. Staff present included Sam Listi, Gene Ellis, John Messer, Amy Casey, Brandon Bozon, Chris Brown, Matt Bates, Paul Romer, Bob van Til, Bruce Pritchard, Angellia Points, Charlotte Walker, Cynthia Hernandez, Judy Garrett, Cheryl Maxwell and Kelly Atkinson. The Pledge of Allegiance to the U.S. Flag was led by Mayor Pro Tern Craig Pearson, and the Pledge of Allegiance to the Texas Flag was led by Director of Planning Cheryl Maxwell. The Invocation was given by Andy Davis, Senior Pastor of First Baptist Church of Belton. 1. Call to order. Mayor Grayson called the meeting to order at 5:32 p.m . 2. Presentation of Council pay for 2018-2019. City Clerk Amy Casey presented each member of the Council with their $1 pay for the previous year. Each dollar bill was folded into an origami shape representative of each Councilmember. 3. Consider an ordinance canvassing the May 4, 2019, General Election returns. Although she was not present, Mayor Grayson thanked Cindy Black for participating in the election, stating that she brought out quite a few voters. She added, "I'm proud of her." City Clerk Amy Casey read the results of the May 4, 2019, General Election: Councilmember (The top four are declared winners.) Craig Pearson - 343 votes Dan Kirkley - 340 votes David K. Leigh - 333 votes John R. Holmes, Sr. - 311 votes Cindy Black - 210 votes Mrs. Casey also reviewed the last few years of historical voter turnout, and encouraged a greater participation in future elections. Upon a motion by Mayor Pro Tern Craig Pearson, and a second by Councilmember Carpenter, the followil'lg captioned ordinance was unanimously approved by a vote of 7-0.  Belton City Council Meeting May 14, 2019- Page 2 ORDINANCE NO. 2019-19 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF BELTON, TEXAS, DECLARING THE RESULTS AND CANVASSING THE RETURNS OF THE GENERAL ELECTION HELD WITHIN SAID CITY ON MAY 4, 2019. , 4. Administer the Oath of Office to newly elected Councilmembers. City Attorney John Messer administered the Oath of Office to Councilmembers Craig Pearson, David K. Leigh , Dan Kirkley and John R. Holmes, Sr. 5. Select Mayor Pro Tern. Upon a motion by Councilmember Craig Pearson, and a second by Councilmember Dan Kirkley, Wayne Carpenter was unanimously approved as Mayor Pro Tern by a vote of 7-0. 6. Public Comments. Jay Howard with Texas Disposal Systems introduced his company and stated that his company is interested in providing a proposal for solid waste services when the Request for Proposals is released. Mayor Grayson asked him to provide his contact information to Director of Finance Brandon Bozon. Mayor Grayson recognized and congratulated members of Belton's Youth Advisory Commission who received the President's Silver Volunteer Service Award at a banquet in Killeen on May 13, 2019. Director of Parks and Recreation Matt Bates introduced Jacob Jimenez, Madden Baggerly and Bradin McDonald, members of YAC, and stated that the entire group volunteered in excess of 600 hours this past year. 7. Proclamations and Recognitions: A. National Bike Month - May 2019 Kendra Coufal of CTCOG/KTMPO was present to receive this proclamation. B. National Public Works Week - May 19-25, 2019 Director of Public Works Angellia Points and the Public Works Staff were present to receive this proclamation. C. Present two $1,000 Scholarships from Waste Management, Inc. to Belton ISO graduating seniors. Belton City Council Meeting May 14, 2019- Page 3 Public Information Officer Paul Romer and Paul Daugereau of Waste Management presented Bradin McDonald and Maia Borchardt with $1 ,000 scholarships. Consent Agenda Items 8-11 under this section are considered to be routine by the City Council and may be enacted by one motion. If discussion is desired by the Council, any item may be removed from the Consent Agenda prior to voting , at the request of any Councilmember, and it will be considered separately. 8. Consider minutes of April 9, 2019, City Council meeting. 9. Consider a resolution denying Oncor's application to the Public Utility Commission of Texas for approval of a Distribution Cost Recovery Factor. 10. Consider an ordinance prescribing the classifications for police officer and firefighter positions, and the maximum number of positions in each classification. 11. Consider authorizing the Citv Manager to execute a Memorandum of Understanding with the Bell County Public Health District for a Medical Countermeasure Plan. Upon a motion by Councilmember Holmes and a second by Councilmember O'Banion, the Consent Agenda, including the following captioned resolution and ordinance, was unanimously approved by a vote of 7-0. RESOLUTION NO. 2019-14-R A RESOLUTION OF THE CITY OF BELTON, TEXAS, FINDING THAT ONCOR ELECTRIC DELIVERY COMPANY LLC'S APPLICATION FOR APPROVAL TO AMEND ITS DISTRIBUTION COST RECOVERY FACTOR PURSUANT TO 16 TEX. ADMIN. CODE §25.243 TO INCREASE DISTRIBUTION RATES WITHIN THE CITY SHOULD BE DENIED; FINDING THAT THE CITY'S REASONABLE RATE CASE EXPENSES SHALL BE REIMBURSED BY THE COMPANY; FINDING THAT THE MEETING AT WHICH THIS RESOLUTION IS PASSED IS OPEN TO THE PUBLIC AS REQUIRED BY LAW; REQUIRING NOTICE OF THIS RESOLUTION TO THE COMPANY AND LEGAL COUNSEL. ORDINANCE NO. 2019-20 AN ORDINANCE PRESCRIBING THE CLASSIFICATIONS FOR POLICE OFFICER AND FIREFIGHTER POSITIONS AND THE MAXIMUM NUMBER OF POSITIONS IN EACH CLASSIFICATION. Belton City Council Meeting May 14, 2019 - Page 4 Regular Agenda 12.Hold a public hearing and consider an ordinance on second and final reading granting an extension to the commercial solid waste collection franchise with Sunbright Disposal Services. City Clerk Amy Casey said that in April 2015, Council authorized a commercial solid waste franchise with Sunbright Disposal Services. The original term of the franchise ended on April 26, 2018, and a one year extension to the franchise agreement was granted. An additional one year extension is allowed under the original terms of the agreement. However, Staff would like the term of this franchise to terminate at the same time as the City's other commercial solid waste franchises, so an extension only to January 26, 2020 is recommended. The City also has commercial solid waste franchise agreements with Waste Management, Eagle Disposal, Temple Iron & Metal and Waste Connections, as well as Sunbright. The City receives 5% of the companies' total gross receipts from customers as a franchise fee. FY2019 Budget for this franchise fee is $110,900 from all commercial haulers. In accordance with the City Charter, franchise ordinances require two readings and a public hearing. Mrs. Casey said Staff recommends holding the public hearing and approving the ordinance granting an extension to Sunbright until January 26, 2020. Mayor Grayson opened the public hearing. Seeing no one wishing to speak, she closed the public hearing. Upon a motion by Councilmember Leigh and a second by Councilmember Holmes, Item #12, including the following captioned ordinance, was unanimously approved by a vote of 7-0. ORDINANCE NO. 2019-18 AN ORDINANCE AMENDING A FRANCHISE AGREEMENT WITH SUNBRIGHT DISPOSAL SERVICES, TO PROVIDE COMMERCIAL SOLID WASTE COLLECTION SERVICES WITHIN THE CITY OF BELTON; AND MAKING OTHER PROVISIONS. 13. Consider authorizing the City Manager to enter into a professional services agreement with Kasberg, Patrick & Associates for bidding and construction phase services for the Old Waco Road Sewer Project. Director of Public Works Angellia Points said that Belton has aging water and sewer infrastructure. Some lines are near the point of failure and/or the lines may be too small for the surrounding development. She said this is the case for the following five (5) projects: 1. Leon Street Sewer and Water Replacement - COMPLETED October 2018. Belton City Council Meeting May 14, 2019 - Page 5 2. Old Waco Road Sewer Replacement - the sewer line is aging , causing some parts of the clay line to collapse and cause back-ups. 3. East and 5th Waterline Replacement - the waterline is aging and has broken in several places; the line needs to be replaced to prevent additional breaks. The project is designed and shelved until funding becomes available. The City has applied for a CDBG grant for this project. A decision is expected late 2019. 4. Old Golf Course Road Waterline Replacement - the waterline is too small and needs to be at least an 8" line to support fire and domestic flows and pressures. The project has been designed and is shelved until funding becomes available. 5. Ave S Waterline Replacement between S Wall and Miller Streets - the waterline is too small and needs to be an 8" to support fire and domestic flows/pressures . The project has been designed and is shelved until funding becomes available. Mrs. Points explained that the design services contract for these projects was awarded to Kasberg , Patrick and Associates in January 2018, and was funded by the 2018 Utility Capital Improvement Project Fund . Following the Leon Street water and sewer project, the Old Waco Road Sewer Project is considered the next top priority project. The Old Waco Road Sewer Project has been designed and all fourteen (14) easements (11 property owners) have been obtained by donation. The property owners who have provided easements understand the need for the project and are excited the City has taken on the project to correct the issues. Mrs. Points said the project is ready to be bid and constructed. The scope awarded to KPA in January 2018 included the design phase services, but it did not include bidding or construction administration services. Staff recommends awarding a contract to KPA for bidding and construction administration services on the Old Waco Road Sewer Project in the amount of $64,420. Upon a motion by Councilmember Holmes and a second by Councilmember Pearson, Item #13 was unanimously approved by a vote of 7-0. 14. Consider authorizing the City Manager to enter into an agreement with Rohde Air Conditioning and Heating, LLC to provide and install the HVAC equipment and materials for Central Fire Station. Director of Public Works Angellia Points explained that in 2004, Central Fire Station was renovated to convert the bay area to a bunk area and restrooms. Soon after in 2007, humidity and mold issues were discovered. The issue was determined to be the negative pressure in the attic space, the lack of outside make-up air, and inadequate insulation of ductwork and ceiling. In 2008, the City and the architect, BRW, agreed upon a settlement. The City hired another firm to design the proposed solutions: insulate the ducting, design a new unit to treat outside air (AAON) , and balance the HVAC units. Mrs. Points stated that humidity continued to be an issue at the Central Fire Station. Staff performed internal changes and modifications to control the humidity and air flow concerns, however, the changes did not fix the problem. Staff then worked with Belton City Council Meeting May 14, 2019- Page 6 EIKON Consulting Group, LLC, and their team of engineers, to design a permanent solution. EIKON identified areas that are contributing to the humidity issues. • Roof-top units are single-phase, constant volume with no capacity control other than on/off. The existing units are 15 and 23 years old, at the end of their life span. • Sheet rock ceiling is trapping moisture in attic space and needs to be replaced with a drop-in ceiling. • Outside air is partially treated and sent into attic space with little to no venting . The AAON system requires frequent and expensive maintenance, and therefore is out of service for long periods of time. • The attic space is not sealed and needs to be reinsulated. • There is not a traditional vapor barrier in the walls of the bunk area. The sheathing needs to be replaced. • The bathroom walls extend above the ceiling and exhaust is restricted. This area needs to be opened up to a return air plenum. Points said that in order to move forward with the designed solution, the fire station was remediated for mold in December 2018. During the remediation, water infiltration through the bricks was discovered. To prevent water infiltration into the building in the future, the brick was removed and replaced, and a vapor barrier was added. Mrs. Points added that EIKON designed appropriately sized and type of HVAC units, along with the ducting, to serve the fire station. The design included two new roof- top units with outside-air components called energy recovery units. Additionally, all new supply ducting was specified for a return air plenum. On April 9, 2019, the following bids were received: • Rohde Air Conditioning and Heating, LLC $80,855.00 • Rabroker Air Conditioning and Plumbing $84,731.00 • Lochridge-Priest $96,830.00 • Bell Air Conditioning $98,076.23 The low bidder, Rohde, is qualified and recommended by Staff and EIKON to perform the work as specified . The contract amount of $80,855 is proposed to be funded by the General Fund Capital Projects and HVAC Equipment Replacement Fund. Mayor Grayson asked, "When is the anticipated move back in date?" Mrs. Points said Staff estimates it to be July or August.
